AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO THE PRESENT CITY
LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED AT 1000 SOUTH COUNTRY
CLUB DRIVE, IN PART OF THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF
SECTION 8, IN TOWNSHIP 44 NORTH, RANGE 12 WEST IN THE COUNTY OF COLE, STATE
OF MISSOURI,AND AMENDING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON,
MISSOURI,DEFINING THE EXISTING CITY BOUNDARY BYADDING ONE NEW SUB-SECTION
PERTAINING TO THE SAME SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo,the City Council of the City of Jefferson desires
to annex the unincorporated area of land described in Section 1; and
WHEREAS, the property is adjacent to the City, the site of a multi-family residential
development; and
WHEREAS, a public hearing concerning the annexation was advertised on August 29, 2008 in
the Jefferson City Post Tribune; and
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The City Council intends to and shall proceed to annex,as provided by law,the
unincorporated area of land described as follows: Part of the Southeast Quarter of the Southwest
Quarter of Section 8, Township 44 North, Range 12 West, more particularly described as follows:
From the Southeast corner of the Southwest Quarter of said Section 8; thence north along the
quarter section line, 414.48 feet; thence west at right angles to the quarter section line, 151.8 feet
to a point on the centerline of the County Road and the beginning point of this description; thence
North 13 Degrees 15 Minutes West, 230.58 feet, to the southeasterly corner of a tract conveyed
to Cecil Edgar Seidel and Wife, by Warranty Deed of record in Book 188, Page 659, Cole County
Recorder's Office; thence South 78 Degrees 30 Minutes West, along the southerly line of said
Seidel Tract, 148.31 feet,to the southwesterly corner thereof;thence South 13 Degrees 15 Minutes
East,262.77 feet,to the centerline of the County Road;thence North 66 Degrees 20 Minutes East,
along the centerline of the County Road, 151.14 feet, to the beginning point of the description;
Except that portion of the above described property already contained within the corporate limits
of the City of Jefferson. Containing approximately 0.7 acres.
Section 2. The City Council finds and declares that the land described in Section 1 is
contiguous to the City boundary; that the annexation is reasonable and necessary to the proper
development of the City; and further, did determine the City has an ability to furnish normal
municipal services to this area.
Section 3. A public hearing was held on September 15, 2008 as provided by law,
• concerning the annexation of the unincorporated area described in Section 1.
Section 4. The land described in Section 1 shall be zoned PUD until such time as the
• zoning may be changed in the manner provided for by State Statute and City Code.
Section 5. Section 1-17 of the City Code of the City of Jefferson, Missouri is hereby
amended by adding one new subsection which shall read as follows:
( ) The City's boundaries shall also include the following parcel:

Section 6. The annexed area shall be in Ward 4 of the City.
Section 7. The effective date of this Ordinance and the annexation of the area described
• in Section 1 will be immediately upon passage, provided that no written objections to the proposed
annexation are filed with the City Council. If sufficient objections are filed, this ordinance shall not
become effective until such time as the annexation issue has been resolved pursuant to the
provisions of Chapter 71 RSMo.

Case No. P08019 — 1000 South Country Club Drive; Voluntary Annexation, Zoning
Plan, and Preliminary PUD Plan. Request filed by Joseph Leydens, property owner, for the
annexation and zoning of approximately 0.7 acres of land and adjacent right-of-way
generally located on the northern side of South Country Club Drive approximately 650 feet
west of Fairgrounds Road. The property consists of part of the Southeast Quarter of the
Southwest Quarter of Section 8, Township 44 North, Range 12 West. (Central. Missouri
Professional Services, Consultant)
A. Voluntary Annexation, pursuant to Section 71.012 RSMo; and
B. Approval of a zoning plan for the subject property to be zoned PUD Planned Unit
Development; and
C. Approval of a Preliminary PUD Plan to construct a residential duplex.
Mr. Barron explained that this request was approved by the Commission on July 10, 2008
and subsequently modified by the applicant. He stated that staff withdrew this request and sent
it back to the Commission due to a modification in the setback dimensions requested by the
applicant. Mr. Barron explained that on the PUD Plan the sewer line is shown three feet from the
rear of the duplex. He stated that staff has indicated a preference to move the duplex two feet in
order to provide for a five foot separation from the sewer line.
No one spoke in opposition to this request and no correspondence was received.
Mr. Bickel moved and Mr. Parker seconded to recommend approval of the Voluntary
• Annexation petition, to the City Council. The motion passed 6-0 with the following votes:

Mr. Bickel moved and Mr. Hagan seconded to recommend approval of the zoning plan to
PUD Planned Unit Development, to the City Council. The motion passed 6-0 with the following

Mr. Bickel moved and Mr. Hagan seconded to recommend approval of the Preliminary PUD
Plan to construct a residential duplex, to the City Council, subject to the following conditions:
1. Compliance with the requirements of the City Wastewater Division regarding sewer
access and sewer line acceptance;
2. Movement of the duplex two feet to the east in order to accommodate a five foot setback
from the sewer line.
The motion passed 6-0 with the following votes:

Nature of Request
This request was withdrawn by City Staff and sent back to the Planning and Zoning Commission due to a
modification in the setback dimensions requested by the applicant.
This property is currently utilized as a multi-family residential development. One four-plex housing units exists on
the property. The property owner intends to divide the property into two separate lots and build a residential duplex
on the front portion of the property, which currently sits vacant. The current four-plex is served by the city sewer
system, however, the property lies outside the city limits of the City of Jefferson. Current city policy requires that
unincorporated properties that are adjacent to the city limits and wish to be served by the city sewer system must
first incorporate into the City of Jefferson.
The current plans for the construction of the residential duplex are somewhat unique in nature and would require a
rear yard setback variance from the Board of Adjustment if constructed according to the zoning code. The property
owner intends to construct the duplex so that it faces toward the existing driveway serving the property, rather than
facing South Country Club Drive. This creates a situation where the rear yard of the property (according to the
definition of a rear yard in the zoning code) actually serves as a side yard to the duplex. City staff suggested that

Staff Analysis
The City Wastewater Division has agreed to accept the current sewer service line that serves the four-plex housing
unit after the property owner submits an as-built plan for this line, grants the necessary easements, and constructs a
lamp hole to access the line. The sewer line would then serve as a sewer main and the property owner would be
able to tap into this line to serve the new duplex. The sewer line is shown on the PUD Plan three feet from the
side of the duplex. City staff have indicated a preference to move the duplex back two feet in order to
provide for a five foot separation from the sewer line.
Staff Recommendation
The property is bordered by property that has been incorporated into the city limits of the City of Jefferson. The
property lends itself well to incorporation. The proposed PUD zoning and preliminary PUD plan for the property
would serve the unique nature of the proposed development. Staff recommends approval of the annexation petition,
• zoning plan, and preliminary PUD plan subject to the following condition:
1. Compliance with the requirements of the City Wastewater Division regarding sewer access and sewer line
acceptance.
2. Movement of the Duplex two feet to the east in order to accommodate a five foot setback from the sewer
line.
