Mayor Yu called the City Council Regular Meeting to order at 7:35 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: ABSENT: ALSO PRESENT: 3. INVOCATION Councilmember-Chavez, Fish, Man, Sternquist, Yu Councilmember-None City Manager Cook, City Attorney Murphy, City Clerk Kuo, Administrative Services Director Hause, Community Development Director Forbes, and Parks and Recreation Director Burroughs Lynne Best, from Westminster Presbyterian Church, 9642 E. Live Oak Avenue, provided the Invocation. 4. PLEDGE OF ALLEGIANCE Boy Scout Troop #161 provided a flag ceremony and led those present in the Pledge of Allegiance. 5. CEREMONIAL/PRESENTATIONS-None 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Peter Choi, CEO and President of Temple City Chamber of Commerce, presented City Council with a plaque recognizing the City for earning the rating of the 38th safest City in California by SafeWise Report. Tony Scaduto, Temple City resident, commented on the long wait to license his dog at the San Gabriel Valley Humane Society. Steve Stafford, Temple City resident, commented on the cars parked on his street and the unsafe speed of the cars. City Council Minutes June 21, 2016 Page 2 of 12 7. APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the Special City Council Meeting of May 31, 2016; 2) Minutes of the Special City Council Meeting of June 7, 2016; 3) Minutes of the Special City Council Meeting of June 7, 2016; and 4) Minutes of the Regular City Council Meeting of June 7, 2016. Action: Approved. B. RE-ADOPTION OF RESOLUTION NO. 16-5173, RECLASSIFYING VARIOUS POSITIONS AND APPROVAL OF THE RESPECTIVE SALARY RANGES Amendment of the Classification Plan for the following positions: Building and Code Inspector I, II, Ill; and Parks and Recreation Manager. Action: Re-adopted Resolution No. 16-5173 amending the Employee Classification Plan and approving the respective salary ranges. C. CONSIDERATION OF A RATE ADJUSTMENT REQUEST FOR WASTE SERVICES FROM ATHENS SERVICES, INC. Per the provisions of the City agreement with Athens, the City Council is requested to approve the rate adjustment request by Athens. The new rates would be effective July 1, 2016. The new single-family rate would increase from $32.10 to $33.51 per month and the rate for a three cubic yard bin would increase from $192.43 to $199.99 per month. Action: Approved the rate adjustment request for waste collection rates made by Athens Services to become effective July 1, 2016. City Council Minutes June 21, 2016 Page 3 of 12 D. ADOPTION OF RESOLUTION NO. 16-5179 ADOPTING THE FISCAL YEAR 2016-17 STATEMENT OF INVESTMENT POLICY The City's Statement of Investment Policy establishes a guideline for the prudent investment of the City's idle funds and outlines a policy for maximizing the efficiency of the cash management system. Action: Adopted Resolution No. 16-5179, adopting the Statement of Investment Policy for the City of Temple City for Fiscal Year 2016-17. E. REAFFIRMATION OF COMMITTED AND ASSIGNED FUND BALANCE CLASSIFICATIONS FOR THE GENERAL FUND FOR FINANCIAL STATEMENT REPORTING PURPOSES AT JUNE 30, 2016, IN ACCORDANCE WITH THE ADOPTED GASB 54 FUND BALANCE POLICY In order to be in compliance with the City's GASB 54 Fund Balance Policy, City Council must reaffirm the Committed Fund Balances and Assigned Fund Balances as designed for financial statement purposes before the end of June 30, 2016. Action: Reaffirmed the Committed Fund Balance of $3,500,000 and the Assigned Fund Balance of $12,302,864 for the General Fund. F. FISCAL YEAR 2015-16 CITY BUDGET -FOURTH QUARTER BUDGET AMENDMENTS The recommended appropriation adjustments are necessary to ensure that actual spending levels in individual line items do not exceed budgeted appropriations at the close of the fourth quarter of Fiscal Year 2015-16. Action: Authorized staff to revise various budgeted appropriations for the Fiscal Year 2015-16 City Budget to ensure revenue estimates are accurate and actual spending levels are within budgeted appropriations during the current fiscal year. G. PETTY CASH AND VISA CARD REPORT The City Council is requested to review, receive and file the Petty Cash and Visa Card Report. ADOPTION OF RESOLUTION NO. 16-5181 APPROVING PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 16-5181 authorizing the payment of bills. Action: Adopted Resolution No. 16-5181. 