HomeMy Public PortalAbout09-05-2006PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, TUESDAY, SEPTEMBER 5, 2006 The Common Council of the City of Richmond, Indiana met in regular session Tuesday, September 5, 2006, in the Council Chambers in said City. President Sharp presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR SHARP ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. APPROVAL OF MINUTES Councilor Parker moved to approve the minutes of the meeting of August 21, 2006, with a second by Councilor Pappin. The motion carried with a unanimous voice vote. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • The City of Richmond is taking part in a contest on recycling. We were second in the Nation in our size class in 2005. All cans and other recyclable materials can be deposited at any City of Richmond buildings September 15 — 30, 2006. • The Indiana Department of Transportation has constructed a "divider" on East Main Street which has cut off five existing businesses from the west bound lane. The City is addressing this issue with the State. • Bill Harris, Interim Human Resources Director, was introduced. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the August 10 & 17, 2006 meeting was accepted as presented. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 52, 54, 55, 56, 57, 58, 72 & 75- 2006 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 52 -2006 — AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2007 BUDGET The Clerk read Ordinance No. 52 -2006 on first reading by title only. This Ordinance is the proposed 2007 Budget. Ordinance No. 52 -2006 will be held for a Special Meeting of Common Council which has been called on Wednesday, September 27, 2006 to adopt the 2007 Budget. ORDINANCE NO. 54 -2006 — AN APPROPRIATION ORDINANCE AUTHORIZING A REDUCTION IN APPROPRIATIONS FROM CERTAIN FUNDS The Clerk read Ordinance No. 54 -2006 on first reading by title only. This Ordinance would reduce appropriations in the 2006 Budget. Councilor Wissel moved to advance Ordinance No. 54 -2006 to second reading and to suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 54 -2006 on second reading by title only. Council President Sharp declared Ordinance No. 54 -2006 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 54 -2006 with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Ordinance No. 54 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 54 -2006 on third reading by title only. Ordinance No. 54 -2006 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 55 -2006 - AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2007 SALARY ORDINANCE The Clerk read Ordinance No. 55 -2006 on first reading by title only. This Ordinance would fix the compensation of the deputies and employees of the Clerk's office and the compensation for each appointive officer, deputy and other employees of all other city departments for the Year 2007. The compensation reflects a 3% raise averaged over two years for civilian employees. Ordinance No. 55 -2007 will be held until the passage of the 2007 Budget. ORDINANCE NO. 56 -2006 — AN APPROPRIATION ORDINANCE FIXING THE ANNUAL COMPENSATION OF ALL ELECTED OFFICIALS FOR 2007 The Clerk read Ordinance No. 56 -2006 on first reading by title only. Common Council Minutes September 5, 2006 Page 3 of 5 This Ordinance would fix the annual compensation of all elected city officers and reflects a 3% raise averaged over two years. Ordinance No. 56 -2006 is required to be published two times in the Palladium -Item and will be held until the first meeting in October. ORDINANCE NO. 57 -2006 — AN ORDINANCE TO PETITION FOR A SHORTFALL APPEAL DUE TO ERRONEOUS ASSESSED VALUE The Clerk read Ordinance No. 57 -2006 on first reading by title only. This Ordinance would authorize the City to appeal to the Local Government Tax Control Board and Department of Local Government Finance from a property tax shortfall, due to erroneous assessed valuation. Councilor Welch moved to advance Ordinance No. 57 -2006 to second reading and to suspend the rules and read by title only with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 57 -2006 on second reading by title only. Council President Sharp declared Ordinance No. 57 -2006 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Lundy moved for engrossment of Ordinance No. 57 -2006 with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. Councilor Elstro moved to advance Ordinance No. 57 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 57 -2006 on third reading by title only. Ordinance No. 57 -2006 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 58 -2006 — AN ORDINANCE TO PETITION FOR AN INCREASE TO THE 2007 MAXIMUM LEVY DUE TO COST OF THE DEFERRED RETIREMENT OPTION PLAN (DROP) The Clerk read Ordinance No. 58 -2006 on first reading by title only. This Ordinance would authorize the City of Richmond to appeal to the Local Government Tax Control Board and Department of Local Government Finance for an excessive levy due to additional costs of the Deferred Retirement Option Plan in their Police Pension Funds and Fire Pension Fund. Councilor Welch moved to advance Ordinance No. 58 -2006 to second reading and to suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 58 -2006 on second reading by title only. Council President Sharp declared Ordinance No. 58 -2006 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 58 -2006 with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Ordinance No. 58 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. ORDINANCE NO. 72 -2006 - A SPECIAL AORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Ahaus Tool) Common Council Minutes September 5, 2006 Page 4 of 5 The Clerk read Ordinance No. 72 -2006 on first reading by title only. This Ordinance is a request of Ahaus Tool & Engineering for a five -year tax abatement on equipment valued at $270,000. Ordinance No. 72 -2006 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 75 -2006 - A SPECIAL AORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Optical Disk) The Clerk read Ordinance No. 75 -2006 on first reading by title only. This Ordinance is a request of Optical Disk Solutions for a ten -year tax abatement for equipment valued at $1,430,000. Ordinance No. 75 -2006 was referred to the Tax Abatement Committee for due diligence. ORDINANCES ON SECOND READING ORDINANCE NO. 68 -2006 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR CERTAIN PARCELS FROM M -2 to C -2 The Clerk read Ordinance No. 68 -2006 on second reading by title only. This Ordinance is a petition to rezone the property at 1200 Industries Road, commonly known as the former Carpenter manufacturing site, from M -2 General Industrial District to C -2 Commercial District so the owner may develop the property for uses including restaurants, a hotel, a retail strip mall and a filling station. The Plan Commission recommended approval at public hearing on August 24, 2006. Councilor Welch moved to amend the second Whereas by replacing filling station at the end of the sentence with convenience store and fuel sales. There was a second by Councilor Parker. Upon a vote viva voce, the motion passed. Council President Sharp declared Amended Ordinance No. 68 -2006 on second reading and public hearing. Mike and Tom Dickman spoke in favor of the Amended Ordinance. There being no comments against the Ordinance, Councilor Elstro moved for engrossment of Amended Ordinance No. 68 -2006 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Amended Ordinance No. 68 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 68 -2006 on third reading by title only. Amended Ordinance No. 68 -2006 was adopted with an 8 -1 roll call vote. The dissenting vote was cast by Councilor Wissel. Councilor Wissel stated he voted against this Ordinance because he is opposed to spot zoning not because he is not in favor of this development. ORDINANCE NO. 76 -2006 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM 0-1 to C -2 The Clerk read Ordinance No. 76 -2006 on second reading by title only. This Ordinance is a petition to rezone the property on the east side of Chester Boulevard, north of the Whitewater River, from 0-1 Greenbelt to C -2 Commercial District so a future owner may develop the Common Council Minutes September 5, 2006 Page 5 of 5 property. The Plan Commission recommended a conditional approval at public hearing on August 24, 2006. Council President Sharp declared Ordinance No. 76 -2006 on second reading and public hearing. Speaking in favor was Mike and Bob Dickman and Ted Sobol. There being no comments against the Ordinance, Councilor Lundy moved for engrossment of Ordinance No. 76 -2006 as recommended by the Plan Commission with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 76 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 76 -2006 on third reading by title only Ordinance No. 76 -2006 was adopted with a 9 -0 roll call vote.
