CALL TO ORDER: Mayor Swain called the regular meeting of the City Council to order at 7:34 p.m. on Tuesday, May 1, 1984, in the Council Chamber of the City Hall. 2. The invocation was given by Roger Lockie, Minister of Christian Education, First Baptist Church of Temple City, 6019 N. Baldwin. 3. The Pledge of Allegiance to the Flag was led by Mayor Swain. 4. ROLL CALL: Present: Councilmen- Atkins, Dennis, Gillanders, Tyrell, Swain Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Planning Director Shaw, Parks and Recreation Director Kobett, and Julie Estrada, Temple City Times. 5. CONSENT CALENDAR: Councilman Dennis requested Item C(1) be removed from the Consent Calendar; Councilman Tyrell requested Items B(2) and F be removed. On motion by Councilman Atkins, seconded by Councilman Tyrell all other items on the Consent Calendar were unanimously approved as recommended. A. APPROVAL OF MINUTES - Regular Meeting of April 17, 1984. Approved as written. B. RECOMMENDATIONS FROM PARKS AND RECREATION MEETING OF 4/18/84. (1) REQUEST FOR USE OF SHELTERS AT LIVE OAK PARK - TEMPLE CITY AMERICAN LITTLE LEAGUE Approved request from Temple City American Little League for use of Live Oak Park May 11 and 12, 1984, to conduct a fund raising pancake breakfast subject to the established City regulations and the required Certificate of Insurance. C. RECOMMENDATIONS FROM PLANNING COMMISSION MEETING OF 4/24/84. (2) SET PUBLIC HEARING - ZONE CHANGE FROM R -1 TO RPD AND TENTA- TIVE TRACT MAP NO. 43111 (5444 N. Santa Anita Avenue) Set public hearing for May 15, 1984, for zone change of subject property. (3) PLANNING COMMISSION ACTION Received and filed memos from Planning Commission relating to action taken at their regular meeting of April 24, 1984. D. REQUEST FOR PARTIAL PAYMENT - LIVE OAK PARK IMPROVEMENTS (D.D. Bennett Construction Co.) Authorized partial payment of $30,254.40 to D. D. Bennett Con- struction Company for work completed under the contract. E. REQUEST FOR AUTHORIZATION TO RECRUIT FOR SUMMER RECREATION STAFF Authorized staff to recruit the necessary personnel to conduct the seven week summer Recreation Program. ACCEPTANCE OF BID - STREET LIGHT CONVERSION - PHASE IV (Portions of City -Owned System Bounded by Encinita Avenue, Primrose Avenue Garibaldi Avenue and Live Oak Avenue) Accepted low bid from Diversified Electric in the amount of $49,800 and authorized the Mayor and City Clerk to sign the agreement. PUBLIC HEARING - STREET LIGHTING IMPROVEMENTS - WORKMAN AVENUE, ALESSANDRO AVENUE TO OAK AVENUE (Pursuant to Chapter 27, Improvement Act of 1911, Streets and Highways Code) Accepted the petition for installation of one street light; adopted Resolution No. 84 -2263 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING ITS INTENTION TO CAUSE CON- STRUCTION OF CERTAIN IMPROVEMENTS PURSUANT TO THE PROVISIONS OF SECTION 5870 ET SEQ., OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, and set public hearing for June 5, 1984. RENEWAL OF AGREEMENT - LOS ANGELES COUNTY LAW ENFORCEMENT SERVICES Approved 5 -year agreement with Los Angeles County Sheriff's De- partment for law enforcement services; adopted Resolution No. 84- 2265 A RESOLUTION OF THE CITY_COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING EXECUTION OF NEW CONTRACT WITH THE COUNTY OF LOS ANGELES FOR LAW ENFORCEMENT. SERVICES OF THE SHERIFF OF LOS ANGELES; and 'authorized the Mayor and City Clerk to sign. L. RENEWAL OF AGREEMENT —.REQUEST FOR RATE INCREASE FOR STREET SWEEPING - COMMUNITY DISPOSAL COMPANY Approved Disposal the rate Clerk to extension of street sweeping agreement with Community for the period. July 1, 1984 to June 30, 1985;' approved increase of 4.65 %; and authorized the Mayor and City sign. M APPROVAL OF WATER SYSTEM AND RELEASE OF SUBDIVISION WATER SYSTEM AGREEMENT AND FAITHFUL PERFORMANCE BOND - TRACT 37580, BETWEEN ARDEN, HALIFAX, AND HALLOWELL (Fairhaven Development Co.) Found that all work has been completed as required by. the Sub- division Water System Agreement for Tract 37580;. released said agreement; and released the Faithful Performance Bond, Bond No. 3SM -565 -167 in the amount..of $38,000. N RESOLUTION NO. 84 -2266 WARRANTS AND DEMANDS Adopted Resolution No. 84 -2266 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE: CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $107,964.07 DEMAND NOS. 7618 THRU 7669. Council Minutes, May 1, 1984 - Page3 CONSENT CALENDAR ITEM B(2) =REQUEST 'OR_`RESERVED USE OF TENNIS COURTS AT LIVE OAK PARK - TEMPLE CITY HIGH SCHOOL Councilman Tyrell requested that approval be made subject to com- pliance with the City litter regulations. Councilman Tyrell moved to approve the recommendation from Parks & Recreation Commission for reserved use of seven tennis courts May 8 and 9, 1984, by the Temple City Unified School District to conduct the Rio Hondo League Boys Tennis Prelims and Finals subject to the required Certificate of Insurance and compliance with City regulations, seconded by Councilman Atkins and unanimously carried. CONSENT CALENDAR ITEM C(1) PROPERTY NUISANCE CASE NO. 84 -111: 6256 BURTON Councilman Dennis questioned whether the issue of eviction should have some bearing on the City Council decision of whether to adopt a resolution of abatement at this time. Councilmembers felt that a public nuisance did exist and abatement should not be delayed. Councilman Tyrell moved to adopt Resolution No. 84 -2267 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREM- ISES TO BE A PUBLIC NUISANCE, AND ORDERING ABATEMENT THEREOF, seconded by Councilman Atkins anc�.