HomeMy Public PortalAbout03-04-10 agenda March 4, 2010 The Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding the Regular Meeting of March 18th, 2010 was held on March 4,2010,6:00 P.M., Council Chambers, Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. The following were noted present: Mayor Daniel J. Reiman Councilmember Vincent Bellino " Jorge Diaz " Dennis DiMascio " Randy Kmm " Susan Naples " Joseph Sitarz Also noted present was Municipal Clerk, Kathleen M. Barney and Borough Attorney Robert J. Bergen, Esq. The Clerk stated that the 2010 Annual Notice was mailed to The Home News Tribune, The Star Ledger and posted on the bulletin board on January 4, 2010 and published in The Home News Tribune on January 6,2010 and The Star Ledger on January 8, 2010. The Meeting was opened with a minute of Silent Prayer and the Pledge of Allegiance led by Mayor Daniel J. Reiman. Upon MMS&C by Councilmembers Jorge Diaz and Susan Naples and unanimous affirmative vote of the full Council present, the Minutes of I Agenda Meeting Noted 'Present Also Noted Present Statement of Meeting Notice Silent Prayer & Pledge of Allegiance Minutes for Approval March 4, 2010 "Special Presentations" ORDINANCE #10-2 "AN ORDINANCE TO AMEND ORDINANCE #84-6 OPENED CLOSED ORDINANCE #10-2 Continued Febmary 18, 2010 were approved and transcribed and engrossed by the Clerk. The Mayor made mention of the two (2) Proclamations and said he would like to hold them for a Special Presentation at the end of the meeting. The Clerk stated that Ordinance #10-2 was introduced and adopted on first Reading at an Agenda Meeting of the Borough Council of the Borough of Carteret held on Febmary 4, 20 I O. It was duly published in The Home News Tribune on Febmary 19,2010 with notice that it will be considered for final passage after Public Hearing to be held on March 4,2010 at approximately 6:00 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Upon MMS&C, by Councilmembers Sitarz and Naples and unanimous affirmative vote of the full Council present, the Mayor declared the Public Hearing to be opened. There were no comments from the public. There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Diaz and Sitarz and unanimous affirmative vote of the full Council present. Upon MMS&C by Councilmembers Sitarz and Naples ORDINANCE #10-2 "AN ORDINANCE TO AMEND ORDINANCE #84-6" March 4, 2010 was finally adopted. Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, K1um, Naples and Sitarz voted in the affirmative. Resolution #10-68 through #10-74 were introduced by the Mayor and refen'ed to the Council for action. Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, Krum, Naples and Sitarz voted in the affirmative. Please note that #1 under Resolutions was omitted from the Consent Agenda. Urban Councilman DiMascio reported that the Borough had another snowst01m last week and Streets and Roads did a tenific job. They should get a lot of credit, the men who do all that plowing. We have two men who work inside that fixed all the plows and fixed the flat tires. It must be done immediately. John Hadinyak and Pat De Bella did a tremendous job, they are overlooked but everything went well. Councilmember Naples said no particular business, just a point of information. They are doing a through cleaning and mini facelift in the Sports & Recreation Center. So if any of her colleagues on the Council have any spare manpower in the next few weeks she would appreciate their help. She then thanked them. Mayor Reiman said the Energy Audits came in with the grants from the BPU. The Auditor has a few recommendations relative to the changing of more energy efficient light bulbs. Council President K1um said he would have his reports ready for the next meeting. Councilmembers Bellino, Diaz, Kmm and Sitarz had no business at this time. Upon MMS&C, by Councilmembers Diaz and Sitarz and unanimous affirmative vote of the full membership present, the meeting was opened to the Public. Kevin Urban said he recently attended a Zoning Board Meeting. He asked what the criteria was for being a Zoning Board Member. Mayor Reiman replied as you know, you have served on entities in the past, one must be for the Zoning Board, at resident of the Community, must be a voter and at least eighteen (18) years of age. You must also be a citizen. March 4, 2010 Mayor Reiman said the Borough Attorney wants to advise the Council that the item in question is an item that was approved by the Zoning Board for a use variance in constlUction of a triplex on a site that was f01merly a commercial/industrial type use. There may be a pending litigation so the Council and I may reserve comment on it. You are free to say anything you like. Mr. Urban said wh<it he was getting at; this is in Cluome (inaudible). The Board Members don't know how to read a blue print. Some of them were falling asleep. The Mayor wanted to know who fell asleep and who could not read a blue print. Mr. Urban replied that he did not want to go there. They were reading the blue prints upside down and the point he was trying to make is that the Council should look into appointments to better represent (inaudible). The Mayor asked if they should only appoint architects, attorneys and