On August 29, 2011 the Town of Gulf Stream issued zoning approval
for the replacement of the roof on the home you own at 2520 Avenue
Au Soleil and issued Receipt Number 5777 to your contractor, Rooftec
Corporation. On August 30, 2011, the City of Delray Beach issued the
re -roofing Permit Number 11-135146 to Rooftec Corporation. The approved
permit covered re -roofing the structure with white, thru and thru,
flat cement tile with no slurry coating or paint. This work was started
but has, to date, not been completed in conformity with the permit
that was issued.
Section 42-29 CONSTRUCTION ABANDONMENT states that failure of the
permit holder or the property owner to complete construction once it
has been initiated within the timeframe of the building permit is
a violation.
Section 70-238 ROOFS requires that roofs on homes that are predominately
with Bermuda influences have flat, white thru and thru, smooth, un -coated
tile. The roof is in violation as there is no tile in place.
Section 70-99 ROOF DESIGN, SLOPE AND MATERIALS (3) Prohibited lists
inconsistent roofing materials visible from the exterior o t e property,
except approved accent materials. The material that has been applied is
inconsistent with roofing materials visible from the exterior of the
property or with any other house in town and thus is in violation
of this section of the Code.

SCOPE AND ADMINISTRATION
10533 An enforcing authority may not issue a building
permit for any building construction, erection, alteration,
modification, repair or addition unless the permit either
includes on its face or there is attached to the permit the fol-
lowing statement: "NOTICE: In addition to the require-
ments of this permit, there may be additional restrictions
applicable to this property that may be found in the public
records of this county, and there may be additional permits
required from other governmental entities such as water
management districts, state agencies, or federal agencies.'
1053.4 A building permit for a single-family residential
dwelling must be issued within 30 working days of applica-
tion therefor unless unusual circumstances require a longer
time for processing the application or unless the permit
application fails to satisfy the Florida Building Code or the
enforcing agency's laws or ordinances.
105.3.5 Identification of minimum premium policy.
Except as otherwise provided in Chapter 440, Florida Stat-
utes, Workers' Compensation, every employer shall, as a
condition to receiving a building permit, show proof that it
has secured compensation for its employees as provided in
Section 440.10 and 440.38, Florida Statutes.
1053.6 Asbestos removal. Moving, removal or disposal of
asbestos -containing materials on a residential building
where the owner occupies the building, the building is not
for sale or lease, and the work is performed according to the
owner -builder limitations provided in this paragraph. To
qualify for exemption under this paragraph, an owner must
personally appear and sign the building permit application.
The permitting agency shall provide the person with a dis-
closure statement in substantially the following form:
Disclosure Statement: State law requires asbestos abate-
ment to be done by licensed contractors. You have applied
for a permit under an exemption to that law. The exemption
allows you, as the ownerof your property, to act as your own
asbestos abatement contractor even though you do not have
a license. You must supervise the construction yourself. You
may move, remove or dispose of asbestos -containing mate-
rials on a residential building where you occupy the build-
ing and the building is not for sale or lease, or the building is
a farm outbuilding on your property. If you sell or lease
such building within I year after the asbestos abatement is
complete, the law will presume that you intended to sell or
lease the property at the time the work was done, which is a
violation of this exemption. You may not hire an unlicensed
personas your contractor. Your work must be done accord-
ing to all local, state and federal laws and regulations which
apply to asbestos abatement projects. It is your responsibil-
ity to make sure that people employed by you have licenses
required by state law and by county or municipal licensing
ordinances.
1053.7 Applicable Code for Manufactured Buildings.
Manufacturers should be permitted to complete all build-
ings designed and approved prior to the effective date of a
new code edition, provided a clear signed contract is in
place. The contract shall provide specific data mirroring that
required by an application for permit, specifically, without
limitation, date of execution, building owner or dealer, and
anticipated date of completion. However, the construction
activity must commence within 6 months of the contract's
execution. The contract is subject to verification by the
Department of Community Affairs.
105.4 Conditions of the permit.
105.4.1 Permit intent. A permit issued shall be construed
to be a license to proceed with the work and not as authority
to violate, cancel, alter or set aside any of the provisions of
the technical codes, nor shall issuance of a permit prevent
the building official from thereafterrequiring acorrection of
errors in plans, construction or violations of this code.
Every permit issued shall become invalid unless the work
authorized by such permit is commenced within six months
after its issuance, or if the work authorized by such permit is
suspended or abandoned for a period of six months after the
time the work is commenced.
105.4.1.1 If work has commenced and the permit is
revoked, becomes null and void, or expires because of
lack of progress or abandonment, a new permit covering
the proposed construction shall be obtained before pro-
ceeding with the work.
105.4.1.2 If a new permit is not obtained within 180 days
from the date the initial permit became null and void, the :
building official is authorized to require that any work
which has been commenced or completed be removed
from the building site. Alternately, a new permit may be
issued on application, providing the work in place and :
required to complete the structure meets all applicable E
regulations in effect at the time the initial permit became E
null and void and any regulations which may have
become effective between the date of expiration and the :
date of issuance of the new permit.
105.4.13 Work shall be considered to be in active prog-
ress when the permit has received an approved inspec-
tion within 180 days. This provision shall not be
applicable in case of civil commotion or strike or when
the building work is baited due directly tojudicialinjunc- t
tion, order or similar process.
105.4.1.4 The fee for renewal reissuance and extension
of a permit shall be set forth by the administrative author-
ity.

105.7 Placement of permit. The building permit or copy shall
be kept on the site of the work until the completion of the pro-
ject.
105.8 Notice of commencement. As per Section 713.135,
Florida Statutes, when any person applies for a building per-
mit, the authority issuing such permit shall print on the face of
each permit card in no less than 14 -point, capitalized, bold-
faced type: "WARNING TO OWNER: YOUR FAILURE TO
RECORD A NOTICE OF COMMENCEMENT MAY
RESULT IN YOUR PAYING TWICE FOR IMPROVE-
MENTS TO YOUR PROPERTY. IF YOU INTEND TO
OBTAIN FINANCING, CONSULT WITH YOUR LENDER

