(2-72 - A RESOLUTIOIJ OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, CONFIRMING THE REPORT OF THE SUPERIN�'ENDEPIT OF STREETS OF SAID CITY, DATED NOVEMBER 7, 1962, RELATING TO'CERTAIN : SID�WALK REPAIRS. WI�REAS, under the provisions of Article 2, Chapter 22, pa.rt 3 of Division 7 of the Streets and Highwa,ys Code of the State ` of Cali£ornia, (Improvement Act'of 1911� the Superintendent of Streets of the City of Lynwood did duly arid regularl� notify the respective owners or persons in possession of the respective , properties described in the report of said Street Superintendent hereinafter referred t'o, that Ehe sidewalk or drive approach in front of such respective properLies was out of repair and notify- ing such owners or persons in possession to repa.ir the same, a.11 in the ma.nner,as contemplated in said law a.bove referred to; and . Whereas, thereafter said owners or persons in possession of said respective pro�erties failed to malte such repa.irs within the � time conternplated by law or at a11; and WHEREAS, thereafter tlie sa.id Stlperintendent of Streets did cause the res�ective repairs to be made to the sidewallc in front of such respective properties and did keep a record of the cost - of such repairs, including the incidenta.l expenses thereof, and - did prepa.re and file with the said CitV Council a report specifying the repairs which had been so made, the cost of euch repairs and ., a description of ea,ch.parcel of rea,l property in front of which such repairs had been made and the assessment a,ga,inst each lot or pa.rcel of land proposed to be levied to pay the cost thereof; and WHEREAS, a.s contem��lated by 1aw, sa,id Superintendent of Streets did cause notice of the said cost of such repairs to be mailed to the respective owners or persons in possession of sa,id respective properties and did in such notices give further notice that on the 7th day of November, 1962, beginning at the hour of 7:30 o'cloek p.m., in the Counc�\ Chamber of the Cit� Hal1 of the � City of Lynwood, Cali£ornia, the Council o£ the said'city would hear and pass upon the said report of the Superintendent of Streets of the said cost of such repairs together with any objections or protests which might be raised by any property owner lia,ble to be assessed for the cost and incidental expenses of making such repairs and the objections or protests of any other interested persons; and WHEREAS, on the said 7th day of November, 1962, said City Council did proceed to hold said hea.ring and did duly and regularly conduct the same all as contemplated by law; and WHEREAS,.�no protests or objections of any kind were made, presented or filed in such matter; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS: ' Section 1 . That the facts with reference to said matter as recited in the preamble to this resolution are true. Section 2 . That said City Council does hereby confirm the report of said Street Superintendent which is on file in the of£ice of the City Clerk of said City and open to public inspection and which is referred to and incorporated by reference herein and is in words and figures as follows: � ;. �� November 7, 1g62 Honorable Mayor and City Council . In accordance with the above mentioned act I have fixed the hour o£ 7:30 o'clock p.m. on Wednesday, the 7th day o£ November, 1g62 in the Council Chambers of the City Hall of the City of Lynwood a.s the time a,nd place of hea.ring such objections or protests. That the sa.id Council does hereby assess the respective costs of said repairs against the respective parcels of rea.1 property fronting upon the sidewalk upon which such res- pective repairs were made, all in the respective.amounts, for the respective purposes and against the respeotive properties as.set' � forth and indica.ted in said.report of sa,id Superintendent of Streets -5- . . • on'file as aforesaid and which is hereinabove quoted in full and. does hereby order that unless the sa.id respective. amounts so assessed are respectively paid within the time limited by law the�sa.id respective amounts' sha.11 constitute and be and are hereby respectively levied by said Council as respective special a.ssessments aga,inst ' the said respective parcels of real properties for the respective amounts,all a.s, set forth in sa.id report hereinabove quoted and a.s contemplated under the provisions of said Chapter 22 of Part 3, of Division 7 of said Streets and Highwa.ys Code, which said respective liens shall respectively continue until the respective assessments . and a1l.reapective interest amounts thereon are respectively paid or until they are respectively discharged of record. . Section 4 . That sa.id Council does hereby elect to proceed _ under the alternative method of collection provided for under the ._ provisions of Section 5628 of said Law (Improvement Act of 1911) , hereina.bove referred to and does hereby a.uth'orize, instruct and �order that the Notice of Lien shall be delivered to the County ' Auditor of Los Angeles County, 'California, who shall enter the amount thereof on the County Assessment Book opposite the des- � cription of the particular property and the amount shall be collected together with a'll other t�es thereon against the property. Said County Auditor, and the Assessor and the Ta.Y Collector of said . County of Los Angeles who perform tax assessin� and t� collecting functions for the City of Lynwood are hereby authorized, instructed, directed a.nd ordered to take any and all a.etion neeessa.ry or proper on their reapective parts, all as contemplated under the provisions- of the laws of the State of California in such cases made and provided. Section 5 . Said County Assessor, said County TaY Collector _... and said County Auditor are hereby authorized, instructed, direc.ted ., and ordered upon receipt of such notices of lien to receive the _, same and thereafter proceed to a.dd the respective amounts of the • , . _6_ respective assessments indicated in said respective notices of ' lien as ��nereinabove set forth in said above quoted report of' said Street Superintendent, to the next regular bill for taxes levied a.gainst the respective lots or,parcels of land therein described or referred to and to enter the respective amounts.thereof on the County Assessment Boolc opposite the respective'descriptions of the respective particula.r properties described and referred to in sa.id respective notices of lien as set'forth in said report and the respective amounta.thereof.shall .be collected with.a.11 other taxes thereon against the respective properties described.
