HomeMy Public PortalAbout2001-026 Resolution Granting Concept Plan Approval for PUD for Charles Cudd Co.Member Carolyn Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.01-26 RESOLUTION GRANTING CONCEPT PLAN APPROVAL FOR PUD FOR CHARLES CUDD CO. WHEREAS, Charles Cudd Co. (the "Applicant") has applied for concept plan approval for its residential PUD (the "PUD") under the PUD ordinance codified at sections 827.25 through 827.43 in the Medina code of ordinances; and WHEREAS, the PUD was reviewed by the planning commission at its meeting on May 8, 2001; and WHEREAS, the planning commission recommended approval of the concept plan for the Applicant's PUD, subject to ten noted concerns; and WHEREAS, this matter was considered by the city council at its meeting on May 15, 2001. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that concept plan approval be granted to the Applicant for its PUD, subject to the following terms and conditions: 1. Concept plan approval is granted subject to the following ten concerns: a. Maintenance of wetland areas/ponds; b. Drainage issues; c. Plan for land in Plymouth; d. Buffer to the multiple family area to the south; e. Hammerhead street end; f. Easements to the south; g. Connections to the Dorweiler property; h. Potential pedestrian traffic — public or private — sidewalks or roads; i. Potential redesign of County Road 101; and j. Crossing County Road 101 to the trail on the west side of County Road 101; 2. The Applicant is authorized to proceed to the general development plan stage, subject to the revisions to the concept plan outlined above. The general plan must be submitted RHB-197791 v 1 ME230-315 1 01-26 May 15, 2001 within 180 days of the date of approval of the concept plan; 3. The Applicant must pay to the city an administrative fee sufficient to reimburse the city for the cost of reviewing this application; and 4. Nothing herein shall be deemed to relieve the Applicant from the need to comply with all other land use regulations of the city, including, if applicable, the city's subdivision regulations.