engineers. Mr. Urban replied that when the Attorney said that the applicant make enough money to put another duplex and it has to be a triplex. The Mayor replied to Mr. Urban, as you know, the applicant can claim a hardship and ask the Board for consideration based upon that. He said he did not necessarily agree with the change in use, he thinks two (2) units would have been sufficient however, as you know from living across the street, that was an old warehouse that was industrial type use. No matter what went into that property you and others, rightfully so, would have raised concerns. If they opened again as a commercial or industrial door and glass manufacturing company with SS foot trailers and trucks coming down the street, you would have been the first one to come down and complain about it and rightfully so. Did you offer any suggestions or alternatives to the board? Mr. Urban replied that he did. 7 Discussion MARCH 4, 2010 Discussion Closed to Public Proclamations The Mayor asked what the suggestions were. Mr. Urban replied a small Taxi Service. The Mayor said when Mr. Urban's family owned that property what was it used for? Commercial use and there were no problems there. There was never any parking in that area. Mr. Urban reply was inaudible. The Mayor said cel1ainly there are considerations that the Board made and should not have made but the Council has no control over the Zoning Board. They are an independent authority and we cannot tell them what to approve 01' what not to approve. They are set up by statute. They are appointed and they are required to attend training and classes required by the Depm1ment of Community Affairs. They have heard the testimony pro and con from the Engineer, Architect and Attorney, the experts and the residents have made a detelmination upon the fact that they heard. This Council and I do not have those facts, those blueprints. You of course, as a resident within that district have a right to appeal as well, if you so desire. Mr. Urban said the town Engineer was not present, and other residents questioned his absence. The Mayor thanked MI'. Urban and asked if there were any fm1her questions relative to this matter or any other matter of concern. Upon MMS&C, by Councilmembers Sitarz and Bellino and unanimous affirmative vote of the full members present, the meeting was Closed to the Public. The Mayor said they had two (2) Proclamations. One is "Disability Awareness Day" and the other is "Girl Scout Week." He then read the Proclamations into the record. MARCH 4, 2010 PROCLAMATION WHEREAS, the Carteret Office of the Disabled will hold its Twenty- Sixth Annual "Carteret Disabilities Day" on Sunday, March 14, 2010 at the St. Demetrius Hall, Roosevelt Avenue, Carteret, New Jersey from 12:00 Noon to 4:00 P.M.; and WHEREAS, Carteret Disabilities Awareness Day is held as an information and social gathering to be enjoyed by all who choose to attend; and WHEREAS, the event id only made possible tln'ough the combined eff011s of many volunteers from non-profit organizations and Borough Departments and businesses within our community; and WHEREAS, the Office of the Disabled continues to expand opportunities for Disabled Persons to achieve their goals, developing and using their capabilities. NOW, THEREFORE, I, DANIEL J. REIMAN, MAYOR OF THE BOROUGH OF CARTERET, in the County of Middlesex, State of New Jersey do hereby proclaim: SUNDAY, MARCH 4, 2010 As CARTERET DISABILITIES AWARENESS DAY "CARING & SHARING" FURTHERMORE, I urge the entire community to participate in said program making it a great success. PROCLAMATION Carteret Disabilities Awareness Day 9 MARCH 4, 2010 The Mayor asked if there were any Girl Scouts at the Meeting. The Girl Scouts all replied "YES". PROCLAMATION PROCLAMATION Girls Scout Week "Girl Scout Week" WHEREAS, March 12, 2010, mm'ks the 98th anniversary of Gil'l Scouts of the USA, founded by Juliette Gordon Low in 1912 in Savannah, Georgia; and WHEREAS, tln'oughout its distinguished history, Girl Scouting has inspired more than SO million girls and women for the highest ideals of courage, confidence and character to make the world a better place; and WHEREAS, tln'ough the Girl Scout Leadership Experience, girls develop the skills and lessons that will serve them throughout their lives so they may contribute to their communities; and WHEREAS, Girl Scouting takes an active role in increasing girls' awareness of the opportunities in math, science, sports, technology and many field of interest that can expand their horizons: and WHEREAS, more than three million cunent Girl Scout members nationwide, including in excess of $100.000 in the State of New Jersey, will be celebrating in the great American tradition. NOW, THEREFORE, I DANIEL J. REIMAN, by virtue of the authority vested in me as Mayor of the Borough of Carteret do hereby applaud the commitment Girl Scouting has made to supp011 the leadership development of American's girls and proudly proclaim: March 7 - 13,2010 As Girl Scout Week MARCH 4, 2010 in the Borough of Carteret and call upon all Citizens ofthe Borough of Cm1eret to recognize and supPol1 the contributions made by Girl Scouts and adult volunteers toward improving the quality oflife in our Community.