Dear Mr. S Mrs. O'Hare:
There are several code violations on the property owned by you
located at 2520 Avenue Au Soleil. These violations are as follows:
1. Expired Re -roofing Permit 511-135146. Section 42-29 of the
Gulf Stream Code of Ordinances states that all authorized
construction shall be completed prior to exoiration of the
permit. Florida Building Code Section 105.4,1.3 states that work
shall be considered to be in active progress when the permit
has received an approved inspection within 180 days. The last
roof inspection was April 26, 2012.
2. No overlay material in place on roof. Section 22-32(5) states
the roof shall be constructed 5 maintained so as not to leak
and they shall be kept clean and painted.
3. Removal of a portion of driveway without obtaining a permit.
This is a violation of Section 58-138(b).
4. Installation of landscape material that does not reinforce the
identy of the applicable zoning district as stated in Section
70-146 and further is in violation of Section 70-32(a)that states
this district is characterized as havinq "oven front lawns'.'.
5. Some of the plants in the landscaping pallet are not listed
within the Code at Section 70-150 ie. the Lady Palms and the
plantings also include species not listed as appropriate or
typical for Gulf Stream or Place Au Soleil

Two styles of architecture have historically dominated the character of Gulf Stream homes: Spanish
Mediterranean Revival style and Gulf Stream -Bermuda style. While the use of these two styles is
therefore encouraged, it is not required. The provisions of this article are Intended for those choosing one
of these styles and are intended to guide the process of design for new construction as well as
remodeling and renovation.
Sec. 70-207. Styles unique to the town.
The style definitions contained in this article are unique to the town. Although these architectural
styles are used throughout South Florida and in other parts of the country, there are certain adaptations
of them that are unique to the town. Chief among these adaptations is a more formal and uncomplicated
use of form and materials than is typically associated with these styles, particularly Spanish
Mediterranean Revival. Users of this chapter are therefore advised to closely study the standards
provided in this article and not rely solely on outside reference books or existing structures in other
communities for guidance on how to use these styles.

A property by property survey was conducted in March of 1997 to identify existing homes designed
In the Spanish Mediterranean or Gulf Stream -Bermuda styles as defined in this article. This survey was
updated in October of 1999 to reflect architectural approvals granted in the proceeding 2'% years. The
locations of these homes are shown on the map on the following page. These homes, as well as those
constructed after the date of the survey and classified as having one of these styles, will be subject to the
standards contained in this article when additions or rehabilitations are proposed.

Many beachfront houses exhibit Spanish Mediterranean Revival style architecture. Strong unifying
characteristics include barrel tile roofs, pale washed walls, simple uncluttered detailing, and the
appearance of thick walls. The emphasis on open architecture such as balconies, courtyards, and
verandas, is suited for the town's subtropical climate. The selected architectural styles, Spanish and
Mediterranean Revival, will be described through a series of graphics and the use of explicit architectural
vocabulary. Appropriate variations or interpretations of this style are permitted.
Mediterranean Revival Style
Sec. 70-217. Building form.
(a) Characteristics. Distinguished by simple and strong configurations, Spanish and Mediterranean style
homes are typically either one or two stories. These structures often exhibit an asymmetrical facade
with varying roofs. Wall planes predominate over openings on primary surfaces (windows, doors,
etc.). Usually one or more predominant arches are incorporated above the main entrance or principal

window. Arches are also used below porches and verandas. They are typically semicircular and in
regular series with columns as supports or walls. Stucco columns should be square, rectangular, or
round and appear massive in thickness. The column height should be four to five times the width of
the column. Balconies or porches should be Integrated Into the building form to add articulation.

Sec. 70.221. Exterior materials; colors.
(a) Characteristics.
(1) Stucco is the primary Spanish and Mediterranean type wall surface material utilized throughout
the town. A smooth stucco finish with a hand -troweled, modeled look is typical. Accent materials
and colors used to complement the stucco are encouraged in moderation. The use of tile, wood,
brick, and finished concrete should be used as design accents only. Buildings are encouraged
to have up to three colors, one base color and two trim colors. The trim colors would typically be
used on the cornice bands and window articulation.
(2) Unlike some Spanish and Mediterranean homes found elsewhere, the Spanish and
Mediterranean homes in the town have a relatively simple and unadorned design with a limited
use of decorative elements such as wall tile, wall fountains, non-standard windows (e.g.
hydrafoils) and varied eave finishes.

Gulf Stream -Bermuda style architecture refers to the majority of houses in the town that exhibit a
combination of Bermuda, British Colonial, or Georgian characteristics. Gulf Stream -Bermuda style
architecture places emphasis on simple, straightforward design. Roofs are a predominant and Identifiable
feature. Gulf Stream -Bermuda style roofs do not recycle rain water as Bermuda roofs do, but the white
tiles do reflect the heat of the sun and the extended overhangs provide shade and shelter from our rainy
climate. Decorative chimneys adorn most roofs, while contrasting details such as shutters and doors add
interest and charm to this style.
Sec. 70-237. Building form.
(a) Characteristics. Most Gulf Stream -Bermuda style houses are patterned after simple rectilinear forms.
Although the majority are rectangles, many houses have L- and U-shaped layouts. Most Gulf
Stream -Bermuda style houses are one story and often exhibit a central peak flanked by peaks over
projecting wings. Two-story houses should pay particular attention to reducing the size of the second
floor and applying articulation such as balconies, setbacks, and other design techniques to avoid
box -like massive buildings.
(b) Stepbacks. The use of stepbacks is appropriate to reduce excessive bulkiness and provide a
transition between first and second stories. A few critical stepbacks on a building are better than
several minor stepbacks that only complicate the facade and create busy architecture.

Dear Mr. Roeder,
I am receipt of your email dated December 10, 2012 concerning the above referenced
property address and subject. The following is the Town's response.
I. "Expired re -roofing permlt Rl1-135146. On November 5, 2012 a "Notice of
Violations" was prepared for delivery to Mr. O'Hare. On November 10, 2012
that "Notice of Violations" was hand delivered and received by Mr. O'Hare.
According to a written document received by the Town on December 11, 2012,
from the Delray Beach Pcrt it Department the subject expired permit was
renewed an November 14, 2012 which is shortly after Mr. O'Hare was in receipt
of the Town's "Notice of Violations". Therefore, the violation of an expired re-
roofing permit no longer exists.
2. This item, as directly related to item 1, is therefore no longer in violation of the
Town's Code.
All other items listed on the November 5, 2012 "Notice of Violations" remain
outstanding. The remaining outstanding violations am requested to be corrected by
January 17, 2013.

