HomeMy Public PortalAbout2022-72 Reso Granting Final Plat Approval Adams-Eagle BluffResolution No. 2022-72 September 20, 2022 Member DesLauriers introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 2022-72 RESOLUTION GRANTING FINAL APPROVAL OF THE EAGLE BLUFF PLAT WHEREAS, the city of Medina (the “City”) is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Jan-Har, LLP (the “Applicant”) is the fee owner of property located north of Highway 55, approximately 1330 feet west of Willow Drive (the “Property”) which is legally described as: ; and WHEREAS, on April 7, 2020, the City Council adopted resolution 2020-20, granting preliminary approval of a two-lot plat proposed at that time to be called “Adams Subdivision,” subject to certain terms and conditions; and WHEREAS, the Applicant has requested final approval of the plat, now to be called Eagle Bluff; and WHEREAS, the City Council reviewed the proposed plat and heard relevant testimony on September 20, 2022; and WHEREAS, subject to the fulfillment of the conditions noted below, the City Council makes the following findings of fact in regard to the plat based on the requirements of the Subdivision Ordinance: a. The proposed plat is consistent with the approved preliminary plat. b. The conditions on which preliminary plat was approved have been completed or have been incorporated into this resolution and the corresponding development agreement. c. The plat meets the criteria described in Subd. 10 of Section 820.21 for approval. NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota hereby grants final approval for Eagle Bluff, as depicted on the plat received by the City on September 9, 2022, subject to the following terms and conditions: 1) The Applicant shall enter into a development agreement with the City, which shall include the conditions described below as well as other requirements by City ordinance or policy. Resolution No. 2022-72 2 September 20, 2022 2) The Applicant shall construct necessary turn lane improvements on Trunk Highway 55 to the satisfaction of the Minnesota Department of Transportation to construct the private road access. 3) The Applicant shall execute and record private road and access agreement(s) in a form and of substance satisfactory to the City Attorney to ensure both lots have access to the private road and related to maintenance of such private road. 4) The Applicant shall grant a right-of-way easement to the City over Outlot A for the potential extension of a public road to serve the Property in the future. 5) The Applicant shall install all improvements shown on the plans dated 9/9/2022 except as may be modified herein. The plans shall address the comments of the City Engineer prior to commencing construction. 6) The Applicant shall preserve four acres of the wooded area through an instrument to the satisfaction of the City to meet park and open space dedication requirements. If the Applicant or a future owner extinguishes the document to preserve the area in the future, a full cash-in-lieu fee of 8% of the future market value of Lots 1 and 2 shall be payable. 7) The Applicant shall update the plat to dedicate drainage and utility easements over all water mains and hydrants and over stormwater improvements in addition to the easements around the perimeter of the lots and over all wetland areas. 8) The watermain and hydrants within the lots shall be privately maintained. 9) The Applicant shall submit a letter of credit in an amount of 150% of the cost of site improvements in order to ensure completion. 10) The Applicant shall execute and record a Stormwater Maintenance Agreement in a form and of substance acceptable to the City Attorney to describe the responsibility of the property owners to maintain the private stormwater improvements. 11) The Applicant shall meet the requirements of the wetland protection ordinance including but not limited to: execution and recordation of Upland Buffer Easement Agreement in a form and of substance acceptable to the City Attorney, planting of appropriate vegetation, and installation of signage. 12) The Applicant shall address the comments of the City Attorney’s plat opinion, title matters and recording instructions. 13) The Property shall be subject to the City’s lawn and landscaping irrigation regulations. No lawn or landscape irrigation systems shall be permitted to be connected to the City water system. 14) The Applicant shall obtain all permits required by Pioneer Sarah Creek Watershed District, Minnesota Department of Transportation, the Minnesota Department of Health, the Minnesota Pollution Control Agency, the Metropolitan Council and any other relevant agencies. 15) The plat shall be recorded in the office of the Hennepin County Recorder within 180 days of the date of the resolution or the approval shall be considered void, unless a written request for time extension is submitted by the applicant and approved by the City Council. 16) The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the plat, construction plans, and other relevant documents.