8. PUBLIC HEARING A. ADOPTION OF RESOLUTION NO. 16-5171 APPROVING THE MASTER FEE AND FINE SCHEDULE FOR FISCAL YEAR 2016-17 AND ESTABLISHING NEW FEES FOR PARKS AND RECREATION PROGRAMS Temple City's fees and fines are currently contained in multiple resolutions adopted over the past 13 years. The proposed Master Fee and Fine Schedule combines all fees and fines into a single schedule. City Manager Cook gave an introduction on the Master Fee and Fine Schedule Schedule. Community Development Director Forbes gave a brief summary of the staff report. Mayor Yu opened public hearing. Franklin Ruedel, Temple City resident, asked questions regarding the noticing for this public hearing. Hearing no further request to speak, Mayor Yu closed public hearing. Councilmember Man made a motion to adopt Resolution No. 16-5171 approving the Master Fee and Fine Schedule for Fiscal Year 2016-17 and establishing new fees for several parks and recreation programs. ADOPTION OF RESOLUTION NO. 16-5178, ORDERING THE LEVY OF City Council Minutes June 21, 2016 Page 5 of 12 CITYWIDE LIGHTING AND MAINTENANCE DISTRICT ASSESSMENTS FOR FISCAL YEAR 2016-17 City Council approval of the Fiscal Year 2016-17 levy of the District assessments will allow the City to continue with its annual Lighting and Maintenance District program. Administrative Services Director Hause gave a brief summary of the staff report. Mayor Yu opened public hearing. Hearing no request to speak, Mayor Yu closed public hearing. Mayor Pro Tern Sternquist made a motion to adopt Resolution No. 16-5178 ordering the levy and collection of assessments for Fiscal Year 2016-17. ADOPTION OF RESOLUTION NO. 16-5177 CONFIRMING THE FACTORS USED FOR CALCULATING THE ANNUAL APPROPRIATIONS LIMIT FOR THE FISCAL YEAR 2016-17 Article Xlll-8 provides limits to the amount of tax proceeds stated and local governments can spend each year. Staff has complied with all the provisions of Article XIII-B in determining the Limit for Fiscal Year 2016-17. In order to be in compliance with California State Law, City Council adoption of the resolution is necessary. Administrative Services Director Hause gave a brief summary of the staff report. Councilmember Chavez made a motion to adopt Resolution No. 16-5177 confirming the factors used for calculating the annual Appropriations Limit for Fiscal Year 2016-17. ADOPTION OF THE PROPOSED FISCAL YEAR 2016-17 CITY BUDGET AND FIND THAT THE CITY IS IN COMPLIANCE WITH GOVERNMENT CODE SECTION 66000 Pursuant to Section 901 of the City Charter, the City Council is required to conduct a public hearing prior to the adoption of the Proposed Fiscal Year 2016-17 City Budget which includes the proposed revenues and corresponding expenditures. City Manager Cook gave an overview of the proposed FY 2016-17 City Budget. Administrative Services Director Hause gave a summary of the staff report. Mayor Yu opened public comments. Jerry Jambazian, Temple City business owner, asked for more information about the Senior Master Plan. Parks and Recreation Director Burroughs shared that the city is expecting the senior population to grow in the next 20-25 years. The Senior Master Plan will include comprehensive studies to look at how to enhance the quality of life for the senior population. Hearing no further request to speak, Mayor Yu closed public comments. Councilmember Man made comments regarding the budgeting process. Mayor Yu made comments regarding the Proposed City Budget. Councilmember Man made a motion to adopt Resolution No. 16-5180, adopting the Proposed Fiscal Year 2016-17 City Budget and making the finding that the City is in compliance with Government Code Section 66000. APPEAL OF PARKS AND RECREATION COMMISSION'S DECISION TO REMOVE TWO (2) SIBERIAN ELM TREES LOCATED IN THE PUBLIC RIGHT OF WAY AT 6034 MUSCATEL AVENUE The City's draft General Plan includes a policy requiring that the City provide adequate and well maintained sidewalks along all City roadways to allow residents of all ages and abilities to walk in a safe and accessible manner. The Siberian Elm trees would interfere with the proposed sidewalk improvements. Parks and Recreation Director Burroughs gave a summary of the staff report. Staff answered City Council questions regarding the trees that will be removed, the tree that will be planted, and regarding sidewalk requirement for new property developments. Mayor Yu opened public hearing. Mark Enkelaar, appellant, made comments regarding the removal of the trees and that he has observed that not all new property development installs sidewalks. Bruce Wee, property owner for 6034 Muscatel Avenue, shared that one of the trees is already lifting the