HomeMy Public PortalAboutTBM 2019-01-23 FRASER BOARD OF TRUSTEES MINUTES DATE: January 23, 2019 MEETING: Board of Trustees Regular Meeting PLACE: Fraser Town Hall Board Room PRESENT Board: Mayor Philip Vandernail; Mayor Pro-Tem Eileen Waldow; Trustees; Andy Miller, Katie Soles, Parnell Quinn and Herb Meyring, Ryan Barwick Staff: Town Manager Jeff Durbin; Town Clerk, Antoinette McVeigh; Town Planner, Catherine Trotter; Public Works Director, Russell Pennington; Police Chief, Glen Trainor, Town Attorney Rod McGowan Others: See attached list Mayor Vandernail called the meeting to order at 6:00 p.m. 1. Rollcall: 2. Approval of Agenda: Trustee Soles moved, and Trustee Waldow seconded the motion to approve the agenda Motion carried: 7-0. 3. Executive Session: For a conference with the City Attorney for the purpose of receiving legal advice on specific legal questions under C.R.S. Section 24-6-402(4)(b) For the purpose of determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, and/or instructing negotiators, under C.R.S. Section 24-6- 402(4)(e) regarding litigation. Trustee Miller moved, and Trustee Soles seconded the motion to open the Executive Session at 6:03 p.m. Motion carried: 7-0 Trustee Miller moved, and Trustee Barwick seconded the motion to close the Executive Session at 6:26 p.m. Motion carried: 7-0 4. Executive Session: For a conference with the City Attorney for the purpose of receiving legal advice on specific legal questions under C.R.S. Section 24-6-402(4)(b) For the purpose of determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, and/or instructing negotiators, under C.R.S. Section 24-6- 402(4)(e) regarding franchise agreements. Page 2 of 3 Trustee Waldow moved, and Trustee Barwick seconded the motion to open the Executive Session at 6:27 p.m. Motion carried: 7-0 Mayor Vandernail was excused at 6:45 p.m. Trustee Soles moved, and Trustee Miller seconded the motion to close the Executive Session at 6:56 p.m. Motion carried: 6-0 5. Consent Agenda: a) Minutes January 9, 2019 b) Resolution 2019-01-03 Reduction in Surety Pursuant to Subdivision Improvement Agreement Elk Creek at Grand Park Filing 3 c) Resolution 2019-01-04 Reduction in Surety Pursuant to Subdivision Improvement Agreement for Elk Creek at Grand Park Filing 4 Trustee Miller moved, and Trustee Barwick seconded the motion to approve the consent agenda. Motion carried: 6-0. 6. Public Hearing and Possible Action a) Right of Way Vacation, Old King Road and Forest Rail Road Trustee Soles moved, and Trustee Quinn seconded the motion to reopen the Public Hearing regarding Right of Way Vacation, Old King Road and Forest Rail Road. Motion carried: 6-0 TA McGowan presented to the Board. The Public Hearing is continued from November 28, 2018. McGowan presented a revised Ordinance 365 that vacates Old King Road but not Forest Rail Road; this was not provided in the packet. The Winter Park Town Manager Riesberg has submitted a letter that states the town does not formally object to the proposed petition to vacate Old King Road and Forest Rail Road. Clark Lipscomb from Grand Park presented to the Board. He asked the Board to approve Right of Way Vacation for Old King Road and continue the public hearing regarding Forest Rail Road. Trustee Soles moved, and Trustee Miller seconded the motion to approve the revised Ordinance 365 Regarding Right of Way Vacation for Old King Road not vacating Forest Rail Road and continue the Public Hearing regarding Forest Rail Road to March 20, 2019. Motion carried: 6-0 TA McGowan was excused from the meeting at 7:25 p.m. 7. Discussion and Possible Action Regarding a) Town Board Governance Policies Review The TB discussed dates for the 2019 bimonthly meetings. The TB would like to get a biannual update from the five areas and committees- Economic Development Advisory Committee, Public Arts Committee, Water Wastewater Committee, Planning Commission and Housing/Property. The TB would like to include the minutes from these Page 3 of 3 committees in the TB packets. The first meeting of each month will include a workshop on the governance policies and board responsibilities which will be adjusted as need be. 8. Open Forum a) Business not on the agenda 9. Board Updates- a) Miller- TPR discussed goals and plans for highway connections b) Barkwick- 170 West construction will commence this summer c) Quinn- How can the Town of Fraser help the people effected by the government shut down? The staff will research and talk with the local food bank, Mountain Family Center, Grand Foundation and other entities to find ways to help. 10.
