HomeMy Public PortalAbout63-026 (04-02-63) �' , RESOLUTION'N0 63-26 RESOLUTION OF INTENTION IN THE MAT�I'ER OF THE � IMPROVEMENT OF BEECHWOOD AVENUE BETWEEN CALIFORNIA �u � AVENUE AND LYNWOOD CITY PARK BY THE REMOVAL OF EXISTING CURB AND GUTTER AND BY THE CONSTRUCTION OF CONCRETE CURB AND GUTTER AND DRIVEWAY APPROA�HES, TOGETHER WITA ALL INCIDENTAL AND APPURTENANT WORK, -WHEREAS, pursuant to the provisions of Division 4 of the Streets and Highways Code, cited as the "Special Assessment Investi- � gation Limitation and Majority Protest Act of 1931," the City Council of the City of Lynwood has determined that the improvement of Beechwood Avenue between California Avenue and Lynwood City Park, as proposed in Resolution No, 63-7'of said city, is £easible, and that the public interest, convenience, and necessity require the improvement sub- stantially as set forth in said report, and WHEREAS, said City Council has found that the lands to be assessed will be able to stand the burden of the proposed amendment, .. , NOW, THEREFORE, BE IT RESOLVED by the City Council of the' . City of Lynwood as follows: Section l . That in the opinion of the City Council o£ the City of Lynwood the public interest and convenience require and it is , the intention of said City Council to order the following work or improvement to be done, to wit: ' The removal of trees, cement concrete curbs, gutters, . sidewalks, driveways, and storm drain catch basins, and the'construction of cement concrete curbs, gutters, driveways, sidewalks, and sto'rm drain catch basins including all incidental anc7 appurtenant work in Beechwood Avenue between the center line of.California Avenue and � the east line of Tract No, 2551 as recorded in Book 24, , page 79 of Maps, Records of Los Angeles County, All of said work or improvement sha11 be performed in the , _1_ public ways and between the limita hereinbefore designated except where the plans indicate that said work shall be omitted, That all of the work or improvement aforesaid shall be done ' and performed in accordance with and to the grades shown on Plans and specifications No z96z-W-3 on file in the office o£ the City Clerk of said .city, Sa;d plans are hereby referred to for a full and com- plete description of said proposed work and for the grades to which the work is to be done, and sai� plans and specifications are by reference made a, part hereof and shall govern for all details of the proposed work, That the total estimated cost of said work or improvement is the sum of Ten Thousand Six Hundred Sixty-seven and 80/100ths Dollars ($10,667,80). Section 2 , 'IThat said contemplated work or improvement, in _- the opinion of said City Council, is of more than local or ordinary public benefit, and said City Council hereby determines and declares � that the district to be benefited by sa'id work or improvement, an� to be assessed to pay the costs and expenses of such work or improvement is shown on Plan'No, 1g62-W-4 on file in the of£ice of the City Clerk of said city, to which reference is hereby made for a full and complete description of the assessment district, Section 3 . The City'Council hereby determines and declares that serial bonds shall be i�sued in the manner and form provided in Division 7 of the Streets and Highways Code, cited as the "Improvemerit Aet of 1911," as amended, bearing interest at the rate of six per cent ' per annum to represent eaeh assessment of Fifty Dollars ($50,00) or ' over remaining unpaid for thirty days after the date of recordation of the warrant; said serial bonds shall extend over a perio� ending nine years from the second day of January next succeeding the next September first following their date, Said bon�s and interest thereon shall be paid at the office o£ the City Treasurer and the same shall be disbursed by him, all as provided in the said "Improvement Act of 1911," as amended, -2- ' . Section 4 , Notice is hereby given that the provisions o£ that certain act of the Legislature of the State of California desie- nated as the Streets and Highways Code, Division 4, cited as the "Special Assessment Investigation Limitation and Majority Protest Act of 19j1," as amended, have heretofore been £ully complied with and all _ the reports required under the provisions of said act are on file in the office of the City Clerk o£ said city, open to public inspection, - and may there be examined by all interes.ted persons, S ection 5 . The proceedings for the aforesaid work or improve- ment shall be taken under an Act of�the Legislature'of the State of California designated as the Streets and Highways Code,.Division 7, cited as the "Improvement Act of 1911," and amendments thereto. Section 6 , The City Engineer is hereby directed to make a diagram of the property affected or benefited by eaid proposed work or improvement as described herein and to be assessed to pay the costs and expenses of said work, showing each separate lot, piece, or parcel of land and the dimensions of each such lot, piece or parcel of land and the relative location of the same to the work or improvement pro- posed to be done�, all within the limits of said assessrnent district, S ection 7 , Notice is hereby givem that on Tuesday, the 7th ' day of May, 1963,,at the hour of 7:30 aTClock p.m., at the Council Chambers in the City Hall, 11330 Bullis Road, in the City of Lynwood, any and all persons having any objections or protests to said proposed work or improvement, or to the_extent of the district to be assessed, or to the grades to which the work is proposed to be done, may appear before said City Council and show cau�e why said proposed work or improvement should not be carried out in accordance with this resolution, Section 8 , The City Engineer, who is the Superintendent of Streets, is hereby directed to post notices of the passage of this resolution in the time, £orm and manner required by law. Section 9 .
