HomeMy Public PortalAbout2001-032 Resolution Granting Variance for Robert Raskob at 2295 Holy Name DriveMember Phil Zietlow introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.01-32 RESOLUTION GRANTING VARIANCE FOR ROBERT RASKOB AT 2295 HOLY NAME DRIVE WHEREAS, Robert Raskob (the "Applicant") is the fee owner of property located at 2295 Holy Name Drive (the "Property"); and WHEREAS, the Property contains 9.2 acres; and WHEREAS, the Applicant proposes to divide the Property into two lots, one of which would contain 4.2 acres with only 3.6 acres of soils suitable for an individual on -site sewage disposal system; and WHEREAS, the city's zoning ordinance requires that each lot in the rural residential area contain a minimum of 5 acres of soils acceptable for individual on -site sewage disposal systems; and WHEREAS, this matter was reviewed by the planning commission at its meeting on May 8, 2001 and by the city council at its meetings on May 15, 2001 and June 5, 2001. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a variance be granted to the Applicant to reduce the minimum lot size from 5.0 acres to 4.2 with 3.6 acres of soils suitable for an individual on -site sewage disposal system, subject to the following terms and conditions: 1. The Property must be subdivided in accordance with the plan submitted to and approved by the city council; 2. The Applicant must pay to the city an administrative fee in an amount equal to reimburse the city for the cost of reviewing this application; and 3. The variance must be utilized by subdivision of the Property within one year of the date of this resolution, after which the approval hereby granted shall be null and void. RHB-199444v 1 ME230-8 1 01-32 June 5, 2001 NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of Medina, Minnesota, that the variance hereby granted is justified by the hardship that two special assessment units were previously levied against the Property and that approximately one acre of land was taken from the Property for the development of Lakeview Road in the past.
