President Sharp presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR SHARP ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. Also in attendance were Bill Martus and Dick Hamm of the Economic Development Corporation and Richmond High School Government students Nickie Kalugyer, Kevy Bailey, Ted Parshall, Ron Coffey, Anjeli Owens, Natalie Hoff, Jerry Busser, Ashley DeLong, Danielle Conway, Mandi Garrett, Gary Clemmons, Tyler Hampton, Antonio Bryant, Nick Thornburg, Antonia Petlus, Jamie Day, Mike Weatherly, Adam Hampton, Tyson Brown, Ambra Schultz, Chandler Robinson, Chalanda Hanpton, Rochelle McConnell, John Dombroski, Samantha Miller, Chava Caldzren; Melissa Mullen, Shatara Jackson, Josh Hall, Stephanie Delucio, Matt Reed,Antwan Bentley, Jonathan Brookbank, Sam Humed, Rebekah Miller, Victoria Brown Beth Maddin and Gary Wier (teacher). APPROVAL OF MINUTES Councilor Wissel moved to approve the minutes of the meeting of April 3, 2006, with a second by Councilor Pappin. The motion carried with a unanimous voice vote. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 7 -2006 — A RESOLUTION SUPPORTING THE APPROVAL OF A LATE FILED APPLICATION FOR A PERSONAL PROPERTY TAX ABATEMENT FOR CHASE EQUIPMENT LEASING, INC. (GOLD STAR COATINGS) This Resolution would allow Gold Star Coatings to request approval of a late filed application for a personal property tax abatement. This application was late due to a lease agreement between Gold Star Coatings and Chase Equipment Leasing, Inc. The Tax Abatement application should be in the name of Chase Equipment Leasing and there was a delay in getting the proper paperwork in order. Councilor Welch moved to adopt Resolution No. 7 -2006 with a second by Councilor Parker. The motion carried with a unanimous voice vote. They were here last week and were introduced to our Veteran's Memorial in the Gorge. They will be working with the local Veteran's Council on future public events at the Memorial and using it as a model for others across the Country. • The Spring Clean Up yielded 25 tons of trash the first week. • There is a water drainage problem at McBride Stadium. It is being addressed. • City Clerk, Karen Chasteen, has earned the International Institute of Municipal Clerk's designation of Certified Municipal Clerk. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the March 23 and 30, 2006 meetings were accepted as presented. Common Council Minutes April 17, 2006 Page 2 of 4 REPORTS FROM DEPARTMENT HEADS None REPORTS FROM STANDING COMMITTEES None REPORTS FROM SPECIAL COMMITTEES None REPORTS FROM ORGANIZATIONS Bill Martus and Dick Hamm presented an update on Economic Development Corporation activities relative to the Midwest Industrial Park. MISCELLANEOUS BUSINESS • Mr. Gary Wier, Richmond High School Government Teacher, expressed his appreciation to the Council for allowing his students to attend meetings to observe local government at work. It serves as a very valuable tool in the classroom. • A Joint meeting of Common Council and the Plan Commission will be held April 19 to discuss the Comprehensive Plan. The meeting is at 7 PM at the First English Lutheran Church, 2727 East Main Street. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 59 -2005, 32 and 35 -2006 on first reading by title only with a second by Councilor Lundy. The motion carried with a unanimous voice vote. AMENDED ORDINANCE NO. 59 -2005 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 (Chase Equipment Leasing, Inc.) The Clerk read Amended Ordinance No. 59 -2005 on first reading by title only. Amended Ordinance No. 59 -2005 was a ten year tax abatement request from Gold Star Coatings for equipment valued at $1.5 million. This Amended Ordinance sets out the reasons for the change for the tax abatement to Chase Equipment Leasing, Inc. as the property entity to apply for a personal tax abatement. Councilor Welch moved to amend Amended Ordinance No. 59 -2005 to a term of six (6) years in lieu of ten (10) with a second by Councilor Lundy. The motion carried with a unanimous voice vote. Councilor Pappin moved to advance Amended Ordinance No. 59 -2005 to second reading and to suspend the rules and read by title only with a second by Councilor Welch. The motion carried with a unanimous voice vote. The Clerk read Amended Ordinance No. 59 -2005 on second reading by title only. Council President Sharp declared Amended Ordinance No. 59 -2005 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Amended Ordinance No. 59 -2005 with a second by Councilor Pappin. The motion carried with a unanimous voice vote. The motion carried with a unanimous voice vote. The Clerk read Amended Ordinance No. 59 -2005 on third reading by title only Ordinance No. 59 -2005 was adopted with a 9 -0 roll call vote ORDINANCE NO. 32 -2006 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -4 TO AN R -4 SPECIAL USE DISTRICT (126 N. 10`') The Clerk read Ordinance No. 32 -2006 on first reading by title only. This Ordinance is a petition to rezoning from R -4 Multi - Family Residence District to an R -4 Special Use District the property at 126 North 10th Street to allow the owner to operate a dinner house and banquet facility. Ordinance No. 32 -2006 was referred to the Plan Commission for public hearing at its monthly meeting on Thursday, April 27, 2006. ORDINANCE NO. 35 — 2006 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE UNITED STATES TENNIS ASSOCIATION MIDWEST SECTION (,luKo) This Ordinance would authorize the City of Richmond Parks & Recreation Department to submit a grant application to the United State Tennis Association Midwest Section and to accept said grant funding in an amount up to One Thousand Dollars ($1,000.00). If awarded, these funds would be appropriated to purchase tennis equipment for Just Us Kids Outdoors (JUKO) summer program. Councilor Welch moved to advance Ordinance No. 35 -2006 to second reading and to suspend the rules and read by title only with a second by Councilor Parker. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 35 -2006 on second reading by title only. Council President Sharp declared Ordinance No. 35 -2006 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance No. 35 -2006 with a second by Councilor Welch. The motion carried with a unanimous voice vote. Councilor Wissel moved to advance Ordinance No. 35 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Lundy. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 35 -2006 on third reading by title only. Ordinance No. 35 -2006 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING AMENDED ORDINANCE NO. 85 -2004 — A GENERAL ORDINANCE AMENDING CHAPTER 154 OF THE CODE OF ORDINANCES, RICHMOND, INDIANA REGARDING THE AQUIFER PROTECTION DISTRICT The Clerk read Amended Ordinance No. 85 -2004 on second reading by title only. Council President Sharp announced that Amended Ordinance No. 85 -2004 will be held on second reading for public hearing on May 1, 2006. Common Council Minutes April 17, 2006 Page 4 of 4 ORDINANCE NO. 31 -2006 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Landis Plastics) The Clerk read Ordinance No. 31 -2006 on second reading by title only. This Ordinance is a request by Landis Plastics for a ten -year tax abatement on equipment valued at $3,370,025. The Tax Abatement Committee recommended approval. Council President Sharp declared Ordinance No. 31 -2006 on second reading and public hearing. There was discussion regarding the leasing of equipment at Landis Plastics. Councilor Pappin moved for engrossment of Ordinance No. 31 -2006 with a second by Councilor Sharp. The motion failed with an 8 -1 voice vote. Councilor Elstro cast the dissenting vote. Ordinance No. 31 -2006 will be held on second reading for public hearing on May 1, 2006. Additional information regarding the equipment lease will be available at that time.
