HomeMy Public PortalAbout2000-050 Resolution Granting Setback Variance to Eric Strommen and Judith Strommen for a Deck/Porch Replacement at 2235 Co. Rd. 24115 Member Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.00-50 RESOLUTION GRANTING SETBACK VARIANCE TO ERIC STROMMEN AND JUDITH STROMMEN FOR A DECK/PORCH REPLACEMENT AT 2235 CO. RD. 24 WHEREAS, Eric Strommen and Judith Strommen (the "Applicants") are the fee owners of property located at 2235 Co. Rd. 24 (the "Property"); and WHEREAS, the Property contains a deck and porch which do not comply with the current rear yard setback requirements applicable to the Property; and WHEREAS, the deck and porch need to be replaced because of their physical condition but, once removed, cannot be reconstructed in their current location without a rear yard setback variance; and WHEREAS, this matter was reviewed by the planning commission on September 18, 2000 and by the city council on October 3, 2000; and WHEREAS, it has been determined that granting the requested setback variance to permit reconstruction of the deck and porch is justified by the specified hardship and is in keeping with neighborhood standards. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a variance be granted to the Applicants to reduce the required rear yard setback from 40' to 34' in order to reconstruct a deck and porch on the Property, subject to the following terms and conditions: 1. The deck and porch must be constructed in substantial compliance with the plans and specifications presented to and reviewed by the planning commission and city council and must be no larger than the existing improvements they are intended to replace; RHB-187571 v 1 ME230-8 00-50 10-17-00 116 2. The Applicants must comply with all building code and other ordinance requirements in reconstructing the deck and porch; and 3. The Applicants must complete construction of the new deck and porch within one year of the date of this resolution or the approval hereby granted will be null and void. BE IT FURTHER RESOLVED by the city council of the city of Medina, Minnesota, that the setback variance hereby granted to the Applicants is in compliance with the neighborhood standards and that a hardship is present on the Property due to the placement of the existing house.