was a request for a permit revision, also dated September 16, 2016 and a sample of a roof the "Ludo Slate Ceramic
Roof Tile" that you would like approved.
The original permit 11135146 Is Inactive and may not be renewed or revised. The last inspection on this permit was
4/26/12 A new permit application for a re -roof on your structure Is required.
In your letter you have made several claims and statements In an attempt for you to better understand the Town's
position on this matter and also expedite the permit application process, the following information Is provided
As previously explained to you and also answered by me in my deposition held by another one of your
attorneys, Mr. Mark Hanna, esquire, the predominant architectural style of your horne Is, by code
definition, Gulf Stream Bermuda Although your letter states that you disagree, the Town's consultant
and the Town stand by this determination and c-oncluslon.
The Town agrees that the map you refer to does indicate the style of your home is"Other various
Although that designation is Inaccurate the map is not the determining factor of the architectural style
of a home, but rather and more importantly, the architectural style is determined by the architectural
elements that exist on the structure.
The sample of the the you have provided Is a flat red clay lite with a "fired" top finish applikd. This
type of roof tele Is prohibited for the architectural style of your home. Approval of this roof tile
exceeds my level of authority Your options are to apply for a variance and/or challenge my decision
on this matter The forms necessary for these options are available at Town Hall,

THE CITY OF DELRAY BEACH AND
THE TOWN OF GULF STREAM
THIS AGREEMENT entered into on this �)e day of bLY
2009 by and between the CITY OF DELRAY BEACH, FLORIDA, A Florida municipal
corporation, hereinafter referred to as "the CITY" and the TOWN OF GULF STREAM,
FLORIDA, a Florida municipal corporation, hereinafter referred to as "the TOWN".
WITNESSETH:
WHEREAS, the health, safety and welfare of the residents of both TOWN and
CITY will best be served by the CITY inspecting certain structures lying within the
TOWN'S limits; and,
WHEREAS, this Agreement evidences the intentions of the respective parties to
cooperate with each other in the furtherance of the public's interest.
NOW THEREFORE, it is hereby agreed by and between the parties hereto as
follows:
Section 1. Definitions:
Code: When used herein, the term "Code" shall mean the Florida Building Code
as amended.
Department When used herein, the term "Department" shall mean the City of
Delray Beach Community Improvement Department.
Building Official: Where used hereln, the term "Building Official" shall mean the
Chief Building Official for the City of Delray Beach.
Feels): When used herein, the term "fee" or "fees" shall mean the fee(s) charged
as a condition for plan review, building, electrical, or plumbing permit and/or the
inspection fee charged for inspection of work; both made a part hereof.
Inspector. When used herein, the term "inspector" shall mean any Building
Inspector in the employ of the CI'T'Y.
Permit: When used herein, the term "permit" shall mean permit issued by the
CITY for any construction work.
Permittee: When used herein, the term "permittee" shall mean any Individual,
corporation or other business entity applying for and/or holding a valid permit.

Structures: When used herein, the term "structures' shall mean any and all
above -ground, in -ground, and/or underground structures, and any and all construction,
mechanical, electrical and/or plumbing work for which a permit must be obtained.
Section 2. The CITY and TOWN, in consideration of the mutual promises and
benefits hereinafter set forth, receipt of which is hereby acknowledged, do hereby agree
as follows:
A. The purpose of this Agreement is to provide the TOWN with the expertise
and assistance of the CITY'S Department for the inspection and permitting of certain
construction projects within the TOWN'S limits for compliance with the Florida Building
Code.
B. The method by which this purpose will be accomplished is as follows:
The TOWN shall adopt an ordinance which:
a. incorporates by reference the provisions of the Code as
presently in force and effect in the CITY;
b. vests the responsibility for reviewing plans for compliance
With the Code, issuing permits, and inspecting structures
with the TOWN In the CITY S Department; and
C. upon adoption by the CITY of any amendments to said
Code, the TOWN shall immediately, upon notice by the CITY
amend its ordinance to accurately reflect such changes.
2. a. Plans for construction shall be submitted to the TOWN in
triplicate by the applicant and shall be reviewed by TOWN
for compliance with TOWN'S Zoning Code and other non -
construction compliance. The three (3) plans shall be
stamped and submitted to CITY by contractor or owner with
the attendant permit applicant and fees.
b. The Department shall review and process all plans,
submitted in triplicate, checking the same for compliance
with the Code; and determine the subsidiary permits
necessary and the amount of fees. For processing and the
inspection service, CITY shall receive one hundred percent
(100%) of the permit fee. Said fees shall be collected by
CITY. After reviewing and processing said construction
plans, CITY shall forward one set of said plans to the
contractor/owner with the permit and another set to the
TOWN with a copy of the permit. CITY shall not forward any
plans to TOWN without the attendant permit.
3. Applications for all permits shall be submitted to CITY on CITY
approved forms. The CITY shall process and prepare all permits for construction within
the TOWN. Any authorized individual may request the Department to inspect a project
on a given time and date. The permit inspection card and plans shall be on the
construction site at all times and the inspector, upon the completion of his inspection,
will mark the card either as to acceptance and the date thereof, or will note reason for
rejection and the date thereof. Upon satisfactory completion of the project and final
inspection, the Building Official will prepare the Certificate of Occupancy and will
forward said Certificate of Occupancy to TOWN which will issue the Certificate of
Occupancy to the permitee, or authorized agent thereof, with a copy to the CITY.
4. The TOWN shall be solely responsible for the enforcement of
violations of the provisions of said Code by persons, firms or corporations engaged in
construction within the TOWN.
5. The TOWN shall assume responsibility for the administration of all
consumer inquires. The TOWN shall forward to the Building Official only those inquires
concerning the plan review and inspection process, set forth above, and all others shall
be the responsibility of the TOWN_
6. The Building Official shall have the right to refuse to Inspect any
structure within TOWN should he/she deem It in the best interest of CITY. All such
determinations not to Inspect a structure shall be made in writing to TOWN.
7. Subject to the limitations of Florida Statute 768.28, the TOWN shall
hold harmless and indemnify CITY against any and all claims for damages of every kind
and nature including, but not limited to claims for property damage, personal injury or
death, arising out of the plan review and inspection process.
8. The TOWN shall annually supply CITY with a Certificate of
Insurance from the TOWN'S insurance carrier evidencing all the necessary insurance
coverage for CITY and the Bullding Official or any authorized agent of the Department
reviewing plans for construction within the Town and/or making inspections within the
TOWN. Said insurance certificates and coverage shall be satisfactory to the CITY'S
Risk Manager. The CITY is not obligated to undertake any action under this Agreement
until the CITY'S Risk Manager has approved said insurance certificate and coverage.
The approval by the CITY'S Risk Manager shall not be unreasonable withheld.
Section 3. Duration.
This Agreement shall be a continuing nature unless cancelled by either party for
any reason and without penalty, on not less than sixty (60) days written notice. Any
fees paid to CITY where inspection services are not completed shall be prorated in
accordance with the percentage of inspection completed and any excess shall be
refunded to TOWN.
Section 4. Miscellaneous
A. This Interiocal Agreement shall be filed pursuant to the requirements of
Section 163.01(11) of the Florida Statutes.
B. This Agreement shall be governed by and in accordance with the Laws of
Florida. The venue for any action arising from this Agreement shall be in Palm Beach
County, Florida.
C. Neither party shall assign or transfer any rights or interest in this
Agreement without the written consent of the other party.
D. This Agreement shall not be valid until signed by the Mayor and the City
Clerk of each party.
IN WITNESS WHEREOF, the parties hereto have caused these to be
signed by their duly authorized officers on the date set forth above.

