Request filed by Five-O-Five Hobbs, LLC, property owner, Clyde Lear, authorized representative, on behalf of Capitol Hospitality Services Inc., applicant, George Pate, authorized representative, to rezone approximately 2.8 acres from C-1 Neighborhood Commercial to PUD Planned Unit Development and for approval of a Preliminary PUD Plan to construct a four story hotel containing 106 rooms. The property is located on the southern side of Missouri Boulevard approximately 350 feet east of Hobbs Road and is described as part of the Southeast Quarter of the Northwest Quarter of Section 9, Township 44 North, Range 12 West, City of Jefferson, Cole County, Missouri. (Naunpareil Inc., Consultant) Mr. Duane Schreimann, Schreimann, Rackers, Francka & Blunt, LLC, 2316 St. Mary's Boulevard, Suite 130, spoke on behalf of Five-O-Five Hobbs, LLC. Mr. Schreimann explained that the purpose of these requests is to construct a full service Holiday Inn Hotel. He stated that the Planning and Zoning Commission approved the previous rezoning request from C-1 to C-2, but was withdrawn by the applicant prior to the public hearing before the City Council. Mr. Schreimann stated that after discussions with Mayor Landwehr and Council members, Mayor Landwehr felt that a PUD zoning designation was more appropriate because it required the developer to come up with a specific plan. Mr. Schreimann stated that the Hobbs Road Neighborhood Association submitted a letter dated August 4, 2008 stating their opposition to the rezoning request however on August 14, 2008 the association submitted a letter withdrawing their opposition. He entered into the record an agreement submitted by Mr. Clyde Lear outlining a list of commitments for the property located to the south of the hotel property. He explained that this property is currently zoned C-1 and the neighbors were concerned about how that property will be developed. Mr. Schreimann explained that final agreement is conditional upon the approval of the Preliminary PUD Plan and closing the sale of this property to the hotel developer. He explained that upon approval of the PUD Plan and the closing of the hotel • sale, it is Mr. Lear's intent to prepare a declaration of restrictions that can be recorded which will encumber this property. Mr. Schreimann clarified that some individuals may speak in opposition however we were in contact with a neighborhood association that claimed to represent the majority of property owners. Excerpt of Unapproved Minutes/Jefferson City Planning &Zoning Commission Page 2 August 14, 2008 • Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding this request. Mr. Bates distributed a visual depicting the roof height of the adjacent Learfield facility. He stated that the height of the hotel driveway entrance facing Missouri Boulevard is 794 feet whereas the height of the first floor entrance of the hotel is 780 feet, which is 14 feet below Missouri Boulevard. Mr. Bates explained that the eave height of the hotel is 829 feet however the entrance canopy extends that height to 835 feet which is approximately four(4)feet below the highest roofline of the adjacent Learfield building. He stated that a conceptual traffic impact study was conducted in September 2005 for the entire site, however, that development did not move forward based on market demand. Mr. Bates explained that, due to concerns from Council members that traffic on Missouri Boulevard increased significantly, they re-conducted the traffic impact study in June 2008 and found that some of the traffic volumes reduced slightly and some increased slightly when compared to the original traffic study. He stated that the morning peak hour would generate approximately 50-55 cars an hour whereas the evening peak hour would generate approximately 60- 65 cars an hour. Mr. Schreimann stated that there were concerns from neighbors of making left turns off of Hobbs Road onto Missouri Boulevard. He explained that the city intends to widen that intersection and that Mr. Lear has indicated that he will dedicate right-of-way to improve that intersection. Mr. Wylie Comp, Naunpareil, Inc., 1028 E. Linwood Drive, Springfield, MO 65807 spoke on behalf of Capitol Hospitality Inc. Mr. Comp explained that the developer is proposing a four story 106 room full service Holiday Inn hotel with an in-house restaurant and lounge. He presented a prototype of a similar Holiday Inn which shows the hotel sitting in a tree lined area with green open space surrounding it. Mr. Comp stated that the proposed hotel will sit below the site line of property owners located to the south and also sits below the roof top of the adjacent Learfield building. Ms. Nancy Duggins Vostal, 733 Hobbs Road, expressed concerns that this rezoning will set a • precedent for future rezonings in this area and that while there are neighbors that have agreed to this rezoning there are neighbors that prefer the C-1 zoning designation and are opposed to this rezoning. Correspondence was received from Mr. Clyde Lear, 505 Hobbs Road, outlining commitments concerning the remaining property located to the south of the hotel property. Correspondence was received from the Hobbs Road Neighborhood Association dated August 14, 2008 retracting their opposition