HomeMy Public PortalAbout2001-003 Resolution Regarding Variances at 2971 Ardmore AvenueMember Carolyn Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.01-03 RESOLUTION REGARDING VARIANCES AT 2971 ARDMORE AVENUE WHEREAS, Raymond P. Wald and Kathryn A. Wald (the "Applicants") are the fee owners of property located at 2971 Ardmore Avenue, which property is currently legally described as Lot 11 and the east 20.00 feet of Lot 10, Block 20, Independence Beach, Hennepin County, Minnesota (the "Property"); and WHEREAS, the Applicants have requested permission to construct a 10' x 20' garage addition which would require reducing the side yard setback from 10' to 7.7' and an addition to the kitchen measuring 10' x 18', which would require variances to reduce the front yard setback from Pine Street from 30' to 25.7' and to reduce the rear yard setback from 30' to 29'; and WHEREAS, this matter was reviewed by the planning commission on December 12, 2000 and by the city council on December 19, 2000; and WHEREAS, the planning commission recommended granting variances from the front yard setback from Pine Street and the rear yard setback variance for the kitchen addition but denial of the side yard setback variance for the garage. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that variances be granted to the Applicants to reduce the required front yard setback from Pine Street from 30' to 25.7' and to reduce the required rear yard setback from 30' to 29' for a kitchen addition, subject to the following terms and conditions: 1. The kitchen addition must be constructed in substantial compliance with the plans and specifications presented to and reviewed by the planning commission and city council; RHB-191244v 1 ME230-8 1 01-03 Jan. 2, 2001 2. The Applicants must comply with all building code and other ordinance requirements in constructing the kitchen addition; 3. The Applicants must complete construction of the kitchen addition within one year of the date of this resolution or the approval hereby granted will be null and void; and 4. The Applicants must pay to the city an administrative fee in the amount necessary to reimburse the city for the cost of reviewing this application. The above variances are justified because there exists a hardship due to the location of the original structure on the lot and the fact that it is on a corner and subject to two front yard setbacks. NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of Medina that the variance for a side yard setback for the garage addition is hereby denied because there is no hardship relating to the Property which justifies granting the variance.