AN ORDINANCE OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY,
FLORIDA, AMENDING CHAPTER 22, OF THE CODE OF
ORDINANCES, NUISANCES, AT ARTICLE I TO INCLUDE
A NEW SECTION 22-3 RELATING TO OBSTACLES TO
TRAFFIC AND PARKING; RESCINDING ARTICLE II,
RELATING TO DEBRIS, RUBBISH, WEEDS AND WILD
GROWTH IN ITS ENTIRETY AND PROVIDING FOR A
NEW ARTICLE 11 RELATING TO UNSIGHTLY, UNSAFE
OR UNSANITARY CONDITIONS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF
ORDINANCES IN CONFLICT; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS
Section 1. The Code of Ordinances of the Town of Gulf Stream is hereby
amended at Chapter 22, Nuisances, Article I, In General, to include a new Section 22-3,
to read as follows:
"Sec. 22-3. Obstacles to traffic and parking
(a) It shall be unlawful for any person to place and/or maintain
any obstructions within the public right-of-way of the Town without first
being given authority in writing by the Town to place said obstructions.
Obstructions shall include, but shall not be limited to, hedges, trees, walls,
fences, traffic triangles, or other obstacles intended to impede traffic or
parking or structures of any kind not previously approved in writing by the
Town.
(b) Any obstacles placed in the Town right-of-way in violation of
this section may be immediately and summarily removed by the Town and
shall be removed at the expense of the property owner.
(c) Any person found to be in violation of this section shall be
subject to the general penalty section of this code or, alternatively, shall be
subject to the jurisdiction of the Town's code enforcement process."
Section 2. The Code of Ordinances of the Town of Gulf Stream is hereby
amended at Chapter 22, Nuisances, by deleting Article Il, Debris, Rubbish, Weeds and
Wild Growth, Sections 22-31 through 22-34 inclusive, in its entirety, and substituting
therefore the following new Article II entitled Unsightly, Unsafe or Unsanitary Conditions
to read as follows.
"ARTICLE II. UNSIGHTLY, UNSAFE OR
UNSANITARY CONDITIONS
See. 22-31. Prohibited.
It shall be unlawful and shall constitute a nuisance for any owner of
land within the Town to have or permit thereon any:
(1) Conditions in violation of any of the provisions in this
chapter.
(2) Rank vegetational growth that exudes unpleasant or noxious
odors, high or rank vegetational growth that may conceal
pools of water, trash or filth, or any other de -posits that may
be detrimental to health.
(3) Brush, weeds or grass that shall be greater than eight inches
in height above the ground.
(4) Dead or dying trees, grass, shrubs, stumps, roots or
obnoxious growth.
(5) Sand, soil or other fill material used in connection with or
resulting from construction projects.
(6) Filth, garbage, trash or debris.
(7) Decayed or decaying buildings or structures, ruins of any
kind or buildings, docks, walls or other structures in a failing
or dangerous condition.
(8) Any condition which provides harborage for rats, mice,
snakes, or other vermin.
(9) Any building or other structure which is in such a dilapidated
condition that is unfit for human habitation, or kept in such an
unsanitary condition that it is a menace to the health of
people residing in the vicinity thereof, or presents a more
than ordinary dangerous fire hazard in the vicinity where it is
located.
(10) All unnecessary or unauthorized noises and annoying
vibrations, including animal noises.
(11) All disagreeable or obnoxious odors and stenches, as well
as the conditions, sub -stances, or other causes which give
rise to the emission or generation of such odors and
stenches.
(12) The carcasses of animals or fowl not disposed of within a
reasonable time after death.
(13) The pollution of any public well or cistern, stream, lake,
canal, or body of water by sewage, dead animals,
commercial wastes, or other substances.
(14) Any building, structure, or other place or location where any
activity which is in violation of local, state, or federal law is
conducted, performed or maintained.
(15) Any accumulation of stagnant water permitted or maintained
on any lot or piece of ground.
(16) Dense smoke, noxious or lethal fumes, lethal gas, soot, or
cinders, in unreasonable quantities.