to the rezoning request. Correspondence in opposition to the rezoning request was received from the Hobbs Road Neighborhood Association dated August 4, 2008. Mr. Barron gave the Planning Division staff report and explained that a previous request to rezone the property to C-2 was recommended for approval by the Planning and Zoning Commission on March 13, 2008, but was withdrawn by the applicant prior to the public hearing before the City Council. The applicant has submitted a new request rezoning the property from C-1 to PUD and approval of a Preliminary PUD Plan to construct a four story hotel, as well as, an associated minor subdivision plat for Missouri Hobbs Business Park. Mr. Barron explained that the proposed pole sign meets the maximum height of 32 feet from the grade of Missouri Boulevard. Mr. Wade gave the Engineering Division staff report and explained that storm water detention will not be required, as storm water will be directed to the creek area to the east of the property. He explained that facilities for fire hydrants and street lights do not exist along Missouri Boulevard and will need to be installed in accordance with City Code. Mr. Bates stated that he concurs with staff comments and recommendations. • Mr. Hilpert explained that Mr. Lear's letter of agreement could be conditionally approved as a part of this request. Mr. Schreimann explained that Mr. Lear cannot agree to restrict the balance of the property until he knows that this site has sold to the developer. He stated that Mr. Lear cannot sell the property to the developer until the Preliminary PUD Plan is approved by the Planning and Zoning Commission and the City Council. The commitment is clear that once the Preliminary PUD Plan is approved and once the sale closes than the restrictions will be recorded. Mr. Schreimann offered to submit a draft of the restrictions to the Council by the time this request is scheduled for final vote. Mr. Bickel moved and Mr. George seconded to recommend approval of rezoning 3625 Missouri Boulevard from C-1 to PUD to the City Council. The motion passed 6-0 with the following votes: Aye: Bickel, Deeken, George, Hagan, Lake, Mihalevich Mr. Bickel moved and Mr. Lake seconded to recommend approval of the Preliminary PUD Plan for 3625 Missouri Boulevard to the City Council, subject to the following conditions: 1. The underlying zoning district of the Preliminary PUD Plan shall be established as C-1 Neighborhood Commercial for the purpose of determining allowed uses with the addition of hotels and motels with building area of 100,000 square feet or less as an allowed use and a maximum height established as 60 feet. 2. The site is vacant, unimproved land, abutting a proposed private roadway on its West boundary line. West Missouri Boulevard (South Frontage/Outer Road to U.S. Highway 50) adjoins the property on its North boundary. An existing natural greenway and drainage draugh adjoins the property on its East boundary. An undeveloped commercial area adjoins the property on its South boundary. The property is sloped north to south, with a gradual west to east cross- fall from the proposed private roadway on the West boundary to a significant grade break on the west side of the natural greenway and drainage draugh on the east side of the property. Mature trees are located along and within the greenway with additional trees and native shrubs located near the South property boundary and through the central portion of the overall site as well. Native grasses cover the balance of the property. The structure will be metal framed and wood sheathed, constructed on a concrete pier and beam foundation. The exterior will be brick and E.F.I.S. Nature of Request The applicant requests a rezoning of the property from C-I Neighborhood Commercial to PUD Planned Unit Development and approval of a Preliminary PUD Plan for consisting of a four story hotel. The property owner has submitted an associated minor subdivision plat that would accommodate the development of the property. The purpose of these requests is to make the property available for the construction of a hotel that would exceed the height limitations and maximum hotel size limitations of the C-1 Neighborhood Commercial zoning district. A previous request to rezone the property to C-2 General Commercial was recommended for approval by the Planning and Zoning Commission on March 13, 2008, but withdrawn by the applicant prior to the • public hearing before the City Council. Location The subject property is located on the southern side of Missouri Boulevard approximately 350 feet east of Hobbs Road. The PUD Plan shows a total of 138 spaces. Permitted Uses: The PUD Plan identifies an underlying zoning district of C-1 for the purpose of establishing allowed uses on the property with the addition of hotels and motels with building area of 100,000 square feet or less as an allowed use and a maximum height established as 60 feet. • Planning and Zoning Commission August 14, 2008 Case No. P08020 and 21 Page 2 Access/Traffic: One driveway entrance off of Missouri Boulevard is proposed by the PUD Plan. While • actually located on the adjacent lot,as proposed by the associated minor subdivision plat,the driveway to the property is located within