HomeMy Public PortalAbout11-06-2006PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, NOVEMBER 6, 2006 The Common Council of the City of Richmond, Indiana met in regular session Monday, November 6, 2006, in the Council Chambers in said City. President Sharp presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR KLOSE ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. APPROVAL OF MINUTES Councilor Welch moved to approve the minutes of the meeting of October 16, 2006, with a second by Councilor Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS VACATION PETITION NO. 2 -2006 - A PETITION TO VACATE A DEDICATED ROADWAY (NW 11 rH Street) This Petition is a request to vacate the right -of -way on NW 11th Street which divides the Johns Manville property. Richmond Power and Light will be using a portion of this right -of -way to facilitate Johns Manville's expansion. Resolution No. 2 -2006 was referred to the Plan Commission for public hearing. RESOLUTION NO. 14 -2006 — APPROVING A DECLARATORY RESOLUTION AND ECONOMIC DEVELOPMENT PLAN OF THE REDEVELOPMENT COMMISSION OF THE CITY OF RICHMOND, INDIANA, AND APPROVING THE ORDER OF THE RICHMOND PLAN COMMISSION This Resolution would approve a Declaratory Resolution, Economic Development Plan of the Redevelopment Commission and the Order of the Richmond Plan Commission with regard to the Johns Manville Economic Development Area. Councilor Welch moved to approve Resolution No. 14 -2006 with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. COMMUNICATION FROM THE MAYOR The Starr - Gennett Foundation and the City of Richmond Department of Parks and Recreation received an award from the Chamber of Commerce for their efforts in the Gorge on the "Logo" Building and trail. ■ Pamela Bliss is working as an Intern in developing an Arts Council. She is working with the Indiana State Arts Council. Her office is on the second floor of the City Building. ■ The leaf pick -up season is upon us. Citizens need to rake their leaves to the street and away from the curbs. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the October 5, 12 & 19, 2006 meetings were accepted as presented. Common Council Minutes November 6, 2006 Page 2 of 4 REPORTS FROM DEPARTMENT HEADS - None REPORTS FROM STANDING COMMITTEES - None REPORTS FROM SPECIAL COMMITTEES - None REPORTS FROM ORGANIZATIONS ■ Tourism Bureau Board of Directors — Melanie Falcone was nominated to serve on the Board of Directors. This nomination will be held until the December 4, 2006 meeting. ■ Police Merit Commission — Sandie Rowe was nominated to be reappointed and Bonita Washington -Lacey was nominated as a new member. These nominations were held until the November 20, 2006 meeting ■ Councilor Lundy, liaison for the Richmond Housing encouraged the support of HR 5576 which supports public housing. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 87 & 89 -2006 on first reading by title only with a second by Councilor Wissel. Upon a vote viva voce, the motion passed. ORDINANCE NO. 87 -2006 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE UNITED WAY OF THE WHITEWATER VALLEY The Clerk read Ordinance No. 87 -2006 on first reading by title only This Ordinance would authorize the City of Richmond Parks and Recreation Department to submit a grant application to the United Way of the Whitewater Valley and to accept said grant funding in an amount up to Five Thousand Three Hundred Fifty Dollars and Zero Cents ($5,350.00). These funds would be appropriated toward operating expenses related to Senior Widowed Program. Councilor Wissel moved to advance Ordinance No. 87 -2006 to second reading and to suspend the rules and read by title only with a second by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 87 -2006 on second reading by title only. Council President Sharp declared Ordinance No. 87 -2006 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 87 -2006 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 87 -2006 on third reading by title only. Ordinance No. 87 -2006 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 89 -2006 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Integrated Manufacturing Solutions) This Ordinance is a request of Integrated Manufacturing Solutions for a 10 -year tax abatement for equipment valued at $90,000. Ordinance No. 89 -2006 was referred to the Tax Abatement Committee for due diligence. ORDINANCES ON SECOND READING ORDINANCE NO. 50 -2006 — A GENERAL ORDINANCE CREATING A SECTION OF THE CITY OF RICHMOND CODE REGARDING ADULT ENTERTAINMENT BUSINESSES The Clerk read Ordinance No. 50 -2006 on second reading by title only. This Ordinance would create Chapter 126 of the Municipal Code and regulate adult entertainment businesses and related activities. A Committee of the Whole meeting was held July 31, 2006. This Ordinance was heard at the October 26 Richmond Advisory Plan Commission meeting. The Plan Commission passed a recommendation for approval. Councilor Pappin moved to amend Section 126.12, paragraph 13 by changing the current paragraph to 13A and adding 13B as follows: (B) Prior to adoption of this Ordinance by the Richmond Common Council shall be deemed a nonconforming use, as provided in Article XV, Section 154.16 of the City of Richmond Code. Councilor Lundy seconded the motion. Upon a vote viva voce, the motion passed. Councilor Parker moved to amend Section 126.16 to read as follows: (a) Any person, business, or corporation violating any provision of this article shall be guilty of an ordinance violation and shall be subject to a fine not to exceed $2,500.00. Each day a Sexually Oriented Business continues to operate is a separate offense or violation. (b) A person, business, or corporation who operates or causes to be operated a Sexually Oriented Business without a valid license or transfers a license (in violation of SECTION 126.11 of this Ordinance) is also subject to a suit for injunction. Councilor Glover seconded the motion. Upon a vote viva voce, the motion passed Council President Sharp declared Ordinance No. 50 -2006 on second reading and public hearing. Mr. Allen Williams spoke in favor of the Ordinance. There being no comments against the Ordinance, Councilor Wissel moved for engrossment of Ordinance No. 50 -2006 with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 50 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Parker. The Clerk read Ordinance No. 50 -2006 on third reading by title only Common Council Minutes November 6, 2006 Page 4 of 4 Ordinance No. 50 -2006 was adopted with a 9 -0 roll call vote ORDINANCE NO. 84 -2006 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 This Ordinance is a request by Ahaus Tool & Engineering for a five -year tax abatement for equipment valued at $120,000. The Tax Abatement Committee recommended approval. Council President Sharp declared Ordinance No. 84 -2006 on second reading and public hearing. Kevin Ahaus, President of Ahaus Tool, spoke in favor of the Ordinance. There being no comments against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 84 -2006 with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 84 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 84 -2006 on third reading by title only. Ordinance No. 84 -2006 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 85 -2006 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 The Clerk read Ordinance No. 85 -2006 on first reading by title only. This Ordinance is a request by TBK America, Inc. for a ten -year tax abatement for equipment valued at $3,114,000. Ordinance No. 85 -2006 was tabled at the request of the Petitioner. ORDINANCE NO. 86 -2006 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 The Clerk read Ordinance No. 86 -2006 on first reading by title only. This Ordinance is a request by P & M Holdings for a ten -year tax abatement for real estate valued at $145,000. Ordinance No. 86 -2006 will be held until further notice.