(17) Any condition constituting a fire hazard
(18) Any worn-out, scrapped, partially dismantled, nonoperative,
unusable, or discarded materials or objects, such as
automobiles or parts thereof, building materials, machinery,
metal, wastepaper, rags, glass -ware, tinware, vehicles,
boats or parts thereof, or other items of junk. Failure of any
vehicle, or parts thereof, to have a valid license plate or
other registration certificate specifically attached to the
vehicle or part thereof, shall be prima facie evidence that
such property is worn out, scrapped, nonoperative, unusable
or discarded.
(19) Failure of any person who has cleared land pursuant to a
land clearing permit to resod, replant or periodically sprinkle
the cleared area to prevent creation of wind-blown dust or
dirt.
(20) A seawall or bulkhead which falls into a state of disrepair or
ruin so as to allow erosion to land adjacent thereto.
Sec. 22-32. Foundations, structural members and exterior surfaces.
Foundations and structural members located upon any lot, parcel of
land or premises in the Town shall provide a safe, firm and substantial
base and support for the structure, and shall meet the following conditions,
in addition to those set forth by the Town's building code.
(1)
No floor, ceiling, roof, beam or essential horizontal
component of a building shall sag in excess of 31/2 percent
of its span.
(2)
Exterior walls shall be reasonably free of cracks or holes
through which weather elements can enter the building or
structure, and all exterior surfacing material shall be kept
painted and in good repair.
(3)
Interior walls and ceilings shall be structurally sound.
(4)
All windows and doors to the outside shall be constructed
and maintained in such a condition as to exclude weather
elements or insects entering.
(5)
The roof shall be constructed and maintained so as not to
leak. Roofs shall be kept clean and painted.
(6)
Every inside and outside stair, every porch and
appurtenance thereto shall be constructed so as to be safe
to use and capable of supporting the load that normal use
may cause to be placed thereon, and in conformance with
the building code, and shall be kept in sound condition and
good repair.
(7)
Accessory buildings and other appurtenances such as
swimming pools, tennis courts, walls, gates and fences
situated on the premises shall be kept in a safe and good
state of repair.
Sec. 22-33.
Notice to abate; content.
Whenever it is made to appear to the Town Manager, or the Town's
designee, after investigation that a nuisance exists within the Town
pursuant to the provisions of this chapter, the Town Manager or the Town
Manager's designee shall forthwith prepare an estimate of the total cost of
removing, suppressing or abating the nuisance and cause to be served
upon the person owning, occupying or having the care or custody of any
lot or parcel of land upon or in connection with such nuisance a written
notice to remove, suppress or abate the nuisance.
The notice shall:
(1) Describe the prohibited act, occurrence or condition, in
sufficient detail to plainly identify same.
(2) State the legal description of the property on which the same
exists or is maintained.
(3) State the estimated total cost which will in the opinion of the
Town Manager cover the total cost of removing, suppressing
or abating same.
(4) The proportion of such cost proposed to be bome by the
Town, if any.
(5) The proportion of such estimated amount which shall be
bome by the owner or occupant of the premises involved.
(6) State that unless such prohibited act, occurrence or
condition has been effectively removed, suppressed or
abated on or before the time stated in the notice, to be not
less than 15 days after service of the notice, the Town will
remove, suppress or abate the same and assess the cost of
so doing, or such proportion thereof as it may deem
equitable and just, against the owner or occupant of the
premises involved, provided such assessment shall in no
event exceed the proportion of the estimated amount set
forth in the aforementioned notice to be bome by the owner
or occupant of the premises involved;
(7) That such notice shall be served upon the owner, occupant
or person having the care or custody of the particular
property Involved, if he or she be found upon the premises or
within the Town. In the event the owner, occupant or
custodian cannot be found within the Town after reasonable
and diligent inquiry, such notice shall be posted in a
conspicuous place upon the premises and a copy thereof
mailed by certified mall, return receipt requested, and by
regular mail, to the last known address of such owner,
occupant or person having the care or custody of the land
involved.
Sec. 22-34. Hearing.
Any person owning or occupying the property removed or otherwise
interested, who objects to the proposed removal, suppression or
abatement or levy of a special assessment under this subchapter, must
present in writing to the Town Manager, his or her objections, within ten
days of the mailing or posting of the notice and must request a hearing
before the Town commission, or the person shall have deemed to have
consented thereto. The hearing shall be on the first regularly scheduled
meeting following the request for the hearing. After the hearing, the Town
commission, in the exercise of its discretion, may approve, revise, modify
or abandon the proposed action.
Sec. 22-35. Abatement by Town.
If at the time specified in the notice as provided in section 42-91,
the nuisance has not been removed, suppressed or abated, or in the
event a hearing is held by the Town Commission and the notice is upheld
in whole or in part, the Town Manager shall cause to be removed,
suppressed or abated the nuisance referred to in the notice according to
the terms set forth in the notice or, in the event of a hearing, in the manner
approved by the Town Commission.
Sec. 22-36. Levy of special assessment lien against property.
(a) The Town Manager shall, as soon as practicable and within 30
days after the completion of work as authorized in this subchapter,
ascertain and determine the actual cost thereof and the respective
portions to be borne by the Town if any, and the owners or occupants of
the property involved and, thereupon shall notify the owner or occupant, in
writing, of the amount required to be borne by the owner or occupant. In
the event said amount is not paid to the Town within thirty days of the date
of said notice in writing, the Town Commission, by resolution, fix, levy and
impose a special assessment against the property involved in an amount
not exceeding either the actual cost of the work, or the estimated special
assessment stated in the notice.
(b) The resolution shall specify the following:
(1) Description of the work performed.
(2) Date of completion.
(3) Total cost
(4) The proportion of such cost to be financed and defrayed by
special assessment.
(5) The unit or basis for distributing the amount to be specially
assessed among the several parcels of property where more
than one parcel is liable for assessment.
(6) The fact that a lien has been assessed by the Town with a
complete schedule or breakdown of the specific amount of
special assessment levied and imposed against and upon
each respective particular parcel of property involved,
showing in detail the description of the property, name of
owner and amount of assessment as severally and
respectively levied and imposed.
(7) That such liens shall bear interest at a rate of eight percent
per annum compounded unless paid within 30 days after
publication of such resolution.
(8) That the Town clerk shall forthwith have prepared and filed
of record, the amount of such lien assessed against each
parcel of property, the date of completion of such work and
such other information as may be deemed appropriate.
(9) That the Town clerk shall cause the resolution to be
published by posting, or publication in a newspaper, as
required by law.
(10) That the Town shall have, assert and possess a lien,
superior to all other claims, except taxes, against and upon
the property as therein described for the respective amounts
of such special assessments as indicated above, together
with interest and costs of collection.
(11) Commanding the Town Manager to enforce collection thereof
Sec. 22-37. Civil actions.
In addition to the other remedies and charges provided in this
article, the Town attorney is authorized to file appropriate civil actions for a
temporary restraining order, temporary injunction, permanent injunction, or
for damages, against any person violating this article.
Sec. 22-38. Emergency action.
Nothing in this article shall be construed to limit the Town's
authority to immediately abate any nuisance existing on public or private
property should an emergency exist.
Sec. 22-39. Penalty.
In addition to the penalties prescribed herein, the violation of this
article may, upon conviction, be punished pursuant to Section 1-15 of the
Town's Code of Ordinances. Additionally, a violation of any of the
provisions of this article may be referred to code enforcement which has
jurisdiction pursuant to Chapter 2, Article II, Section 2-68."
Section 3. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of this Ordinance which can
be given effect without the invalid provisions or applications, and to this end the
provisions of this Ordinance are hereby declared severable.
Section 4. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which
conflict with this or any part of this Ordinance are hereby repealed.
Section 5. Codification.
This Ordinance shall be codified and made a part of the official Code of
Ordinances of the Town of Gulf Stream.
Section 6. Effective Date.
0
This Ordinance shall take effect immediately upon Its passage and approval, as
provided by law.

