Rosene, Grand County Clerk, Colorado TOWN OF FRASER Series 2019 Ordinance No. 465 AN ORDINANCE TO VACATE A PORTIONS OF THE STREET KNOWN AS OLD KING ROAD IN THE TOWN OF FRASER. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER IN THE STATE OF COLORADO, THAT: SECTION 1. The Board of Trustees of the Town of Fraser does hereby find and resolve that there is no continuing public need for that portion of a certain street hereinafter described, except for easements reserved as hereafter set forth; and that the same should be vacated pursuant to the statutory authority of Section 31-15-702(1)(a)(I) and Section 43-2-303(1)(a), C.R.S., as amended, and Section 19-3-245 of the Fraser Municipal Code. The Board of Trustees also finds that such vacation will leave no parcel without public access as defined in Section 43-2-303(2), C.R.S., as amended. SECTION 2. The following portion of Old King Road located in the Town of Fraser, Colorado, to wit: A portion of that 60-foot wide County Roadway in the Town of Fraser known as Old King Road surveyed by Frank Huntington on June 10, 1929, adopted by the Board of County Commissioners in File No. 0080 on July 1, 1929, recorded July 3, 1929 of the records of Grand County, Colorado, said 60-foot wide County Roadway located in the SE1/4 of Section 29, Township 1 South, Range 75 West of the 6th Principal Meridian, Town of Fraser, County of Grand, State of Colorado, which is more particularly described on Exhibit A attached hereto and incorporated herein by this reference, is hereby vacated; provided, however, this Ordinance does not vacate Forest Rail Road, as described and shown on Exhibit B attached hereto, at this time, SECTION 3. This Ordinance shall be effective thirty (30) days after publication thereof as provided by law.
