The original deposit of $800.00 for this application was in the form of a check in the name of BBI Properties and signed by Mr. Bello. (See attached photocopy of that check.) Mr. Bello did not sign the application but his name was printed on the applicant line along with John P. Hilderbrand. (Refer to attached copy of the application.) Standard procedure in processing a new application is to open the new account in the name of the person presenting the opening deposit. All statements on the account are then sent to this same person. Apparently Mr. Bello discussed this problem with Mr. Hilderbrand but we were not aware of this discussion. Mr. Hilderbrand did call you on 11 /19/91, in response to a letter sent to him requesting payment of the past due balance, to complain about the charges on this account. (See attached copy of your memo to Jim) Jim's note on the memo indicated that he spoke with Mr. Hilderbrand, recommended that he discuss the problem with PWD, and stated no changes were to be made to the account at that time. My records indicate that this was the last contact our department had with Mr. Hilderbrand concerning this problem. Mr. Chew called you in November, after receiving a letter from our department requesting that he, as agent for the property owner, pay the past due balance on this account. As a result of your conversation with Mr. Chew I was instructed to write him a follow-up letter, dated 11/14/91, stating that he would not be held responsible for any part of the past due balance and that our department would work with Mr. Hilderbrand to clear up the problem. (See attached photocopy.) I have received statements from the Napa Planning Department for the above project in the past. Each time I received such a statement, I would question Mr. Hilderbrand as to why my name and address was on a bill for a project that I wasn't involved with. His response has always been that the bill is in error and that we shouldn't be receiving it. I personally.was never an agent for the Swinderman Estate, nor have I ever been on title on any property on Trower Avenue in Napa, California. If this letter is not enough to clear up this matter, as it relates to me personally, I would appreciate it if you would cowunicate with me directly so that I can resolve it. Through the process, the City of Napa has required that in case of future development, the properties to the rear of Swinderman's will use the fifteen (15) foot wide private drive east of the these properties for access. The private drive, therefore must be improved to City Standards in order to serve the future development. The requirements for the subject project shall include installation of the portion of the improved private street along its eastern boundary. It will also eliminate the traffic safety concerns associated with the two adjacent access drives proposed on the Tentative Map. The reason for this letter is that I am requesting that access rights over the the fifteen (15) foot wide existing easement be granted to me in order for us to proceed with this project. I am also requesting the right to construct the full street improvements along the project's eastern boundary. Your suggestion of requiring the applicant to forward a certified letter to the owners of the easement is appropriate. It is recommended that the applicant forward a letter via certified mail to the owner of the fifteen (15) foot wide access drive and any other controlling property owners. The letter should clearly state the following points: 1. A brief description of the proposed tentative parcel map project. 2. A description of the required private street improvements along the project's eastern boundary; thirty-eight (38) foot wide easement, twenty-eight (28) foot wide paved road, sidewalk and landscaping. 3. A request for access rights over the fifteen (15) foot wide existing easement. 4. A request for the right to construct the full street improvements along the project's eastern boundary. 5. A statement that the design of the private street and drainage system will accommodate future development of the properties to the north which currently use the fifteen (15) foot wide easement. 6. A statement that all costs associated with the street improvements required for this project shall be paid by the applicant. 7. A request for a written response within a specified time period. It is hoped that the property owners controlling the fifteen (15) foot wide easement will agree to the applicant's request. They should realize that if,they propose any future development on their properties, they will be required to install the private street described in #2 above. By allowing this applicant to install the portion of private street along his property, the cost of future development to the north will be reduced. I have personally spoken to three of the owners, namely Misters Basfor (the owner of the right of way), Kear and Gholsen (owners of the two back parcels) in regards to developing their parcels with that in the front. None of them have consented to do this. I asked Mr. Basford about "consent" for access for the front parcel and his answer was negative. A review of the development potential of the properties currently served by the existing private drive indicates that a portion of the future development to the north could be served through the Lloyd property (APN 07-161-04) via the proposed public street which will abut the eastern boundary of the Breckenridge Subdivision. However, all other future development to the north must use the fifteen (15) foot wide private drive for access. The private drive, therefore must be improved to City Standards in order to serve the future development. The requirements for the subject project shall include installation of the portion of the improved private street along its eastern boundary. This requirement will provide access to the two lots to the rear of this project, as well as the future development to the north. It will also eliminate the traffic safety concerns associated with the two adjacent access drives proposed on the Tentative Map. The recommended private street design requires a total easement width of thirty-eight (38) feet which would include the existing fifteen (15) foot wide easement. The paved road width would be twenty-eight feet which would provide two-way travel and parking on ane side. A sidewalk adjacent to the curb would be provided on one side and landscaping would make up the remaining space. The applicant is required to obtain permission from the owner of the fifteen (15) foot wide easement to allow installation of the private street as described above.
