HomeMy Public PortalAbout2001-042 Resolution Granting a Conditional Use Permit to James Renier and Christine Renier for Accessory Structures at 3392 Hamel RoadMember Jim Lane introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.01-42 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO JAMES RENIER AND CHRISTINE RENIER FOR ACCESSORY STRUCTURES AT 3392 HAMEL ROAD WHEREAS, James Renier and Christine Renier (the "Applicants") are the fee owners of the property located at 3392 Hamel Road (the "Property"); and WHEREAS, the Property is zoned Rural Residential ("RR") and is 37 acres; and WHEREAS, the Applicants have requested permission to add to the number and size of the existing accessory structures on the Property; and WHEREAS, Section 825.19 of the city's zoning ordinance limits any land zoned RR and at least 3 acres in size to no more than 2 accessory structures, which structures may not exceed a total of 3000 square feet unless a conditional use permit is granted; and WHEREAS, the Applicants wish to add to their existing accessory buildings so that the total area thereof will be 15,000 square feet; and WHEREAS, this matter was reviewed by the planning commission at its meeting on July 10, 2001 and by the city council at its meeting on July 17, 2001; and WHEREAS, it has been determined that the Applicants' request will not adversely impact the development of adjacent properties for purposes for which they are currently zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a conditional use permit be granted to the Applicants for the Property for the stated purpose, subject to the following terms and conditions: 1. The Applicants acknowledge and agree that the building nearest to Hamel Road may RHB-201173v1 ME230-324 1 01-42 August 7, 2001 only be used as a riding arena and may not be used as a stable; 2. The Applicants may keep a maximum of 10 horses for personal use with no commercial boarding allowed; 3. The Applicants must comply with the requirements of the Minnesota Pollution Control Agency regarding removal of manure from the Property; 4. The total size of all accessory structures on the Property may not exceed 15,000 square feet; and 5. The Applicants must pay to the city an administrative fee in an amount to be determined by the city staff to represent the actual cost to the city of reviewing this conditional use permit.