existing driveway. He added that they are trying to comply with the approved plan which requires him to install a sidewalk. Parks and Recreation Burroughs stated that the reason for removing the trees is not due to the condition of the trees or if they are causing damage to the curb and street, but because installation of the sidewalk was a condition to approving the plan for this property improvement. Frank Ruedel, Temple City resident, spoke against removal of the trees. Steve Stafford, Temple City resident, commented regarding City's need to have a policy on sidewalks. Tony Scaduto, Temple City resident, spoke in favor of the City Council considering sidewalk installation on a case by case basis. Dominque Kwan, San Gabriel resident, spoke in regards to the property owner trying to comply with the City's requirement to install a sidewalk. Hearing no further request to speak, Mayor Yu closed public hearing. City Council made comments regarding the City's need to establish a City Council Minutes June 21, 2016 Page 8 of 12 sidewalk policy and the request to remove the trees. Councilmember Chavez made a motion to uphold the Parks and Recreation Commission's decision to remove the trees and plant a new tree as recommended by staff. UNFINISHED BUSINESS-None The City Council recessed at 9:47 p.m. and reconvened at 9:59 p.m. with all members present. 10. NEW BUSINESS A. DISCUSSION OF PUBLIC ARTS COMMISSION The City Council is requested to discuss the Public Arts Commission. City Manager Cook gave a brief history on the Public Arts Commission and items that were recently discussed during their meetings. City Council asked questions regarding staffing and current projects for the Public Arts Commission. Mayor Yu shared that when the Public Arts Commission was formed, there were a Jot of art projects with the Rosemead Boulevard Improvement Project. Without funding and a more definitive scope of work, he suggests establishing Council Ad Hoc Committee to address specific art projects with art advisory members. Councilmember Chavez stated that the Public Arts Commission works differently than the other Commissions. City Council relies on the Public Arts Commission to bring items for City Council consideration whereas the other Commissions meet about discretionary items set by City Council. Perhaps City Council should consider reverting the Public Arts Commission back to an advisory group. Councilmember Fish stated that maybe there are not enough projects for the Public Arts Commission to consider. She would prefer to see the group City Council Minutes June 21, 2016 Page 9 of 12 become an ad hoc or an advisory committee. City Attorney Murphy answered Mayor Pro Tern Sternquist's question regarding next steps if City Council should decide to dissolve the Public Arts Commission. He stated that the City Council would direct staff to bring back an ordinance to eliminate the commission, keep the public arts program and provide a new structure for either an advisory committee or a citizen advisory group that can be called upon by the City Council to help in different ways to allow for more flexibility. City Council directed staff to have a discussion with the existing Public Arts Commissioners for their input regarding the current structure of the Commission and bring this item back to City Council for consideration. Councilmember Man stated that he would also like staff to address what would happen to the already established ideas and adopted Public Arts Annual Plan when this discussion is brought back to City Council. UPDATE FROM CITY MANAGER Shared that the City has reached out to neighboring cities affected by the recent fire. COUNCILMEMBER MAN Commented on the Mental Health Awareness talk hosted by the library this past Saturday. He would like the City to help raise awareness. D. MAYOR PROTEM STERNQUIST Shared that the San Gabriel Valley Economic Partnership is offering cities their own page on the San Gabriel Valley Economic Partnership website for businesses looking for a location to open. Reported on the County Library Commission meeting she attended. E. MAYORYU Made comments regarding the City Budget and thanked staff for facilitating the process. 16. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Jerry Jambazian, Temple City business owner, asked City Council to consider updating the City's entrances sign on the east side of town (i.e., Baldwin and Las Tunas Drive). He also expressed excitement for the start of City's concert in the park series. 19.
