HomeMy Public PortalAbout2001-031A Resolution Ordering Improvement by Day Labor and Adopting Assessment RollMember Bruce Workman introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.01-31a RESOLUTION ORDERING IMPROVEMENT BY DAY LABOR AND ADOPTING ASSESSMENT ROLL WHEREAS, on May 15, 2001, the city council adopted a feasibility report for the improvement of Brockton Lane from Hamel Road to Medina Road and called for an improvement hearing and assessment hearing on the project for June 5, 2001; and WHEREAS, pursuant to notice as required by law, the city council on this date has held the improvement hearing and the assessment hearing on the project, at which hearings all persons wishing to express an opinion were given an opportunity to do so; and WHEREAS, the improvement consists of the grading and surfacing of a public street, which improvement project may be constructed by day labor. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, as follows: 1. The Medina public works director shall proceed under the direction of the council as given from time to time to carry out all work in connection with the improvement in accordance with the plans and specifications herein approved, subject to the condition that no work be done on the project until 30 days from the date of this resolution. 2. The proposed assessment of this project, a copy of which is attached hereto as Exhibit A and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein. Each tract of land therein included in is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 3. Such assessment shall be payable in equal annual installments extending over a period of five years. The first installment to be payable on or before the first Monday in January 2002 and shall bear interest at the rate of 7.5% per annum from the date of the adoption of this assessment resolution. The first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2001. To each subsequent installment when due shall be added interest for one year on all unpaid installments. RHB-199450v1 ME230-319 1 01-31a June 5, 2001 4. The owner of any property so assessed may any time prior to certification of the assessment to the county auditor pay the whole of the assessment of such property with interest accrued to the date of the payment to the Medina administrator -clerk -treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days of the date of the adoption of this resolution. Any such owner may, at any time thereafter, pay to the administrator -clerk - treasurer the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. Such payment shall be made before November 15 or interest will be charged through December 31 of the succeeding year. 5. The administrator -clerk -treasurer shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the proper tax list of the county and such assessment shall be collected and paid over in the same manner as other municipal taxes.
