HomeMy Public PortalAbout63-018 (03-05-63) RESOLUTION N0 63-18 RESOLUTION OVERRULING PROTESTS IN CONNECTIQN WITH THE HEARING ON DEBT LIMITATION FOR THE PROPOSED IMPROVEMENT'OF BEECHWOOD AVENUE BETWEEN CALIFORNIA AND LYNWOOD CITY PARK BY THE REMOVAL OF EXISTING CURB AND GUTTER AND BY THE CONSTRUCTION OF CONCRE'I`E � CURB AND GUTTER AND DRIVEWAY APPROACHES, TOGETHER WITH ALL INCIDENTAL AND APPURTENANT WORK. WHEREAS, the City Council of the City of Lynwood did, on the 15th dag of January, 1963, approve an investigation report under ' the provisions of Division 4 of fihe Streets and Highways Code, cited as "Special Assessment Investiigation, Limitation and Majority Protest Act of 19j1," as ametided, upon the proposed iniprovement o£ Beechwood � Avenue between California and Lynwood City Park by the removal of existing curb and gutter and by'the construetion of concrete curb and gutter and driveway approaches, together with all incidental and " appurtenant work, as shown on Plan No Zg62-w-z on file in the office of the City Clerk of said city, and �WHEREAS, said report having been duly prepared and filed, a hearing was held by said City Council on the 5th day of February, 1g63 in the manner provided in said Aet above referrec3 to, and WHEREAS, more than thirty days have expired since the date , of mailing notices of hearing on said report, NOW, THEREFORE, the City Council o£ the City of Lynwood ' does hereby resolve as followe: l, That the protests made at said hearing on said investi- gation report be and the same are hereby overruled; - _ 2. That the public interest, convenience, and necessity � require the doing and making o£ the public improvement set forth and ' deseribed in said report above referred to and substantially in the , manner set £orth; �, 3. That the project consisting of the proposed improvement above referred to is feasible, and that the land to be assessed will be able to carry the burden of said proposed assessment; 4, That the estimated total amount proposed to be assessed upon any or all lots or parcels of land for the costs and expenses o£ said proposed improvement does not exceed the limitation of indebt- edness established and set forth in said act above referred to and will not, by the levy thereof, cause said limitation to be exceeded in any instance; 5, That no majority protest has been filed with the clerk of the legislative body by the owners of the property proposed to be assessed to pay the costs and expenses of said proposed improvement; 6, That it is hereby ordered that the proceedings for the making of said proposed improvement be undertaken pursuant to the provisions of an Act of the Legislature of the State of California designated as Division 7 of the Streets and Highways Code, cited as the "Improvement Act of 1911, and amendments thereto," ` APPROVED and ADOPTED this 5th day of , March;:, ig63 � f ��n���%�?!�-���_ � AT ST: , D I I I I � I � �.,_.,:y.._._,. _ � STATE OF CALIFORNIA } COUNTY OF LOS ANGELES: ss.
