RESOLUTION NO. 16-9177
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA, AUTHORIZING THE ISSUANCE
OF AN RFP/RFQ; AND AUTHORIZING THE CITY MANAGER
TO EXECUTE AN AGREEMENT (EXHIBIT "A") WITH THE
BEST, COMPETITIVE AND MOST RESPONSIVE APPLICANT;
AND AUTHORIZING THE APPLICANT TO BE RESPONSIBLE
FOR THE CONSTRUCTION AND PLACEMENT OF BUS
BENCHES, TRASH RECEPTACLES AND BIKE RACKS; AND
TO PERMIT ADVERTISING ON THE BUS BENCHES, THE
TRASH RECEPTACLES AND BIKE RACKS; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, The City has control of and owns or has the right to use various
locations in its municipal boundaries for the convenience of its citizens as locations for
bus stops, where it is desirable to place bus benches for the convenience of the public;
and
WHEREAS, the placement of bus benches is a public utility and convenience
and, as such, fulfills a collateral public transportation need; and
WHEREAS,The City is desirous for the construction of bus benches; and
WHEREAS, The City will issue an RFP/RFQ from which the best, competitive,
and most responsive applicant will be selected to be "The Contractor", and
WHEREAS, The City Manager is hereby authorized and directed to execute, on
behalf of the City of Opa-locka, the Agreement (Exhibit "A") with "The Contractor", in
substantially the same form as attached, to allow the construction and placement of bus
benches, trash receptacles and bike racks at locations approved by the City and to
permit advertising on each of them for a ten year term, as listed in the Agreement
(Exhibit "A") and in accordance with City code;

WHEREAS, The City will require, as provided in The Agreement (Exhibit "A"),
that all insurance and indemnification be provided by "The Contractor" to protect the
City; and
WHEREAS, The City will require, the Contractor to be completely responsible
for the installation, maintenance, repair, and replacement of the bus benches, trash
receptacles and bike racks for the full term of this agreement both materially and
financially; and
WHEREAS, The City will require that the Contractor is also responsible for
maintaining a code compliant appearance of the area immediately surrounding the
bench for a radius of ten feet from the exterior of the bench; and
NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA, FLORIDA:
Section 1. The recitals to the preamble herein are incorporated by reference;
Section 2. The City Manager is hereby authorized to issue an RFP/RFQ from
which the best, competitive, and most responsive applicant will be selected to be "The
Contractor", The City Manager is directed to execute, on behalf of the City of Opa-
locka, the Agreement (Exhibit "A") with "The Contractor", in substantially the same
form as attached, to allow the construction and placement of bus benches, trash
receptacles and bike racks at locations approved by the City and to permit advertising
on each of them for a ten year term, as listed in the Agreement (Exhibit "A");
Section 3. The Contractor is responsible for the installation, maintenance, repair
and replacement of the bus benches, bike racks and trash receptacles both materially
and financially for the full term of this Agreement (Exhibit "A") and is also responsible
for maintaining a code compliant appearance of the area immediately surrounding the
bench for a radius of ten feet from the exterior of the bench.
Section 4. The Contractor shall pay the City a fixed fee or ten percent of the
gross annual advertising revenue, whichever is greater for the full term of this
agreement.

Section 5. This Resolution shall take effect immediately upon adoption.

Short Title:

Staff Summary
The City administration has determined that there is a great need for additional bus stops and at
these bus stops it is desirable to place bus benches (bus shelters) to better serve the community
and provide improved convenience for its citizens. The new bus shelter locations must be
approved by the City prior to installation. It has also been determined by the City Administration,
that the bus shelters, constructed and placed as a result of this legislation shall be located in the
public rights of way as close as possible to Miami-Dade County transit stops. Approval of this

legislation authorizes the issuance of an RFP/RFQ and authorizes the City Manager to enter into
an agreement with the best, competitive and most responsive applicant. The contractor, the best,
competitive most responsive applicant, shall be selected from those obtained from an RFP/RFQ
process and the applicant shall be responsible for all liabilities concerning the use of the bus
shelters and will be responsible for the maintenance of the shelter for the term of the agreement.
This agreement especially items One through Twenty-Five, of "The Agreement" will be in effect for
a term of ten years with an optional five-year extension.
This legislation will also grant the applicant or shelter manufacturer/installer the right to market
advertisements on city-owned bus benches (bus shelters) and to authorize them to install trash
receptacles and bike racks with advertisements at the same locations.
Proposed Action:
Staff recommends approval of this Resolution.

Request:

Financial Impact:
Based on the average per other local municipalities, the City shall receive a minimum
$500.00 per month in years 1-3; $600.00 per month in years 4-6; and $700.00 per
month in years 7-10.
