TUESDAY, JANUARY 3, 2006
The Common Council of the City of Richmond, Indiana met in regular session Tuesday, January 3, 2006,
in the Council Chambers in said City. President Sharp presided and the following business was
conducted:

PRAYER BY COUNCILOR PAPPIN
ROLL CALL
Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry
Parker, Al Glover, Gil Klose and Diana Pappin.
APPROVAL OF MINUTES
Councilor Wissel moved to amend the proposed minutes to correct the spelling of the name of Ron Itnyre
as a nominee for the Street Tree Commission and to amend the paragraph regarding the appointment of
a new Board member to the Wayne County Tourism Bureau to read as follows: The Chamber of
Commerce presented the nomination of Dana Weigle as a member of the Wayne County Tourism Board
of Directors. Councilor Welch moved to appoint Mr. Weigle with a second by Councilor Sharp. There
was a second by Councilor Pappin. The motion carried with a unanimous voice vote.
Councilor Wissel moved to approve the amended minutes of the meeting of Monday, December 19, 2005
with a second by Councilor Sharp. The motion carried with a unanimous voice vote.
PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS,
MOTIONS, RESOLUTIONS
RESOLUTION NO. 1 -2006 —A RESOLUTION TO ADOPT FISCAL PLAN
This Resolution is based upon the petition to annex into the City of Richmond, the property at the
southeast corner of South 23rd and "L" Streets. The developer of the property was requested by
Common Council to annex this parcel as part of their approval for a Special Use rezoning (Ordinance No.
21 -2005) to allow development of a nursing home and assisted living campus at this location.
Resolution No. 1 -2006 was referred to the Plan Commission for public hearing at its meeting on January
26, 2006.
COMMUNICATION FROM THE MAYOR
• As of this date, the property tax apportionment to the City of Richmond will be $511,000 less than
anticipated
• The sale of the Carpenter property will be final as soon as there is a final clearance from the
Indiana Department of Environmental Management
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the December 15, 2005 meeting were accepted as presented.
REPORTS FROM STANDING COMMITTEES
Street Tree Commission — Ron Itnyre was nominated to serve on the Street Tree Commission for a
three year term by Councilor Pappin with a second by Councilor Parker. The motion carried with a
unanimous voice vote.
MISCELLANEOUS BUSINESS
Members of Council remembered Dr. John Mader for his community service.

ORDINANCES ON FIRST READING
Councilor Elstro moved to suspend the rules and read Ordinance Nos. 1, 2 & 3 -2006 by title only with a
second by Councilor Lundy. The motion carried with a unanimous voice vote.
ORDINANCE NO. 1 -2006 - ORDINANCE ANNEXING CERTAIN CONTIGUOUS LANDS INTO THE
CITY OF RICHMOND
The Clerk read Ordinance No. 1 -2006 on first reading by title only
This Ordinance would annex real estate located at the southeast corner of South 23rd and "L" Streets into
the City of Richmond as requested in a Petition for Annexation dated December 28, 2006 by G &L
Partnership, LP of Tell City, Indiana. The developer of the property was requested by Common Council
to annex this parcel as part of their approval for a Special Use rezoning (Ordinance No. 21 -2005) to allow
development of a nursing home and assisted living campus at this location.
Ordinance No. 1 -2006 was referred to the Plan Commission for public hearing at the January 26, 2006
meeting.
ORDINANCE NO. 2 -2006 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF
TRANSPORTATION
The Clerk read ordinance No. 2 -2006 on first reading by title only.
Ordinance No. 2 -2006 would authorize The City of Richmond to submit a grant application to the Indiana
Department of Transportation, Transportation Enhancement Program and to accept said grant funding in
an amount up to Two Hundred Thousand Dollars ($200,000). This ordinance would also authorize the
City of Richmond to provide local funds in an amount up to Fifty Thousand Dollars ($50,000). These
funds would be appropriated to acquire the CSX Railroad corridor from South Fifth Street to Richmond
Avenue.
Councilor Welch moved to advance Ordinance No. 2 -2006 to second reading and to suspend the rules
and read by title only with a second by Councilor Pappin. The motion carried with a unanimous voice
vote.
The Clerk read Ordinance No. 2 -2006 on second reading by title only.
Council President Sharp declared Ordinance No. 2 -2006 on second reading and public hearing. There
being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance
No. 2 -2006 with a second by Councilor Pappin. The motion carried with a unanimous voice vote.
Councilor Wissel moved to advance Ordinance No. 2 -2006 to third and final reading and suspend the
rules and read by title only with a second by Councilor Wissel. The motion carried with a unanimous
voice vote.
The Clerk read Ordinance No. 2 -2006 on third reading by title only.
Ordinance No. 2 -2006 was adopted with a 9 -0 roll call vote.
ORDINANCE NO. 3 -2006 — A SPECIAL ORDINANCE PROVIDING FOR A PLANNED UNIT
DEVELOPMENT TO BE USED FOR RESIDENTIAL PURPOSES
The Clerk read Ordinance No. 3 -2006 on first reading by title only.
This ordinance is a petition to create a Residential PUD in an 0-1 Greenbelt District at the Elks Country
Club at 2100 South US 27. The rezoning would allow the owner to develop 24 units in 12 structures at
the site. The development will be known as Fairway Acres.

This ordinance was referred to the Plan Commission for public hearing at its meeting on January 26,
2006.
ORDINANCES ON SECOND READING
ORDINANCE NO. 89 -2005 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6 -1.1 -12.1 (Yukiya U.S.A.)
The Clerk read Ordinance No. 89 -2005 on second reading by title only.
This ordinance is a ten -year tax abatement request by Yukiya U.S.A. Gasket & Sealing Co., Ltd. for
equipment valued at $85,000.
The Tax Abatement Committee requested this Ordinance be held until January 17, 2006 in order to
complete the necessary due diligence.
