HomeMy Public PortalAbout16-9198 Accept yhe Bids from BOFAM Construction, Inc Sponsored By: City Manager RESOLUTION NO. 16-9198 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECCESSARY AND APPROPRIATE ACCEPT THE BIDS FROM BOFAM CONSTRUCTION, INC, FOR CITY OWNED PROPERTY IDENTIFIED BY FOLIO: 08- 2122-003-1690, LOCATED AT 1801 ALI BABA AVENUE FOR A BID OF $7,350.00; TO EXECUTE ALL DOCUMENTS NECCESSARY AND APPROPRIATE TO EFFECTUATE THE SALE OF THE PROPERTY IDENTIFIED HEREIN; AND TO AUTHORIZE THE CITY ATTORNEY TO PREPARE THE NECESSARY TITLE AND SELLER DOCUMENTS IN FURTHERANCE OF THE SALE; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City of Opa-locka City Commission authorized the issuance of an Request For Proposal No.: 16-2405200 for the sale of surplus City owned property; and WHEREAS, The City required a minimum bid and proposal for how the property would be developed; and WHEREAS, BoFam Construction, Inc.,has agreed to develop as per the zoning permitted use; and WHEREAS,The City Manager recommends the acceptance of the bids; and WHEREAS, The City Manager needs the authority to execute all necessary closing documents and in order to effectuate the sale and transfer of the surplus property set forth in resolutions herein; and WHEREAS, The seller's, settlement and title documents must be prepared and clear title to property must be conveyed, and an attorney is needed to perform such services. Resolution No. 16-9198 NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference; Section 2. The City Commission hereby authorizes the City Manager to accept the bids from BoFam Construction, Inc., of $7,350.00, for the City- Owned parcel identified by folio 08-2122-003-1690, located in the at 1801 Ali baba Avenue; Section 3. The City Manager is hereby authorized to execute all necessary closing documents in order to effectuate the sale and transfer of the surplus property set forth herein; and City Attorney is hereby authorized to prepare the title and seller's documents. Section 4. The proposed use for these parcels must have a development agreement between the City and the Developer/Purchaser; the development agreement must contain a timeline for permitting through certificate of occupancy; the developer/purchaser will forfeit any deposits and/ or related expenditures should the project not be built or developed as agreed; and the development agreement must contain a reverter clause requiring the property to revert to the City's ownership should the properties not be developed as agreed. Section 5. This Resolution shall take effect immediately upon adoption. Staff Summary The City of Opa-locka issued a Request for Proposal No. 16-2405200 for the Sale of City Owned Surplus Property. The City provided a list of properties that were available. The City required a minimum bid amount and required that the bidder provide a proposal of how the land would be developed and an indication of the time frame for development. BoFam Construction, Inc., has submitted a bid of$7,350.00 for this property identified by folio: 08-2122-007-1690, and has agreed to develop this vacant parcel according to the permitted uses of their specific zoning districts within 2 years. Interested parties are able to review all available property records, by appointment. 1.22 RULES, REGULATIONS AND LICENSING REQUIREMENTS: The Bidder shall comply with all laws, ordinances and regulations applicable, especially those applicable to conflict of interest and collusion.
