' ' WHEREAS, under the provisions of Article 2, Chapter 22, Part 3 of Division 7 of the Streets and Hiohways Code of the State o£ California (Improvement Act of 1911) the Superintendent of • , Streets of the City of Lynwood did duly and regularly notify the . respective owners or persons in possession of the respective • properties�described in the report of sa.id'Street Superintendent:. . hereinafter referred to, that the sidewalk or drive approach in front of suc}i respective properties was out of repair and notify- ing such owners or persons in posseasion to repair�the same, all , _ in the manner as co�ztemplated in said law,above referred to; arid , �. WH.EREAS, therea.fter said owners or persons in possession of said respective properties failed to make such repairs within "'' tYie time contemplated 'by ].aw or at all; and ,. WHEREAS, thereafter the said Superintendent of Streets. � did cause the respective r'epairs to be made to the sidewalk in , front of such respective properties arid did,keep a record of the. cost of such repairs, including the incidental expenses thereof, ' and �i.d prepare and File with-the sa.id �City�Council a'report : specif'ying the repairs which had been'so made, the cost of sach ��repairs and a description of eacii parcel of real prope,rty'in front' of which such repairs had beeri made and the assessment against each lot or parcel of land proposed to be levied to pay the cost . tl�ereof; a.nd .' . " WAEREAS, as contemplated by law,•said Superintendent of � . . Streets did cause notice of the.said cost of such repairs to be mailed to the respective owners or persons.in possession of said re'spective properties and did in such notices give further notice' that on the 4th day,•of June, 1963 beginning at_the hour of � 7:'30 o'clock p.m, in the Council ChaMber o£ the City Hall of the .' , ` ' . . City of'Lynwood, California, the Council of the said city would hear and pass upon the:said report of the Superintendent oY Streets of the said cost of such repairs together with any objections or protests which might be raised by any,property owner liable to be assessed for'the cost and expenses of making such repairs and the objections, or protests of any other interested ' persons; and WHEREAS', on'the said 4tli day of June, 1g63; said City : Counril did proceed to hold sa,id hearing and did'duly and regularly conduct the same all a.s contemplated by law; and WHEREAS, such protests as were made in such matt.er were overruled; � � NOW, THEREFORE, THE,CITY COUNCIZ OF THE CITY OF LYNWOOD, CALIFORNIA, DOES HER�Y RESOLVE, DECLARE, FIND, DETERMINE AND • ORDER AS FOLLOWS: ' Section l. That the facts with .rePerence to'said ma.tter as"recited in the prea.mble to this resolution are true. Section 2. That said City Council does hereby confirm the report of said Street Superintendent'wliich' is on file in the office of the City Clerk o_f said City and open to�public inspection a.:�d which is referred•to and incorporated by reference herein. Section 3. That the said Council does hereby assess the' respective costs of said repairs against the respective parcels � of real property fronting upon the sidewalk upon,which such respective repairs were made, all in the respective amounts, for the respective purposes and a�ainst the respective properties as � set forth a,nd indicated in sa,id report of said Superint'endent of Streets on file as aforesaid and does hereby order that unless the said respective amounts so assessed are respectively paid within the time limited by la,w the said respe�tive amounts shall constitute and be and are hereby respectively levied by said Council as respective specia.l assessment against .the said respective , -2 . parcels of rea.l properties for the respective a.mounts all as set forth in said report hereinabove quoted and a.s contemplated under the provisions of said Chapter 22 of Part 3, of Divis�on 7 of said • Streets and.Highways Code, which said respective liens shall respectively continue until the respective assessments and all respective interest amounts thereon are respectively paid or until they are respectively discharged of.record. � Section 4. 7'hat said Council does hereby elect to proceed under i;he a7.te�nat:tve me��hod of collection provided for:urider the� , • provisions of Section'5728 of said La.w (Improvement Act of 1911) ', hereinabove referred to and does he'reby authorize, instruct and ' order that the Notice of Lien shall be delivered to the County • Auditor of Los Angeles County, California, who shall enter the ` - amount thereof on the County Assessment Book opposite the des- cription of the particular property and the amount shall be collected to'gether with all other taxes.thereon aga.inst the property. Said County Auditor, and the Assessor aizd the Tax Collector of said County of Los Angeles who per£orm'tax assessing and tax collection , functions for the City oi Lynwood are hereby authorized, instructed, ,directed and ordered to take a.ny.and�a.11 a.ction necessary or proper on .their respective parts,'all as contemplated uizder the provisions of the laws of the State•of California in such cases made and provided. . Sectiori 5, Said County Assessor, said County Tax Collector and said County Auditor ar.e hereby authorized, instructed, directed and ordered upon receipt of such notices of lien to receive the same a�d thereafter proceed to add the respective �nounts of the respective assessments indicated in sa.id respective notices of 'lien a.s hereinabove set forth'•in said�above report.of sa,id Street Superinteiident, to the next regular bill f.or taxes levied against �the respective lots or parcels' of� l�and therein des'cribed or : referred to a.nd to enter the respective amount thereof�on the . . .
