Home My Public Portal About2010.202 (10-05-10) RESOLUTION NO. 2010.202 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE ADDITION, INCREASE, OR REDUCTION OF DEVELOPMENT PROCESSING FEES AND OTHER CITY RATES, CHARGES AND FEES FOR VARIOUS GOVERNMENTAL SERVICES WHEREAS, pursuant to the California Constitution Article XI §7, a city has the authority to impose fees, charges and rates under its police power; and WHEREAS, the City engaged the services of MAXIMUS Consulting Services to � validate the Cost of Services study conducted in 2006 in the Building and Safety Division, Planning Division and Public Works Engineering Division; recommend adjustments; calculate the cost differentials since 2006; calculate new fee prices; extend new fee prices and estimate the budgetary impact of getting prices at levels that reflect the updated costs, and WHEREAS, the City has a policy to provide for charges that reflect the cost of services provided by the City and provide equity in distributing the cost burden for City services on the beneficiary and tax payer pursuant to Resolution 2006.112; and WHEREAS, California Government Code Section 66016 requires that prior to approving certain new or increased fees a city must hold at least one public hearing; publish notice of the hearing twice at least 10 days prior to the hearing, send notice of the meeting at least 14 days in advance to any interested party, and make available to the public at least 10 days before the meeting data indicating the amount of estimate cost required to provide service for which the fee or charge is levied; and WHEREAS, staff published a notice twice on the Lynwood Press on September 96 and September 23; verified with the City Clerk's Office that there were no interested parties on file that should receive the notice; and made Exhibit A available for public review at the City Clerk's Office on September 23 to comply with California Government Code Section 66016; and WHEREAS, a public hearing was held on October 5, 2010 at a regular City Council Meeting to hear oral and written comments. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The City Council approves the addition, increase or reduction of development processing fees and other City rates, charges and fees for various governmental services as listed under the attached "EXHIBIT A". Section 2. Any action adopting or increasing a fee or charge for deveiopment projects may not take effect for at least 60 days upon adoption.
