HomeMy Public PortalAbout2001-033 Resolution Granting Final Approval of Ducharme AdditionMember Carolyn Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.01-33 RESOLUTION GRANTING FINAL APPROVAL OF DUCHARME ADDITION WHEREAS, Cyril Ducharme and Marian Ducharme (the "Applicants") are the owners of property located at 2182 Pinto drive (the "Property"); and WHEREAS, the Applicants wish to subdivide the Property into two lots; and WHEREAS, the city council granted preliminary approval to the proposed plat on April 4, 2001; and WHEREAS, the Applicants have requested final approval of the plat, which plat has been reviewed by the city staff for compliance with city ordinances and the terms of preliminary plat approval. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that final approval be granted to the plat of Ducharme Addition, subject to the following terms and conditions: 1. The Applicants must comply with the city's park dedication requirements; 2. The Applicants must pay the city an administrative fee in the amount necessary to reimburse the city for the cost of reviewing this application; 3. The final plat must be filed with Hennepin County within 60 days of the date of approval of this resolution or the approval hereby granted shall be null and void; and 4. The mayor and administrator -clerk -treasurer are not authorized to execute the plat of Ducharme Addition until notified by the city attorney that the terms and conditions of the city attorney's June 19, 2001 supplemental plat opinion have been met. NOW, THEREFORE, be it further resolved by the city council of the city of Medina that variances be granted to reduce the size of Lot 1 from 5.0 acres to 4.34 acres and the size of Lot 2 RHB-199194v 1 ME230-310 1 01-.33 June 19, 2001 from 5.0 acres to 4.69 acres. The variances are justified by the hardship that the reduction in size of the lots is directly attributable to the right-of-way dedication required by the city. Dated: June 19, 2001. John>.