Defendant, ROBERT A. SWEETAPPLE (hereinafter "Defendant"), by and through the
undersigned counsel, and pursuant to Rule 11, Federal Rules of Civil Procedure, respectfully
serves the following Motion for Rule I 1 Sanctions and Incorporate Memorandum of Law, and as
grounds therefore, would state as follows:
FACTUAL BACKGROUND
The above -captioned matter involves a meritless and frivolous claim, as set forth
in the Plaintiff MARTIN E. O'BOYLE's ("Plaintiff' or "O'Boyle") Second Amended
Complaint; for slander pease against Defendant.
2. Plaintiff is a long time resident of the Town of Gulfstream ("Town"), a small
municipality with only 1,000 residents. [D.E. 411 at lr�¶ 5, 8. Moreover, Plaintiff is a self-
proclaimed "avid supporter" of Florida's Public Records Law and has by his own admission
submitted numerous public records requests to the Town as well as other municipalities and
agencies over the years. Id. at 19. Moreover, Plaintiff is no stranger to conflict with Town or the
legal system. Id. at j;¶ 10-17. Plaintiff has admittedly filed approximately twenty-nine (29)

lawsuits against the Town for alleged violations of the Public Records Law, including, but not
limited to approximately twelve (12) pending legal actions against the Town regarding alleged
violations of the Public Records Law, at the time this action was filed. Id, at ¶ 11.
3. Due to these pending lawsuits, the Town elected to "step up its defense of the
lawsuits", wherein the Town proceeded to hire Sweetapple as special counsel to assist its other
attorneys with respect to the defense of Plaintiff's numerous lawsuits against the Town. Id, at ¶¶
24-25.
4. O'Boyle further alleges that Defendant along with the Town of Gulf Stream's
Mayor, Scott Morgan, devised a plan to "defame, harass, intimidate, and antagonize" Plaintiff at
"private" meetings held between April 3, 2014 and June 10, 2014. Id. at ¶ 29. Specifically,
Plaintiff further asserts that Morgan and Sweetapple decided on a course of action to "falsely and
maliciously publish to others that Plaintiff is violating the civil and criminal provisions of the
federal and Florida RICO Acts by his filing and pursuit of public records cases," "falsely and
maliciously publish to others that Plaintiff's pursuit of public records cases against the Town is a
`scheme' devised by Plaintiff to `line his pockets' with profit," and "putting pressure on
Plaintiff's son and business associates in an effort to gain an undue advantage over Plaintiff in
[his) lawsuits against the Town" Id, at 130.
5. In this regard, Plaintiff alleges that "on several occasions over the last four
months, Sweetapple has spoken to friends, colleagues, business associates, and attorneys for
Plaintiff and conveyed the same message to each — Plaintiff is a criminal, he has violated the
federal and Florida RICO Acts, and that he is engaging in a for-profit scheme by having the
audacity to file public records requests and the will power to enforce them through lawsuits..."

and that a lawsuit would be filed soon against the Plaintiff for the alleged RICO violations. Id. at
¶¶ 32-33, 45-46.
6. In response to Defendant's First Set of Interrogatories, in particular Number 3,
which requested information related to the alleged defamatory statements made by Sweetapple,
Plaintiff was only able to specifically identify two instances: (1) July 2014 — settlement
discussions between Defendant as counsel for the Town of Gulf Stream, and Mark Hanna, an
attorney representing another town resident, Chris O'Hare, who has filed similar public records
suits against the Town, stating that the suits should be dismissed or Mr. O'Hare ran the risk of
being named in a RICO suit against O'Boyle; and (2) during a confidential settlement conference
between Defendant, as counsel for the Town of Gulf Stream, and Mark Hanna and Lou Roeder,
acting as counsel for Chris O'Hare and Mr. O'Hare himself, Defendant purportedly made the
statements alleged in paragraphs 30 and 32 of the Second Amended Complaint.
7. In fact, in or around February 12, 2015, the Town of Gulf Stream as well as the
Wantman Group, Inc. filed a Federal RICO Class Action suit against O'Boyle, Mr. O'Hare and
others, in the United States District Court for the Southern District of Florida, Case No.: 9:15-cv-
80182.
8. There is no Factual or legal basis to support O'Boyle's claims under federal or
slate law against Sweetapple.
9. The doctrines of Florida's absolute litigation immunity privilege, qualified
privileges as well as absolute immunity privilege as counsel/agent for the Town of Gulf Stream
clearly bars Plaintiff's claims. Moreover, the evidence in this matter establishes the truth of
Sweetapple's alleged statements which likewise serve as a complete bar to Plaintiffs claims.

10. The absence of a viable claim is se readily apparent that it amounts to a Rule 11,
Federal Rules of Civil Procedure, violation. As a result, Sweetapple, asks this Court for entry of
an Order imposing sanctions against O'Boyle and his attorneys.
11. In accordance with Rule 11(c)(2), this Motion for Rule I1 Sanctions will be
served upon O'Boyle, but will not be Bled with the Court until after the expiration of the safe
harbor period. If O'Boyle withdraws the Second Amended Complaint before then, this Motion
for Rule 11 Sanctions will not be filed with the Court, and Sweetapple will not seek sanctions
against O'Boyle or his attorneys.
MEMORANDUM OF LAW
It is axiomatic that a party who files a suit that is legally baseless and made without
reasonable and competent inquiry, is subject to sanctions under Rule 11. See, In re: BankAtlantic
Bancorp, Inc. Sec. Litie., 851 F. Supp, 2d 1299, 1308 (S.D. Fla. 2011) affdsub nom. Hubbard v.
BankAdantic Bancorp, Inc.. 503 F. Apple 671 (11th Cir. 2012); see also, Thompson v.
RelationServe Media, Inc.. 610 F.3d 628, 665 (11th Cir. 2010). In other words, a legal claim is
frivolous if no reasonably competent attorney could conclude that it has any reasonable chance
of success or is a reasonable argument to change existing law. Worldwide Primates. Inc. v.
Mc real 87 F.3d 1252, 1254 (11th Cir. 1996) citing Jones v. Int'I Riding Helmets. Ltd. 49 F.3d
692, 695 (11th Cir. 1995)); see also Davis v. Carl 906 F.2d 533, 538 (11th Cir. 1990) (noting
that legal claims are objectively frivolous when they ignore clearly established law). Further,
suits that are intended to harass a party are subject to Rule I I sanctions.' In re: Flinn 139 F.R.D.