`''unanimous1y carried. CONSENT CALENDAR ITEM F. AGREEMENT FOR COMMUNITY RECREATION PROGRAM WITH TEMPLE CITY UNIFIED SCHOOL DISTRICT • Councilman Tyrell stated there appeared to be an inconsistency in paragraphs 6 and 7 of the Agreement with regards to transposition of the words "City" and "District" and also questioned if the amount of insurance coverage was sufficient. After reviewing the Agreement, City Attorney Martin concurred and made the proper modification of Paragraphs 6 and 7, and stated fur- ther that public agencies are sometimes locked into the amount of insurance coverage they can provide. Staff was instructed to contact the School District regarding their insurance coverage limits. Councilman Gillanders moved to approve the Community Recreation Agree- ment with Temple City Unified School District as modified subject to potential expansion of insurance coverage, and authorized the Mayor and City Clerk to sign the Agreement, seconded by Councilman Tyrell and unanimously carried. 6. UNFINISHED BUSINESS: A. PROPERTY NUISANCE CASE 84 -110: 5032 ROSEMEAD (Continued from April 3, 1984, meeting) City Manager Koski presented background information stating that City Council, at their regular meeting of April 3, 1984, deferred until May 1, final action on the subject property nuisance to allow the property owner time to eliminate unwanted property and organize the remaining materials in a neat and orderly fashion. Staff was directed to videotape the premises to show the degree of progress in resolving the matter. Planning Director Shaw presented the videotapes of the premises taken on April 4th and again on May 1, 1984, showing progress has been noted with approximately 30% of the rear yard area cleared of miscellaneous items Barry Waldrep, 5032 Rosemead Boulevard, stated he needed more time to clear the property and requested Council to review the property again in 30 days before ordering abatement. Council Minutes, May 1, 1984 - Page 4 Councilman Tyrell moved to defer until June 5, 1984, meeting, final action on Property Nuisance Case 84 -110 allowing the property owner another extension to eliminate unwanted property and organize the remaining materials, seconded by Councilman Atkins, and unanimously carried. B. PUBLIC HEARING: 7:30 P.M. STREET IMPROVEMENTS - GREEN STREET, NORTH SIDE, 10039 -10119 GREEN STREET (Pursuant to Chapter 27, Improvement Act of 1911, Streets and Highways Code) City Manager Koski presented background information stating City Council set public hearing for this evening regarding the construc- tion of street improvements on the north side of Green Street which is one of the few unimproved streets in the City and is an area which regularly experiences flooding problems during the rainy season due to inadequate drainage of the area. Petitions were returned with signatures of property owners representing 85.7% of the front footage of the unimproved section on the north side of Green Street. An in- sufficient percentage of property owners on the south side of Green Street responded. Under provisions of the Streets and Highways Code, an improvement project may take place on only one side of the street, between two dedicated streets. Pursuant to City policy, the City assumes the engineering costs plus one -half of the construction costs of the curb and gutter, and the property owner assumes one - half of the construction costs of the curb and gutter and the entire cost of construction of driveway approaches. Property owners are aware of the costs to them which are estimated at approximately $900 per property owner. Mayor Swain declared the public hearing open and invited anyone wishing to speak to come forward. Russell Proctor, 10051 Green Street, wanted to verify the approximate cost to the property owner and when they could anticipate construction to begin. City Manager Koski stated the $900 estimate was the property owners portion and estimated the project to commence by August. Ted Hoyt, 10119 Green Street, stated some, of their property is washed away.; the standing water is hazardous for the children; was hopeful the project would be completed soon; and asked if the side- walks could be constructed at the same time. City Manager Koski stated the property owner could negotiate with the contractor and the sidewalks would be at the owner's..ex- pense. There being no one else that came forward to speak, Councilman Dennis moved to close public hearing, seconded by Councilman Gillanders and unanimously carried. Councilman Atkins moved to find the project to be in the best public interest; approved the Negative Declaration of Environmental Impact; adopted Resolution No. 84 -2264 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING THE