President Sharp presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR ELSTRO ROLL CALL Councilors present were Howard "Jack" Elstro, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. Absent was Councilor Lundy. APPROVAL OF MINUTES Councilor Wissel moved to amend the Minutes to reflect his motion to reinstate Ordinance No. 85 -2006 with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. Councilor Pappin moved to approve the amended minutes of the meeting of November 20, 2006, with a second by Councilor Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS ■ IU EAST POLITICAL SCIENCE CLASS PROJECT - Dr. Paul Kriese's Political Science Class presented a proposed Smoking Ban Ordinance. This Ordinance was the Fall semester project. ■ RESOLUT ION NO. 15 — A RESOLUTION AUTHORIZING THE EXECUTION OF AN ASSIGNMENT, ASSUMPTION, CONSENT AND MODIFICATION AGREEMENT IN CONNECTION WITH THE CITY OF RICHMOND, INDIANA ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES 1998 (NORTHLAND CORPORATION PROJECT) The Clerk read Resolution No. 15 -2006 by title only. This Resolution would provide a loan to Northland Corporation (Marvel Industries) for the purpose of financing the cost of the acquisition, construction, installation and equipping of an approximately 47,200 square foot manufacturing facility and 5,000 square foot office area, together with the purchase of machinery and equipment to be utilized therein. The Project is located at 233 Industrial Parkway, Richmond, IN 47374. Councilor Welch moved to adopt Resolution No. 15 -2006 with a second by Councilor Parker. Upon a vote viva voce, the motion passed. ■ INTRODUCTION — Mr. Jim Dinkel was introduced by Councilor Sharp as the new Economic Development Corporation chairman. COMMUNICATION FROM THE MAYOR ■ Mayor Hutton discussed the resignation of City Controller John Kenny and apologized for Council not being notified of the announcement of Tammy Glenn serving as Interim Controller before the newspaper ran the story. ■ The City has received $7,500 from the Wayne County Foundation for the Police /Fire Training Center. ■ Citizens were encouraged to call the Salvation Army Christmas program. Several Department Heads are taking part in the bell ringing during the Christmas season. REPORTS FROM DEPARTMENT HEADS - None REPORTS FROM STANDING COMMITTEES - None REPORTS FROM SPECIAL COMMITTEES - None REPORTS FROM ORGANIZATIONS Councilor Sharp, Mayor Hutton and Metropolitan Development Director Tony Foster attended a reception at TBK. MISCELLANEOUS BUSINESS Councilor Pappin presented an etching of Johnson Hall on the Ivy Tech campus which will be placed in the City Building. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 91, 94, 96, 97 & 98 -2006 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 91 -2006 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS IN CERTAIN FUNDS The Clerk read Ordinance No. 91 -2006 on first reading by title only. This Ordinance authorizes additional appropriations to the General Fund from Motor Vehicle Highway, Park and Recreation, Fire Pension, Police Pension and Roseview Transit. Councilor Wissel moved to advance Ordinance No. 91 -2006 to second reading and to suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 91 -2006 on second reading by title only. Council President Sharp declared Ordinance No. 91 -2006 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 91 -2006 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 91 -2006 to third and final reading and suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 91 -2006 on third reading by title only. Ordinance No. 91 -2006 was adopted with an 8 -0 roll call vote. ORDINANCE NO. 94 -2006 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY BROWNFIELDS CLEANUP GRANT PROGRAM The Clerk read Ordinance No. 94 -2006 on first reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application, and to accept said grant funding, to the United States Environmental Protection Agency Brownfields Cleanup Grant Program to assist with the costs associated with environmental remediation in a portion of the Starr - Gennett area Common Council Minutes December 4, 2006 Page 3 of 4 in the Whitewater Valley Gorge. The funding would be in an amount up to Two Hundred Thousand dollars ($200,000.00). If awarded the funds shall be appropriated for assistance with the costs associated with environmental remediation in a portion of the Starr - Gennett area in the Whitewater Valley Gorge. A 20% local match is required for this grant to be provided by the Indiana Finance Authority Federal Grant Matching Incentive Program. Councilor Wissel moved to advance Ordinance No. 94 -2006 to second reading and to suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. This Ordinance would authorize the transfer of funds within the Police and Fire Department 2006 budgets. Councilor Wissel moved to advance Ordinance No. 96 -2006 to second reading and to suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 96 -2006 on second reading by title only. Council President Sharp declared Ordinance No. 96 -2006 on second reading and public hearing. This Ordinance would authorize the transfer of funds within the Park and Recreation 2006 budget. Councilor Elstro to advance Ordinance No. 97 -2006 to second reading and to suspend the rules and read by title only with a second by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 97 -2006 on second reading by title only. Council President Sharp declared Ordinance No. 97 -2006 on second reading and public hearing. This Ordinance would authorize the transfer of funds within the Municipal Airport 2006 budget. Councilor Welch moved to advance Ordinance No. 98 -2006 to second reading and to suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 98 -2006 on second reading by title only. Council President Sharp declared Ordinance No. 98 -2006 on second reading and public hearing. ORDINANCES ON SECOND READING ORDINANCE NO. 64 -2006 — A GENERAL ORDINANCE AMENDING SECTION 154.04 OF THE CITY OF RICHMOND CODE REGARDING ZONING (PODS) Councilor Welch moved to table Ordinance No. 64 -2006 with a second by Councilor Wissel. Upon a vote viva voce, the motion passed. ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, the meeting was adjourned.