the area proposed to be rezoned to PUD and is identified on the Preliminary PUD Plan. In 2005, a traffic study was prepared by George Butler Associates for this area that assumed the development of the property with 34,000 square feet of general office space, 17,500 square feet of retail space, a 5,700 square foot drive-in bank,and 88 condominium units. George Butler Associates has since prepared an update to this traffic study that reflects the development of the property with a hotel and a future fast food restaurant. The expected number of peak hour trips that would be generated by the hotel would be 61 (with a peak in the PM hour). Building Design: Elevation drawings representing the facade design of the building have been submitted. The construction materials for the building facade are identified as brick and EFIS. Landscaping_The PUD plan indicates a total of 20 parking lot landscaping trees,which would be expected to meet the 35%parking lot coverage ratio requirement as outlined within the zoning code. Ski s In PUD districts,the location, size and character of signs shall be established by the Commission and Council during site plan review and approval. Three building mounted signs(88.75 square feet each)would be located on the front, back, and side of the building facing Missouri Boulevard. One pole sign(90 square feet) with a maximum height of 32 feet as measured from the grade of Missouri Boulevard would be located near the entrance. Two entrance/exit signs(8 square feet each)would be located at the entrance to the parking lot. The total amount of signage proposed by the PUD Plan is 378.25 square feet. In a normal commercial zoning district,the total amount of signage that the property would be eligible for(based on 153 linear feet of roadway frontage)is 276.5 square feet. While the proposed level of signage exceeds what would normally be permitted, the property has a rather small amount of frontage because the property boundary was drawn in order to exclude a stormwater drainage/natural area adjacent to Missouri Boulevard,which detracted from the allowable signage for the property. Signage allowances in excess of what would normally be permitted can be approved within the PUD Plan. Lighting: A photometric illustration of the lighting plan has been submitted. The average lighting level across the parking lot is indicated as 1.92 footcandles,which is under the maximum footcandle level of 2.0 allowed in the proposed C-1 underlying zoning district. Pedestrian Walkways: A 5 foot wide sidewalk is shown along Missouri Boulevard as required. First, the proposed PUD of 2.5 acres falls well below the 10 acres specified by the city as the 1 • minimum PUD size. The vacant area available for development comprises nine acres. To convert dust 2..5 of these to a PUD in order to circumvent the current C-1 zoning for one building is essentially"spot-zoning." Moreover, it leaves the remaining area open to any number of projects, v,hick combined with the currently proposed hotel, could further the negative impact on the area. Vie strongly object an exception to the PUD size requirements when there is adjacent land i available for development and potential projects have already been voiced by-the owner. If the entire: parcel were to be part of the PUD and an enlarged buffer for the residential areas clearly ` outlined, the neighborhood would look on the development much more favorably. Second, while the neighbors have been told we should be grateful for the proposal as PUD, as we will be informed of all details, this has not been our experience to date. The city has been unable to answer our questions about the development— ostensibly because the developer has not proti-ded them with this information either. Traffic studies on file were done before much of the current development on this end of Missouri Blvd. 1 We are in favor of development for the land. We would like to sec the last vacant lot on Missouri Blvd, put to use for the betterment of the city, not just our neighborhood. Surrounding properties (city blocks on both sides of the location) are characterized by two-story or under, attractive coq orate structures with extensive surrounding green areas that are nicely landscaped. Learfield, which is next door, is a prime example of this. A 4-story hotel, as it has been presented, is simply 1 not in the spirit of the area and would only serve to make traffic issues on Missouri Boulevard worse than they already are, • A conversion from C-1 to C zoning was approved unopposed by your board in April, largely due to the fact that the community-was not yet aware of it. As you-know, the proposal was pulled before it went to City Council. In the meantime, it has already had a negative impact on the real 1 estate prices in that at least one property has already been "dumped" for below-market prices. Other properties on the market have been passed on after prospective buyers learned of the proposed hotel. Our concerns are valid. Approving the PUD, as it currently stands, will only continue this downward trend. if the PUD 1 were to cover the entire land, including an enlarged wooded buffer for the adjoining residential areas, we feel the integrity of the neighborhood could largely be preserved.
