HomeMy Public PortalAbout07-17-2006PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, JULY 17, 2006 The Common Council of the City of Richmond, Indiana met in regular session Monday, July 17, 2006, in the Council Chambers in said City. President Sharp presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR LUNDY ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. APPROVAL OF MINUTES Councilor Parker moved to approve the minutes of the meeting of July 5, 2006, with a second by Councilor Pappin. The motion carried with a unanimous voice vote. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS John Oberle, representing the Contractor's Partnership of Indiana, presented a power point presentation of the plans for the Police /Fire Training Center. COMMUNICATION FROM THE MAYOR • The Mayor outlined the Bicentennial celebration events and invited all to participate. • Ms. Hutton reported she is continually receiving compliments from citizens on the performance of City employees. • The 2007 Budget process is under way REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the June 29, 2006 meeting was accepted as presented. REPORTS FROM DEPARTMENT HEADS 1006 =I- REPORTS FROM STANDING COMMITTEES 1006 =I- REPORTS FROM SPECIAL COMMITTEES None REPORTS FROM ORGANIZATIONS None MISCELLANEOUS BUSINESS Councilor Lundy reported that the City has been petitioned by AFSCME to represent the Park Department. The petition was delivered July 12. A copy of Revised Ordinance No. 45 -2000, which sets the procedures associated with employee collective bargaining, was distributed to Council members. Per Section 33.04(b)(2), a three - member Oversight Panel must be appointed within 15 days of receipt of the Common Council Minutes July 17, 2006 Page 2 of 4 Petition to Initiate Collective Bargaining. One member of this Panel must be a potentially affected employee from the subject department who shall be selected by Common Council. Danny Sexton was presented and presented the name of Ron Moore, laborer with Park Department, to be considered. Councilor Lundy moved to appoint Mr. Moore to the Oversight Panel with a second by Councilor Glover. The motion carried with a 6 -3 vote. Dissenting were Councilors Wissel, Welch and Pappin. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 46, 51, 59, 60, 61 & 62 -2006 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 46 -2006 - A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR CERTAIN PARCELS FROM C -2 to R -3 (100 and 200 blocks of Kinsey Street) The Clerk read Ordinance No. 46 -2006 on first reading by title only. This Ordinance is a petition to rezone the properties at 103, 107, 109, 115, 117, 119, 201, 205, 211, 223, 225 and 229 Kinsey Street from C -2 Commercial District to R -3 One to Eight Family Residence District so the two blocks will not be considered for commercial development is a solidly residential portion of the Baxter Neighborhood. Ordinance No. 46 -2006 was referred to Plan Commission for public hearing at its meeting on July 27, 2006. ORDINANCE NO. 51 -2006 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR CERTAIN PARCELS FROM R -1 AND 0 -1 TO C -2 (1401 Chester Boulevard) The Clerk read Ordinance No. 51 -2006 on first reading by title only. This Ordinance is a petition to rezone the property at 1401 Chester Boulevard, commonly known as Reid Hospital, from R -1 Single Family Residential and 0-1 Greenbelt to C -2 Commercial District so the owner may develop the property. Ordinance No. 51 -2006 was referred to Plan Commission for public hearing at its meeting on July 27, 2006. ORDINANCE NO. 59 -2006 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1 -12.1 (Recycling Center - Equipment) The Clerk read Ordinance No. 59 -2006 on first reading by title only. This Ordinance is a request by Recycling Center, Inc. for a ten -year tax abatement on equipment valued at $4,743,050. Ordinance No. 59 -2006 was referred to Tax Abatement Committee for due diligence. ORDINANCE NO. 60 -2006 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1-12.1 (Marvel Industries - Equipment) The Clerk read Ordinance No. 60 -2006 on first reading by title only. This Ordinance is a request by Marvel Industries for a ten -year tax abatement on equipment valued at $1,440,000. Ordinance No. 60 -2006 was referred to Tax Abatement Committee for due diligence Common Council Minutes July 17, 2006 Page 3 of 4 ORDINANCE NO. 61 -2006 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1 -12.1 (Marvel Industries - Equipment) The Clerk read Ordinance No. 61 -2006 on first reading by title only. This Ordinance is a request by Marvel Industries for a five -year tax abatement on equipment valued at $140,000. Ordinance No. 61 -2006 was referred to Tax Abatement Committee for due diligence. ORDINANCE NO. 62 -2006 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1 -12.1 (Recycling Center — Real Estate) The Clerk read Ordinance No. 62 -2006 on first reading by title only. This Ordinance is a request by Recycling Center, Inc. for a ten -year tax abatement for real estate valued at $300,000. Ordinance No. 62 -2006 was referred to Tax Abatement Committee for due diligence. ORDINANCES ON SECOND READING ORDINANCE NO. 43 -2004 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (82.12) The Clerk read Ordinance No. 43 -2004 on second reading by title only. Councilor Wissel requested this Ordinance be held until the August 21, 2006 meeting. ORDINANCE NO. 48 -2006 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Color Box, LLC) The Clerk read Ordinance No. 48 -2006 on second reading by title only. This Ordinance is a request of Color Box, LLC for a ten -year tax abatement on equipment valued at $6,441,000. The Tax Abatement Committee recommended approval. Council President Sharp declared Ordinance No. 48 -2006 on second reading and public hearing. There being no comments for or against the ordinance, Councilor Elstro moved for engrossment of Ordinance No. 48 -2006 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 48 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 48 -2006 on third reading by title only. Ordinance No. 48 -2006 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 49 -2006 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Envirotech Extrusion) The Clerk read Ordinance No. 49 -2006 on second reading by title only Common Council Minutes July 17, 2006 Page 4 of 4 This Ordinance is a request of Envirotech Extrusion for a 10 -year tax abatement on equipment valued at $943,372.12. Councilor Wissel requested Ordinance No. 49 -2006 be held until a Resolution is presented regarding a late abatement request.