1994).
In this regard, Rule 11(b), Federal Rule of Civil Procedure I I(b) provides that,
[b]y presenting to the court a pleading, written motion, or other paper—whether
by signing, filing, submitting, or later advocating it—an attorney certifies that to
the best of the person's knowledge, information, and belief, formed after an
inquiry reasonable under the circumstances:
(1) it is not being presented for any improper purpose, such as to harass, cause
unnecessary delay, or needlessly increase the cost of litigation;
(2) the claims, defenses, and other legal contentions are warranted by existing law
or by a non -frivolous argument for extending, modifying, or reversing existing
law or for establishing new law;
(3) the factual contentions have evidentiary support or, if specifically so
identified, will likely have evidentiary support after a reasonable opportunity for
further investigation or discovery; ..."
Fed. R. Civ. P. 1 I(b). Thus, under Rule 11, an attorney must make some reasonable inquiry into
the facts and the law. Worldwide Primates 87 F.3d at 1254, The reasonableness of the inquiry is
a fact -based question, dependent on the circumstances of the case at hand. Id.
A court confronted with a motion for Rule I I sanctions premised on the alleged frivolity
of a claim must first determine whether the party's claims or assertions are objectively frivolous
in view of the facts or law; if they are, the court must then determine whether the person who
signed the pleadings would have been aware they were frivolous had he made a reasonable
inquiry. Id An objective standard of reasonableness governs this inquiry. Baker v. Alderman.
158 Fad 516 (11th Cir. 1998); Donaldson v. Clark 819 F 2d 1551, 1556 (11th Cir. 1987) (en
Banc ). A legal claim is frivolous if no reasonably competent attorney could conclude that it has
any reasonable chance of success or is a reasonable argument to change existing law.
Worldwide Primates 87 F.3d at 1254 citing Tones, 49 F.3d at 695; see also Dgyis 906 F.2d at
538. As explained in detail below, Plaintiff's claims against Defendant fall squarely within the

purview of Rule 1 I and as such, Plaintiff and his attorneys should be sanctioned. Plaintiff's
claims set forth in the Second Amended Complaint are objectively frivolous and are clearly
barred under federal and state law. O'Boyle's counsel either knew or should have known that
the Second Amended Complaint was objectively frivolous. The entry of Rule 11 sanctions
against O'Boyle and his attorney are the property remedy for O'Boyle's improper conduct.
A. PLAINTIFF'S CLAIM FOR SLANDER PER SE
In order to prove a valid claim of slander per se, O'Boyle must establish that (1) the
defendant published a false statement; (2) about the plaintiff, (3) to a third party; and (4) the
party suffered damages as a result of the publication. Valencia v. Citibank Int'I 728 So.2d 330,
330 (-la. 3d DCA 1999); Fun Spot of Florida. Inc. v. Magical Midway of Cent. Florida. Ltd.,
242 F. Supp. 2d 1183, 1187 (M.D. Fla. 2002). Further, an actionable claim of slander per Se
must show that the purported slander impute to another (a) a criminal offense amounting to a
felony; (b) a presently existing venereal or other loathsome and communicable disease; (c)
conduct, characteristics, or a condition incompatible with the proper exercise of his lawful
business, trade, profession, or office; or (d) acts of unchasti[t]y. Campbell v. Jacksonville Kennel
Club, 66 So.2d 495, 497 (Fla. 1953).
1. Plaintiffs Claim for Slander per se is barred by the absolute litiaation immunity
orivileae
It is well established under Florida law that counsel involved in a judicial proceeding
enjoys an absolute privilege from civil liability for any act taken in relation to such proceedings.
Levin. Middlebrooks, Mabie, Thomas. Moves &. Mitchell- P.A. v. U.S. Fire Ins. Co 639 So.2d
606, 609 (Fla. 1994). In this case, Counts I of Plaintiffs Second Amended Complaint against
Sweetapple are based entirely on Defendant's alleged conduct preliminary to, in the course of,
and otherwise related to Defendant's defense of 30 plus, various law suits filed by Plaintiff

against the Town. In a recent decision, Florida's Fourth District Court of Appeal, in a matter
similar to the facts in this case, affirmed the trial court's dismissal with prejudice of the
plaintiffs defamation claim. McCullough v. Kubiak, 158 So.3d 739, 740 (Fla. 4th DCA 2015).
Specifically, the Court affirmed the trial court's opinion that alleged disparaging
statement(s) which were made during the course of a deposition of a non-party witness in an
attempt to scare the insurance company into a settlement were absolutely privileged.
McCullough v. Kubiak 158 So.3d 739, 740 (Fla. 4th DCA 2015). In this regard the Court
recognized that the privilege extended to conversations between opposing counsel in a pending
civil action in which the attorneys represented one of the parties involved. Id. citing Sussman v.
Damian. 355 So?d 809, 811 (Fla. 3d DCA 1977). In addition the Court relied on the holding in
Jackson v. BellSouth Telecomms. 372 F.3d 1250, 1276 (11th Cir. 2004) which noted that
"events taking place outside the courtroom during discovery or settlement discussions are no less
an integral part of the judicial process, and thus deserving of the protection of the [litigation]
privilege, than in -court proceedings." Id, citing Jackson v. BellSouth Telecomms., 372 F.3d
1250, 1276 (11th Cir. 2004)(internal citations omitted). Lastly, the McCullough Court
distinguished the facts in that matter from DelMonico v. Traynor, 116 So.3d 1205 (Fla. 2013),
noting that the facts in McCulloughlike those in this matter, do not fall within the narrow
scenario and concern presented in Delmonico. Id.
Notwithstanding the broad sweeping and bare bones allegations in the Second Amended
Complaint Plaintiff cannot maintain his claim for slander per se. Specifically, a review of
Plaintiff's interrogatory responses reveals that any purported statements by Mr. Sweetapple were
made during the course of confidential settlement discussions between Mr. Sweetapple on behalf
of his client, the Town of Gulf Stream and Mark Hana, Esq., Lou Roeder, Esq. as counsel for

