HomeMy Public PortalAbout1986-06-24 MeetingAttest: Village Clerk May 27, 1986 COUNCIL MINUTES June 24, 1986 The Council of Bal Harbour Village met Tuesday, June 24, 1986 at 9:30 A.M. in the Village Hall. Present: Mrs. Antiles, Messrs. Laikin, McKeehan, Sherman and Taplin. Also present: Louise Miller, Village Manager; Mary Wetterer, Village Clerk and Stanley Price, representing Richard Weiss, Village Attorney. On motion of Mrs. Antiles, seconded by Mr. Taplin and voted the minutes of May 27, 1986 were approved as submitted. Mayor Sherman said that our zoning code needs clarification on busi- ness establishments in the multi -family high rise buildings. The proposed ordinance was recommended by bcth Alan Gold and Richard Weiss and has been presented to all high rises. The Village Clerk read the proposed ordinance by title. The council discussed the ordinance and suggested that the list of permitted businesses be enlarged to include health clubs, boutiques, sundry shops and dress shops. An art show could be considered on an in- dividual basis. It was moved by Mr. Taplin, seconded by Mrs. Antiles and unanimously voted to amend the proposed ordinance to include the above uses. It was moved by Mr. Taplin, seconded by Mrs. Antiles and unanimously voted to adopt the proposed ordinance, as amended, on first reading., s:2tting forth the types of commercial activity that would be permitted in high rise apartments. George Desharnais, Building Official, explained the proposed ordinance which would provide for increased building permit fees. He said our use of the Dade County fees were not suitable for our situation as like other small towns we must hire outside imspeotor8 on a percentage of the permit fee basis. He said the matter has been worked on for six months and a more equitable way would be to use a Means Method geared to the cost of the building. Mr. Desharnais explained the Means Method is which the county is divided into zones and the fee is a percentage of the square foot construction cost. He proposes a 1% factor. Mr. Desharnais said a fee would also be charged for reviewing plans prior to issuing a permit. Ms. Wetterer read the proposed ordinance by title. On motion of Mr. McKeehan, seconded by Mrs. Antiles, June 24, 1986 and unanimously voted the ordinance was adopted on first reading. Chief Baquero explained the reason for the proposed ordinance changing our system of issuing our own parking tickets for $3.00 with about a 30% return to one of using the County tickets charging $10.00 and a 80 - 90% return. Two-thirds of the fine will be returned to the village. Mrs. Miller said that this is an opportunity to bring fines into line and generate more revenue for the village. On motion of Mr. McKeehan, seconded by Mrs. Antiles and unanimously voted the ordinance was adopted on first reading. Mayor Sherman explained that under our Charter provision the Village Manager is limited to purchases up to $500. As this is an unrealistic fig- ure the amount should be raised to $2,500.00. On motion of Mr. Taplin, seconded by Mr. McKeehan and unanimously voted Resolution No. 308 was adopted instructing the Village Attorney to draft a Charter amendment to provide for the increased amount. Mrs. Miller said one of the property owners informed her that his two lots were being put together and that his security assessment should be for only one parcel. She asked that the council cancel the $154.00 assessment for Lot 17 Block 11, Res. Sec. in the name of C. W. Whitmoyer, Sr. and w. Carole. On motion of Mr. Taplin, seconded by Mrs. Antiles and unanimously voted the assessment for the security assessment was cancelled. Mayor Sherman said he had spoken to the manager of the Sea View Hotel and Mr. Cliff was of the opinion that the recent fire would not have spread if the alarm system to be installed by September would have been in place. Mrs. Miller stated that our Collins Avenue patrol officer, Erwin Meyers, spotted the smoke and reported the fire. Mr. Sherman said that Dade County has informed the cities that the fee for dumping at the Resource Recovery Plant will be raised from $24.00 to $30.00, with a $40.00 fee per ton for the transfer station. He said he had toured the plant with sixteen other municipal officials and Deputy Clerk Morris and found the plant being operated in an inefficient manner with many breakdowns. The plant is also selling the generated electricity to Florida Power and Light Co. for 1.6C/kilowatt hours, FPL sells to us at 6.00/kwh. Mr. Price explained the original Parson & Whittemore contract, the plant builders and original operators. Parson and Whittemore tried to get out of the contract due to the terms being slanted toward Dade County. The County took over the plant and hired Montenay Company to operate the run down facility. The county then passed a bond issue to cover the cost of closing their land fills, and renovating the plant and are raising the rates to pay off the bonds. Mr. Sherman said that to pay the new proposed rates the millage would have to be raised 1.5 mills. The Dade League of Cities has appointed a committee to study the plant operation and make recommendations as to operating costs, the bond issue, designating it as public utility, selling its output to the airport and other county facilities and turning the plant over to private ownership. Mr. Sherman also mentioned that the county is closing dumps near the plant, which land has tremendous value, approximately 250 acres at $75,000 an acre. It was moved by Mr. Taplin, seconded by Mr. McKeehan, and unanimously voted that Bal Harbour support the League of Cities' efforts in this matter. June 24, 1986 ing was adjourned at 10:55 A.M. Mayo Attest: Mrs. Miller said that our alarm system at the sewer station is not adequate. Three bids have been received, each company submitting proposals for a some- what different system. The bids were received and her recommendation is the bid submitted by Lauderdale Services. This company is familar with our system and will use an automatic dialing system, give powerline surge protection, and have a battery backup. Also recommended was a maintenance contract The entire bid for the package is $8,900. On motion of Mrs. Antiles, seconded by Mr. Taplin and unanimously voted the purchase of the sewer system alarm system from Lauderdale Services, Inc. was authorized. Mrs. Miller said that wreaths placed on the light poles at holiday time are in need of repair. Two companies came to survey the situation and bid on refurbishing and adding four new ones. Also it would be to the village's advantage to have the decorating company install and remove them. Recommended is the bid from Carpenter Decorating of Florida for a total cost of $15,513.52. On motion of Mr. Taplin, seconded by Mr. McKeehan and unanimously voted Carpenter Decorating was given the contract to refurbish the old decorations, furnish four new ones and install and remove the decorations. The Village Manager said that Ludovici and Orange are working on the document to complete the application to the State of Florida for the jogging path on the beach. Mr. von Oesen is preparing the specifications for the bids. Wells Fargo promotes health programs and works with hos- pitals for fitness plans. We are trying to obtain a grant for the jogging path from them. The State of Florida indicated they will approve the path. It should be in place in five or six months. Mrs. Miller said that we have had a private contractor cleaning up the beach at a cost of approximately $16,000.00 a year. She has contacted Dade County and they will do the same work, at least twice a week, at no cost to the Village. The seaweed will be ground up and removed. Also signs are being placed on the beach regarding no swimming at the jetty, no fires, loitering, etc. Mrs. Miller reported that the St. Francis Hospital Health van will return to the Village Hall on July 31, 1986 from 10:00 A.M. to 1:00 P.M. testing for skin cancer, blood pressure, pulse readings, and height and weight measurements. Mrs. Miller reported that benches had been placed at the yacht basin for the residents use; Mayor Sherman had been installed as President of The Dade League of Cities on June 21st; and good comments had been re- ceived on the new entrance signs. This will be looked into. Mr. Taplin suggested that it would be nice to have lights in the trees in the Collins Avenue median at holiday time.
