Member Zietlow introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.00-55
RESOLUTION REGARDING VARIANCES AT 3120 CEDAR
AVENUE
WHEREAS, Roger Vieau (the "Applicant") is the fee owner of property located at 3120
Cedar Avenue (the "Property"); and
WHEREAS, the Applicant has requested permission to construct a 20' x 24' detached
garage on the Property which would require reducing the rear yard and front yard setbacks from 30'
to 15' each; and
WHEREAS, the Applicant has requested permission to construct a 12' x 12' porch on the
front of the house which would require reducing the front yard setbacks from Walnut Street and
Cedar Avenue from 30' to 24.5'; and
WHEREAS, this matter was reviewed by the planning commission on October 10, 2000
and by the city council on October 17, 2000; and
WHEREAS, the planning commission recommended granting variances from the front
yard setbacks from Walnut Street for both the porch and garage but denial of the rear yard setback
variance for the garage and the front yard setback variance from Cedar Avenue for the porch.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that variances be granted to the Applicant to reduce the required front yard setback from
Walnut Street from 30' to 15' to construct a detached garage on the Property and to reduce the
required front yard setback from 30" to 24.5" from Walnut Street for a porch, subject to the
following terms and conditions:
1. The detached garage and porch must be constructed in substantial compliance with

the plans and specifications presented to and reviewed by the planning commission and city
council;
2. No driveway may be constructed from Walnut Street to serve the detached garage;
3. The Applicant must comply with all building code and other ordinance requirements
in constructing the detached garage and porch; and
4. The Applicants must complete construction of the detached garage and porch within
one year of the date of this resolution or the approval hereby granted will be null and void.
The above variances are justified because there exists a hardship due to the topography of the lot
and the fact that it is on a comer and subject to two front yard setbacks.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of
Medina that the variance for rear yard setback for the detached garage and front yard setback from
Cedar Avenue for the porch are hereby denied because there is no hardship relating to the Property
which justifies granting the variances.

The motion for the adoption of the foregoing resolution was duly seconded by member Smith and
upon vote being taken thereon, the following voted in favor thereof:
Ferris, Johnson, Lane, Smith, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
