HomeMy Public PortalAbout06-19-2006PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, JUNE 19, 2006 The Common Council of the City of Richmond, Indiana met in regular session Monday, June 19, 2006, in the Council Chambers in said City. President Sharp presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR KLOSE ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. Councilor Wissel moved to approve the minutes of the meeting of June 5, 2006, with a second by Councilor Welch. The motion carried with a unanimous voice vote. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 9 -2006 - RESOLUTION TO ADOPT FISCAL PLAN (Hidden Valley 12th Addition) The Clerk read Resolution No. 9 -2006 by title only. This Resolution presents the Fiscal Plan which is required while considering Ordinance No. 34 -2006 which is an annexation petition by Edwin and Christina Nicholson. After review by the City Planning staff, it was recommended that the fiscal plan be modified to reflect the fact that some level of City resources will be spent as a result of annexation. Planning staff recommended replacing item 6 of the Fiscal Plan for Municipal Services with the following statement: The cost of all other services and facilities provided by the City to the area being annexed is minimal and can be accommodated by City budget. The Plan Commission recommended approval of the amended resolution. Councilor Parker moved for adoption of Resolution No. 9 -2006 with the recommended amendment of the Planning staff with a second by Councilor Wissel. Upon a vote viva voce, the motion passed. RESOLUTION NO. 10 -2006 - RESOLUTION TO ADOPT FISCAL PLAN (Honeysuckle Estates - South 1" Street and Henley Road) The Clerk read Resolution No. 10 -2006 by title only. This Resolution presents the Fiscal Plan which is required while considering Ordinance No. 40 -2006 which is an annexation petition by Lingle Real Estate for Honeysuckle Estates - South "L" Street and Henley Road. After review by the City Planning staff, it was recommended that the fiscal plan be modified to reflect the fact that some level of City resources be spent as a result of annexation. Members of Common Council are invited to work with the employees on this certification. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the May 25, June 1 and 6, 2006 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS None REPORTS FROM STANDING COMMITTEES None REPORTS FROM SPECIAL COMMITTEES None REPORTS FROM ORGANIZATIONS None MISCELLANEOUS BUSINESS Mayor Hutton recommended Gary Hackman for the Economic Development Corporation Board. Councilor Elstro moved to accept the recommendation with a second by Councilor Wissel. Upon a vote viva voce, the motion passed. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance No. 45 -2006 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 45 -2006 - A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -4 AND C -2 TO ALL C -2 (103 Garwood Road) The Clerk read Ordinance No. 45 -2006 on first reading by title only. This ordinance is a petition to rezone the property at 103 Garwood Road from C -2 Commercial District and R -4 Multi - Family Residence District to all C -2 Commercial District so the owner may operate the residential structure at that location as a restaurant. Ordinance No. 45 -2006 was referred to the Plan Commission for public hearing at its meeting on June 22, 2006. ORDINANCES ON SECOND READING ORDINANCE NO. 34 -2006 — ORDINANCE ANNEXING CERTAIN CONTIGUOUS LANDS INTO THE CITY OF RICHMOND (Hidden Valley 12 1h Addition) The Clerk read Ordinance No. 34 -2006 on second reading by title only This Ordinance is a request of Edwin and Christina Nicholson to annex real estate into the City of Richmond pursuant to Indiana Code 36- 4- 3 -5.1. Said real estate is contiguous with the city's corporate Common Council Minutes June 19, 2006 Page 3 of 4 boundary. Mr. and Mrs. Nicholson own 100 percent of the land and the only persons who reside within the territory that is proposed to be annexed. The Richmond Advisory Plan Commission voted 6 -0 recommending approval. Council President Sharp declared Ordinance No. 34 -2006 on second reading and public hearing. Speaking in favor was Ed Nicholson, developer of the subject property. There being no comments against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 34 -2006 with a second by Councilor Pappin. The motion carried with a unanimous voice vote. Councilor Lundy moved to advance Ordinance No. 34 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 34 -2006 on third reading by title only Ordinance No. 34 -2006 was adopted with a 9 -0 roll call vote ORDINANCE NO. 40 -2006 - ORDINANCE ANNEXING CERTAIN CONTIGUOUS LANDS INTO THE CITY OF RICHMOND (Honeysuckle Estates- South 1" Street and Henley Road) The Clerk read Ordinance No. 40 -2006 on second reading by title only. This Ordinance is a petition to annex into the City of Richmond the property located west of Lantern Trail on Henley Road. As part of the subdivision process for this property, the developer was requested to annex this real estate to avoid conflict between city and county road standards. Ordinance No. 40 -2006 was heard at the May 26, 2006 Richmond Advisory Plan Commission meeting. The Plan Commission voted 6 -0 recommending approval. Council President Sharp declared Ordinance No. 40 -2006 on second reading and public hearing. Speaking in favor was David Winemiller. There being no comments against the Ordinance, Councilor Welch moved for engrossment of Ordinance No. 40 -2006 with a second by Councilor Parker. The motion carried with a unanimous voice vote. Councilor Lundy moved to advance Ordinance No. 40 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 40 -2006 on third reading by title only. Ordinance No. 40 -2006 was adopted with a 9 -0 roll call vote ORDINANCE NO. 42 -2006 - AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 51- 2005 KNOWN AS THE 2006 SALARY ORDINANCE The Clerk read Ordinance No. 42 -2006 on second reading by title only. Common Council has previously adopted Ordinance No. 51 -2005 to establish salaries for the Year 2006 An amendment is now necessary to reflect the deletion of a Street Department Laborer position as well as a cost of living adjustment for contracted workers within the same department. It also reflects a reorganization in the Department of Public Works and Engineering. Council President Sharp declared Ordinance No. 42 -2006 on second reading and public hearing. Speaking in favor was Dan Sexton representing AFSCME Union Local 1791. Councilor Wissel moved to remove the health insurance language from the Addendum to Professional Negotiation Agreement between AFSCME Union Local 1791 and the City of Richmond, Indiana. The motion failed due to a lack of a second. Councilor Welch moved to amend the following language to the second paragraph of Article 23 of the Addendum: An eligible retiree is defined to be any member of the AFSCME Local 1791 bargaining unit who is fifty -five (55) years of age and retires from active duty in good standing with twenty (20) years or more service to the City of Richmond. There was a second by Councilor Wissel. The motion Common Council Minutes June 19, 2006 Page 4 of 4 was defeated with a 4 -5 roll call vote. Dissenting were Councilors Elstro, Lundy, Pappin, Al Glover and Klose. There being no further comments for or against the Ordinance, Councilor Welch moved for engrossment of Ordinance No. 42 -2006 with a second by Councilor Parker. The motion carried with a unanimous voice vote. Councilor Elstro moved to advance Ordinance No. 42 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Lundy. The motion carried with a unanimous voice vote. The Clerk read Ordinance No. 42 -2006 on third reading by title only. Ordinance No. 42 -2006 was adopted with a 9 -2 roll call vote. Dissenting votes were Councilors Wissel and Welch. ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, the meeting was adjourned.
