HomeMy Public PortalAbout62-033 (05-15-62) RESOLUTION N0. 62-33 RESOLUTION OF INTENTION IN THE MATTER OF THE IMPROVEMENT OF THORSON AVENUE (EAST SIDE) HE- TWEEN THE NORTH LINE OF CARLIN AVENUE AND 600 FEET NORTH BY THE CONSTRUCTION OF CONCRETE CURBS AND GUTTERS TOGETHER WITH ALL INCIDENTIAL AND APPURTENANT WORK, WHEREAS, pursuant to the provisiona of Division 4 of the Streets and Highways Code, cited as the "Special Assessment Investi- gation Limitation and Majorit�a Protest Act of 19j1," the Cit�r Council of the Citv of Lynwood has determined that the east side of Thorson Avenue between the north line of Carlin Avenue and 600 feet north, as proposed in Resolution No. 62-20 of said cit�T is feasible, and that. the public interest., r•onvenience, and necessity require the 3mprove- ment eubstantia11,7 as set forth in said report, and WHEREAS, said Cit�T Council has found that the lands to be assessed will be alile to stand �he burden of the proposed assesament, DIOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lvnwood as follows: Section 1. That in the opinion of the Cit�,r Council of the Cit�a of Lynwood the public interest and convenience require and it is the intention of said Cit� Council to order the following work or improvement to be done, to wit: The construction of cement concrete curb and rement concrete gutter, including all incidental and appurtenant work on the east side of Thorson Avenue l,�ing between the center line of Carlin Avenue and the northerlv cit�r boundary as said boundary existed Ma;r 15, 1962, being a portion of the J. J. Bullis Tract, Lot 2, as recorded in Miscellaneous Records, Book 3, pages 612 - 612, Record� of Los Angeles Count;r. All of said work or improvement shall be performed in the public waJs and between the limits hereinbefore designated excepf. where the plans indicate that said worl� shall be omitted. That all oi the work or improvement aforesaid shall be done and performed in accordance with and to the �rades shown on Plans and -1- �pecifications No. 1962-B-3 on file in the office of the City Clerk o£ said city. Said plans are hereb,y re£erred to for a full and com- plete description of said proposed work and for the grades to which the work is to be done and said plans and specifications are by reference made a part hereof and shall govern for all details of the proposed work. That the tiotal estimated coet of said work or improvement is the sum of One Thousand Five Hundred One and 12/100ths Dollars ($1,501.12). Section 2. That said contemplated worlc or improvement, in the opinion of said City Council, is of more than local or ordinary public benefit, and said City Council hereby determines and declares that the district to be benefited by said work or improvement, and to be assessed to pay the costs and expenses of such work or improvement, is shown on Plan No. 1962-B-4 on file in the office of the City Clerk of said city, to which reference is herebv made for a full and complete description of the assessment district. Section 3. The CitV Council hereby determines and denlares that serial bonds shall be issued in the manner and form provided in Division 7 of the Street� and Highways Code cited as t.he "Improvement Act of 1911," as amended, bearing interest at the rate of six per cetit per annum to represent each assessment of Fifty Dollars ($50.00) or over remaining unpaid for thirty days after the date of recordation of the warrant;said serial bonds sha11 ertend over a period endinb nine years from the second day of Januar� next succeeding the next September first following their date. Said bonds and interest thereon shall be paid at the office of the Citv Trea�urar and the same shall be disbursed by him, all as provided in the said "Improvement Act of 1911," as amended. Section 4. Notice is hereby given that the provisions of that certain act of the Legislature of the State of California �esig- nated �s the Streets and Highways Code, Division 4, cited as the "Special Assessment Investigation Limitation and Ma,jority Protest Act of X931," as amended, have heretofore been fullv complied with and a11 -2- the report s required under the provisions of said act are on file in the office of the City Clerk of said city, open to public inspection, and may there be examined bJ all intereste� persons. Section 5. The proceedings for the aforesaid work or improve- ment shall be taken under an acb of the Legislature of the State of California de,�i�nated as the Streets and Highways Code, Division 7, cited as the ° Improvement Act of 191�," and amendments thereto. Section 6. The City Engineer is hereby directed to mal:e a diagram of the property affected or benefited by said proposed wor.k or improvement as described herein and to be assessed to pay the costs and expenses of said work, showing e�ch separate lot, piece, or parcel of land and the dimensions of each such lot, piece or parcel of land and the relative location of the same to the work or improvement pro- posed to be done, all within the limits of said assessment_, district. Section 7. Notice is hereby given that on Tuesc3ay, the 19th day of June, 1962, at the hour of 7;30 oFClocic p,m., at the Council Chambers in the City Hall, 11jj0 Bu11is Road, in the City of Lynwood, any and all persons having any objections or protests to �aid proposed work or improvement, or to the e.�zent of the district to be assessed, or to the grades to which the work is proposed to be done, tnag appear before said City Council and show cause wh� said proposed worl: or improvement should not be carried out in accordance with this resolution. Section 8. The City Engineer, who is the Superintendent of Streets, is hereby directed to post notices of the passage of this resolution in the time, form, and manner required by lawo Section 9, The Gity Clerk shall certify to the passage of thi� resolution by the City Council of said City of Lynwood, and cause the same to be published twice in the Lynwood Press, a newspaper pub- lished and circulated weekly in said city and hereby deaignated b�T said City Council for the purposes a£oresaid. Said Clerk is also directed to mail notices of the adoption of this resolution of inten- tion in the time, form and manner, and to the persons, all as provided -3- in said "Improvement.
