HomeMy Public PortalAbout07-05-2006PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, WEDNESDAY, JULY 5, 2006 The Common Council of the City of Richmond, Indiana met in regular session Wednesday, July 5, 2006, in the Council Chambers in said City. President Sharp presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR ELSTRO ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. APPROVAL OF MINUTES Councilor Wissel moved to approve the minutes of the meeting of June 19, 2006, with a second by Councilor Parker. The motion carried with a unanimous voice vote. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR Mayor Hutton presented a certificate congratulating Aaron Koger for being a member of the Richmond High School Swim Team and placing first in the State of Indiana in Breaststroke. Victoria Norp was presented a Good Samaritan Award from the City and Dunn Center for calling the Fire Department when she saw a home on fire. Several lives were saved. Tyler Maupin and Brian Atwell received a commendation from the City of Richmond and the Police Department for interrupting a purse snatcher. The duo also pursued and caused to be apprehended the perpetrator. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the June 8, 15 & 22, 2006 meetings were accepted as presented. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 48, 49 & 50 -2006 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 48 -2006 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Color Box) The Clerk read Ordinance No. 48 -2006 on first reading by title only. This Ordinance is a request for a 10 -year tax abatement on equipment valued at $6,441,000. Ordinance No. 48 -2006 was referred to the Tax Abatement Committee. ORDINANCE NO. 49 -2006 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Envirotech Extrusion, Inc.) The Clerk read Ordinance No. 49 -2006 on first reading by title only. This Ordinance is a request for a 10 -year tax abatement on equipment valued at $943,372.12. Ordinance No. 49 -2006 was referred to the Tax Abatement Committee. ORDINANCE NO. 50 -2006 — A GENERAL ORDINANCE CREATING A SECTION OF THE CITY OF RICHMOND CODE REGARDING ADULT ENTERTAINMENT BUSINESSES The Clerk read Ordinance No. 50 -2006 on first reading by title only. This Ordinance would create Chapter 126 of the Municipal Code and regulate adult entertainment businesses and related activities. A Committee of the Whole meeting will be scheduled to discuss Ordinance No. 50 -2006 at the July 17 Common Council meeting. ORDINANCES ON SECOND READING ORDINANCE NO. 43 -2006 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -3 SPECIAL USE TO R -3 SPECIAL USE DISTRICT The Clerk read Ordinance No. 43 -2006 on second reading by title only. This Ordinance would change the real estate located at 2015 East Main Street from R -3 to R -3 Special Use District to allow the owner to use the property as a CPA office plus 3 to 4 residential rentals. Ordinance No. 43 -2006 was heard on public hearing at the Richmond Advisory Plan Commission. The Plan Staff recommended approval with the following commitments from the petitioner: 1) The five parking spaces necessary for the office will not be required until a Certificate of Occupancy has been given to the business, and 2) A directional sign should be placed in the area of the carport indicating NO EXIT onto East Main Street. These commitments would be recorded in the County Recorder's office and would run with the property. The Plan Commission recommends approval with commitments. Council President Sharp declared Ordinance No. 43 -2006 on second reading and public hearing. Kevin Cowin, owner, spoke in favor of the Ordinance. There being no comments against the ordinance, Common Council Minutes July 5, 2006 Page 3 of 3 Councilor Elstro moved for engrossment of Ordinance No. 43 -2006 with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Ordinance No. 43 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 43 -2006 on third reading by title only. Ordinance No. 43 -2006 was adopted with a 9 -0 roll call vote.