CONSTRUCTION OF CERTAIN IMPROVE- MENTS PURSUANT TO SECTION 5870 ET SEQ. OF THE STREETS AND HIGHWAYS CODE; and to report on the improvements when the work is completed, seconded by Councilman Gillanders and unanimously carried. C. PUBLIC HEARING: 7:30 P.M. ASSESSMENTS FOR STREET LIGHTING IM- PROVEMENTS - CAMELLIA AVENUE, SPARKLETT STREET TO LA ROSA DRIVE Pursuant to Chapter 27, Improvement Act of 1911, Streets and Highways Code) City Manager Koski presented background information stating City Council, at their regular meeting of April 3, 1984, set public hear- ing for this evening to approve the assessments to property owners regarding the installation of four street lights on new marbelite standards with overhead service. The installation has been confirmed by staff and energized by Edison on March 19, 1984. Cost of installa- tion was $972 resulting in an assessment of $46.28 per property owner. Council Minutes, May 1, 1984 - Page5 Mayor Swain declared the- public hearing= open and invited anyone wish- ing to speak to come forward. There being no one that came forward to speak, Councilman Gillanders moved to close public hearing, seconded by Councilman Atkins and unanimously carried. Councilman Atkins moved to approve the assessments as detailed in the staff report dated April 20, 1984, and directed the Superin- tendent of Streets to notify property owners and collect the assess- ments, seconded by Councilman Dennis and unanimously carried. I 7. NEW BUSINESS: None. 8. COMMUNICATIONS: None. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: 1 No one came forward to speak. RECESS TO CRA: At this time, Council recessed to meet as the Community Redevelopment Agency; approved the minutes ,of the regular . meeting of April 17, 1984; received and accepted the reP6rt pursuant to California Health and Safety Code Section 33837 and transmitted same to City Council by resolution; and adopted resolution approving warrants and demands. The minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: A. RESOLUTION NO. 84 -2268: LEVYING SPECIAL ASSESSMENTS FOR CERTAIN BENEFITED PROPERTIES WITHIN THE ROSEMEAD BOULEVARD REDEVELOPMENT PROJECT AREA City Manager Koski presented the report prepared by Special Counsel Parrington on the assessment district within the Rosemead Boulevard Redevelopment Project pursuant to the authorization of Health and Safety Code Section 33823 for the fiscal year 1984 -85,• which Code Section provides a special assessment for the area known as Temple City Shopping Center. These assessments are necessary-to pay the indebtedness of the Temple City Community Redevelopment Agency which was incurred to carry out the development of the Shopping Center and for which the Agency would not have other available funds. The Agency recommends that the levy of $170,062.00 be made for the fiscal year 1984 -85. Notices for the special assessments have been sent to all affected property owners. Councilman Tyrell moved to adopt Resolution No. 84 -2268 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY LEVYING SPECIAL ASSESS- MENTS FOR CERTAIN BENEFITED PROPERTIES WITHIN THE ROSEMEAD BOULEVARD REDEVELOPMENT PROJECT AREA, seconded by Councilman Atkins and unani- mously carried. I 11. MATTERS FROM CITY OFFICIALS: A. REQUEST FOR USE OF TEMPLE CITY PARK - T.C. CHAMBER OF COMMERCE City Manager Koski presented a requested from the Temple City Chamber of Commerce for use of a portion of Temple City Park to present the Sixth Annual Residential Recognition Evening. The event is scheduled for Tuesday, May 22, 1984, from 7:00 to 8:30 p.m. Mayor Swain stated the program was a fine example of the contribu- tion of our citizens to the welfare of the City as well as the Chamber. Council Minutes, May 1, 1984 - Page 6 Councilman Tyrell moved to approve Park by the Temple City Chamber of Residential Recognition Evening on man Atkins and unanimously carried use of a portion of Temple City Commerce for the Sixth Annual May 22, 1984, seconded by Council- B. PROPOSED C -1 -R AND C -1 BUSINESS DEVELOPMENT COMMITTEE Councilman Dennis requested Council approve the establishment of an Ad Hoc Development Committee for the specific purpose of study- ing the C -1 -R and C -1 zones to determine the intermediate and long term prospects for that particular area of our community and also to study what methods can be employed to bolster that area. Coun- cilman Dennis would act as Chairman of the committee and would select a maximum of eight members. It is further anticipated that an initial budget of $1,000 would be required for meetings, travel and consultation in addition to the staff time required. Councilman Tyrell moved to approve the establishment of an Ad Hoc Development Committee; appoint Councilman Dennis as Chairman of the Committee who in turn will select the members; and appropriate $1,000 amending the budget accordingly, seconded by Councilman Atkins and unanimously carried. 12. ADJOURNMENT On motion by Councilman Atkins, seconded by Councilman Dennis, meeting adjourned at 8:15 p.m. Next regular meeting of the City Council will be held Tuesday, May 15, 1984, 7:30 p.m. in the Council Chamber of the City Hall.
