HomeMy Public PortalAbout2001-016 Resolution Granting Preliminary Approval of a Plat for Cyril Ducharme and Marian DucharmeMember Phil Zietlow introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.01-16 RESOLUTION GRANTING PRELIMINARY APPROVAL OF A PLAT FOR CYRIL DUCHARME AND MARIAN DUCHARME WHEREAS, Cyril Ducharme and Marian Ducharme (the "Applicants") are the owners of property located at 2182 Pinto drive (the "Property"); and WHEREAS, the Applicants wish to subdivide the Property into two lots; and WHEREAS, the planning commission reviewed the proposed plat on March 13, 2001; and WHEREAS, the city council considered the proposed plat on March 20, 2001. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that preliminary approval be granted to the Applicants' plat of the Property, subject to the following terms and conditions: 1. The final plat must provide for dedication to the city for roadway purposes 30 feet on the west and north sides of the Property with a 275 foot radius at the northwest corner; 2. The final plat must provide for standard drainage and utility easements around the perimeter of the lots and over the wetlands; 3. The Applicants must submit title evidence acceptable to the city attorney prior to approval of the final plat; 4. The Applicants must comply with the city's park dedication requirements; 5. The final plat must be in conformance with state law, city ordinances and the preliminary plat, except as required by this resolution; 6. The Applicants must pay the city an administrative fee in the amount necessary to reimburse the city for the cost of reviewing this application; and 7. The final plat must be submitted to the zoning administrator within 180 days of the date of approval of this resolution or the approval hereby granted shall be null and void. RHB-195391v1 01-16 ME230-313 April 3, 2001 NOW, THEREFORE, be it further resolved by the city council of the city of Medina that variances be granted to reduce the size of Lot 1 from 5.0 acres to 4.37 acres and the size of Lot 2 from 5.0 acres to 4.66 acres. The variances are justified by the hardship that the reduction in size of the lots is directly attributable to the right-of-way dedication required by the city. Dated: April 3, 2001.
