COUNCIL MINUTES

The Council of Bal Harbour Village met Tuesday, April 29, 1986 at 9:30
A.M. in the Village Hall.
Present: Mrs. Antiles, Messrs. Laikin, McKeehan, Sherman and Taplin
Also present were Louise Miller, Village Manager; Mary Wetterer, Village
Clerk; and Richard Weiss, Village Attorney.
Mr. Weiss explained that our original ordinance requiring smoke detectors
in high rise buildings did not include hotels. The proposed ordinance now
will include hotels, which will move up the State Sprinkler Law requirements.
Also the hotels will have until November 28, 1986 to comply. Mr. Desharnais
said that compliance by the hotels to this ordinance will mean that they will
not have to install sprinklers under the State Fire Regulations, however, this
does not include condominiums. It was decided to wait until the Building
Official has word on the condo provisions before considering the amending
ordinance.
Mayor Sherman explained that the State is considering a 2% tax on
library books and materials which would only be refunded to libraries serv-
ing over 20,000 people. This is unfair to the libraries operated by smaller
cities. Mrs. Miller explained that there is a grant available from the Ben
Franklin Society to survey how small libraries could pool their books and
materials and still remain independent. Dr. Antiles from the Library Board
said this would benefit our library as the three towns have no space to store
books. Mr. Sherman said Dade County had approached Bal Harbour to join the
County system, however, it would be based on a millage levy of .456, this could
cost the individual taxpayers a total of $216,000. The advantages and dis-
advantages of this should be studied. On motion of Mr. McKeehan, seconded by
Mrs. Antiles and unanimously voted

requesting the State to include independent libraries in the proceeds of the
proposed 2% tax on library materials was adopted.
Mr. Desharnais reported that hotels are exempt from the Fire Law under
certain conditions, such as a one hour fire separation between apartments and
use of non-combustible materials. Condominiums are not exempt from the sprinkler
law effective October 1, 1990. The Village Clerk read the proposed ordinance
by title. It was moved by Mr. Taplin, seconded by Mr. Laikin and unanimously
voted to pass the ordinance on first reading including hotels in the smoke
detector ordinance.

Mrs. Miller said that the attorneys are preparing documents on the owner-
ship of the land for the mini -park so that the Sun Bank can participate.
The Department of Transportation have given a contribution pledge and we are
trying to increase the contribution. Ludovici and Orange, Village Engineers
have been contacted and they estimate their cost to be $19,700 to prepare
specifications and engineering drawings of the final design of the park so
it can go out for bids. This should take four or five weeks. It was moved
by Mr. Taplin, seconded by Mrs. Antiles and unanimously voted to contract
with Ludovici and Orange to prepare bids and specifications for the mini -park.
Mrs. Miller said that the Hal Mar Realty case has been settled, the results
of the settlement are that the firm will serve Balmoral residents only and
deal in residential sales. They will remove their offices by March 1, 1988.
It was moved by Mr. McKeehan, seconded by Mr. Taplin and unanimously voted
to accept the settlement.
Mr. Sherman reported that the firm of Reynolds, Smith and Hills has
offered to review the items concerning residential district construction
i.e. building heights, lot coverage, etc. at no cost to the village .
Mr. Kelly, Finance Director, reviewed the six months operating statements.
He discussed with the council the recent breakdown at one of the sewer
stations and pending the results of engineering and other findings it may
be necessary to raise sewer rates, and possibly water rates. The resort taxes
are now as estimated due to March returns being up. Expenses are in line.
On motion of Mrs. Antiles, seconded by Mr. Laikin and unanimously voted the
statements were filed for audit.
Mr. Sherman said that the village has a problem getting people who have
burglar alarms to file for a permit. He said the Manager and he have sug-
gested that a penalty be instituted for those not filing. This is provided
for in a suggested ordinance. He is also suggesting that the graduating
penalties be instituted for false alarms. Mr. Weiss said he had prepared an
ordinance incorporating these suggestions. The ordinance also provides a
per day penalty for not filing for a permit. The Village Clerk read the
ordinance by title only. On motion of Mr. Laikin, seconded by Mrs. Antiles
and unanimously voted the ordinance was passed on first reading.
Mayor Sherman said that he is asking Messrs. John Alden, Steve Bobby
and Gerry Orange to serve on the Budget Committee.
Mr. Sherman reported that we had a 25% response from the gambling survey.
69% said "no gambling" in Bal Harbour, and 60% said "no" for Dade County.
There were many comments both for and against. Some said they would change
their vote under certain stipulations. Our results were compared to a Dade
County survey which showed a 50-50%.
Mrs. Miller said our Charter provisions are to low, stating a $500.00
purchase limit by the Manager without Council approval. A more logical amount
would be $2,500.00. Mr. Weiss said he would prepare an ordinance for next
meeting stating the ballot question to be placed on the ballot for the General
Election.
The Village Manager reported that the State of Florida needs extra in-
formation regarding our plans for a jogging path on the oceanfront on the
east side of the planting beds. On May 15, 1986 we intend to make a pre-
sentation for a grant for the construction. Mr. Desharnais described the path
which will be ten feet wide with a surface of lime rock over sand contained

inside boards. We are also getting prices for stainless steel equipment for
the Vita Course. The cost of the path will be approximately $40,000.00 to be
paid from the Grant and the Tourism account.
Mrs. Miller said that the security firm for the residential section had
made some suggestions and requests which the village took care of. A new
maintenance firm, Cincinnati Gate Company has been hired to maintain the
back entrance gate. There have been some comments from those assessed re-
garding the method of assessment. Mr. Sherman said this can be considered
by the budget committee and Mr. Kelly for next year's budget.
The council discussed the problem of people on jet skis coming too close
to the swimmers. Chief Baquero outlined the problem involved in trying to
contact the skiers. It was suggested that the police department contact the
rental agent for the skis at Haulover and ask for their cooperation in ad-
vising the renters of the skis about marine regulations for the skis.
On motion of Mr. Taplin, seconded by Mrs. Antiles and voted the meeting
was adjourned at 11:45 A.M.

The regular monthly meeting of the Bal Harbour Village Council was
held at 9:30 A.M. on Tuesday, May 27, 1986, in the Village Hall. Present:
Mrs. Antiles, Messrs. Laikin, McKeehan, Sherman and Taplin. Also present:
Village Manager Louise K. Miller, Deputy Clerk Carole Morris, and Village
Attorney Weiss.
Approval of Minutes: The Mayor requested that the minutes of the April
29, 1986 meeting be amended to show that information stated at that time
regarding fire safety requirements was incorrect. Further research has
indicated that if buildings install smoke detection systems as described
by Village Ordinance, neither condominiums or hotels will be required to
install sprinkler systems - except in public areas. There was some dis-
cussion as to where a system such as the one required by the proposed Ord-
inance could be seen in operation. Building Official George Desharnais
indicated that the Ba1 Harbour 101 has a similar system. After some further
discussion, a motion was made by Mrs. Antiles and seconded by Mr. Taplin
to accept the minutes as amended. The motion carried unopposed.
Smoke Detection Ordinance, Number 278: It was requested by Mr. Bernie
Burke of the Singapore Hotel that this Ordinance be tabled until the next
meeting so that the hotel owners would have ample time to investigate the
ramifications of the Ordinance. Village Attorney Weiss explained that this