Chris O'Hare as well as Mr. O'Hare. Notwithstanding, Plaintiffs inability to articulate and/or
establish two occasions where the alleged statements were made, it clear from the record that the
alleged statements of Mr. Sweetapple, fall with the absolute litigation immunity privilege as they
were done between counsel of represented parties, and during the course of settlement
discussions. As such, Plaintiffs claims for slander per se are clearly barred by the absolute
litigation immunity privilege.
2. Plaintiffs Claims are barred based upon the qualified privilege
Moreover, based upon the facts and evidence in this matter Plaintiffs claims are also
barred pursuant to a qualified privilege as recognized by the DelMonico Court precluding
Plaintiff's claim for slander per se DelMonico 116 So.3d at 1219. Specifically, the qualified
privilege applies where the statements are made out of court and are relevant to the underlying
suit. Id. Here the alleged statements were all made during the course of confidential settlement
discussions. Where as in this matter the qualified privilege applies, Plaintiff must then establish
express malice of Sweetapple. Id. Plaintiff has not and cannot establish the requisite malice
requirement to defeat the qualified privilege. As such, Plaintiffs slander per se fails as a matter
orlaw.
3. Plaintiffs Claims are barred by the absolute immunity privilege
In this matter all the alleged statements of Mr. Sweetapple, are barred by the absolute
immunity privilege. Casell v. India 964 So.2d 190, 193-94 (ila. 4th DCA 2007); Fla. State.
Univ. Bd. of Trustees v. Monk 68 So 3d 316, 318-19 (Fla, 1st DCA 2011); McNavr v. Kelly.
184 So.2d 428,429-31 (Fla. 1966); M.S. v. Nova Southeastern Univ. 81 So.2d 614, 617-19 (Fla.
4th DCA 2004); Fla. Stat. § 768.28; see e.g. Andrew H. Boros. P.A. v. Arnold P Carter M.D.,
P.A. 537 So.2d 1134, 1135 (Fla. 3d DCA 1989). Specifically, Florida's executive immunity

privilege extends to certain private parties who are in a contractual relationship with the Stale.
M.S.. 81 So.2d at 618-19; Fla. Stat. § 768.26. In this matter, all of Defendant's alleged
defamatory statements, even if true, were made during and in the scope of Defendant's role as
special counsel for the Town or Gulf Stream and are therefore based upon his contractual
relationship with the Town of Gulf Stream are absolutely immune from liability. Id.
4. Defendant's purported statements were of nure opinion
Further, the alleged statements by Mr. Sweetapple were of pure opinion precluding them
from being actionable as a matter of law. Colondy v. Iverson. Yoakum. Papiano & Hatch, 936
F.Supp. 917, 923 (M.D.Fla. 1996); Hay v. Independent Newspapers, Inc.- 450 So.2d 293, 295
(Fla. 2d DCA 1984). To be sure, to date the only individuals Plaintiff can identify that Mr.
Sweetapple made any of the alleged statements to, are Mark Hannah and Lou Roeder both of
whom are experienced attorney's practicing in Florida and Chris O'Hare, another resident of the
Gulf Stream engaged in public records requests and a party to the RICO action. Mr, Hannah hus
already testified in deposition in other matters that the alleged statements of Mr. Sweetapple
were merely his opinion based upon facts generally known and previously admitted by Plaintiff.
Under the totality of the circumstances, it is clear that any of Sweetapple' s alleged statements
were no more than his opinion with respect to Plaintiff's admittedly litigious conduct over the
last eighteen (18) months. As such, any of Sweetapple's alleged statements are not actionable as
a matter of law as they are of pure opinion and Plaintiff' has not and cannot establish that Mr.
Sweetapple acted with the requisite malice. See e.g. Estoril Inc, v. Villarreal 2009 WL 2876229,
"4 (S.D. Fla. Sept. 8, 2009).

It is an absolute defense to any claim for defamation/slander that the offending statements
were in fact true. See e.g. Rosenberg v. American Bowline Congress 589 F.Supp. 547, 551
(M D.Fla. 1984). In this matter, there can be no doubt that the alleged statements made by Mr.
Sweetapple were in fact true. Specifically, Plaintiff has alleged that Sweetapple stated that
O'Boyle has violated the federal and Florida RTCO Acts, that he believes O'Boyle's public
records requests and law suits are a scheme to make profit and that RICO suit was forth coming.
In or around February 12, 2015, the Town of Gulf Stream as well as the Wantman Group, Inc.
filed a Federal RICO Class Action suit against O'Boyle, Mr. O'Hare and others, in the United
States District Court for the Southern District of Florida, Case No.: 9:15-cv-80182, establishing
the Sweetapple's statements were in fact true and accurate. It follows that Plaintiffs slander per
se claim is completely unsupported by the facts and law and is grossly frivolous as the truth
serves as a complete bar to same.
WHEREFORE, and for the reasons detailed above, Defendant, ROBERT A.
SWEETAPPLE, respectfully requests that this Court enter an Order granting this Motion for
Rule I1 Sanctions against, Plaintiff, MARTIN O'BOYLE, and Plaintiffs counsel, DANIEL
DESOUZA, and award Defendant his attorneys' fees and costs incurred directly from these Rule
11 violations, and to take such further action as it deems just and proper.

Sec. 22-32. - Foundations, structural members and exterior surfaces.
Foundations and structural members located upon any lot, parcel of land or premises in the
town shall provide a safe, firm and substantial base and support for the structure, and shall
meet the following conditions, in addition to those set forth by the town's building code.
(5) The roof shall be constructed and maintained so as not to leak. Roofs shall be kept
clean and painted.

A permit issued shall be construed to be a license to proceed with the work and not as authority to violate,
cancel, alter or set aside any of the provisions of the technical codes, nor shall issuance of a permit prevent
the building official from thereafter requiring a correction of errors in plans, construction or violations of
this code. Every permit issued shall become invalid unless the work authorized by such permit is
commenced within six months after its issuance, or if the work authorized by such permit is suspended or
abandoned for a period of six months after the time the work is commenced.

If work has commenced and the permit is revoked, becomes null and void, or expires because of
lack of progress or abandonment, a new permit covering the proposed construction shall be obtained
before proceeding with the work.

If a new permit is not obtained within 180 days from the date the initial permit became null and
void, the building official is authorized to require that any work which has been commenced or
completed be removed from the building site. Alternately, a new permit may be issued on
application, providing the work in place and required to complete the structure meets all applicable
regulations in effect at the time the initial permit became null and void and any regulations which
may have become effective between the date of expiration and the date of issuance of the new
permit.
