HomeMy Public PortalAbout2001-044 Resolution Granting a Permit to Reliant Energy, Qwest, Mediacom, Xcel Energy, Wright Hennepin, WhlinkMember Phil Zietlow introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.01-44 RESOLUTION GRANTING A PERMIT TO RELIANT ENERGY FOR INSTALLATION OF NATURAL GAS, QWEST FOR INSTALLATION OF TELEPHONE, MEDIACOM FOR INSTALLATION OF CABLE T.V., XCEL ENERGY FOR INSTALLATION OF ELECTRIC AND STREET LIGHTS, WRIGHT HENNEPIN FOR INSTALLATION OF ELECTRIC, AND STREET LIGHTS AND WHLINK FOR INSTALLATION OF TELEPHONE. WHEREAS, Reliant Energy has made an application for installation of natural gas facilities, Qwest for installation of telephone facilities, MediaCom for installation of cable T.V., Xcel Energy for installation of electric and street lights, Wright Hennepin for installation of electric, and street lights, and WH Link for installation of telephone in the Wild Meadows sub -division in Medina; and, WHEREAS, the permit issued hereby is not a cable franchise as provided in Minnesota Statues, Chapter 238, and issuance of this permit to WHLink does not authorize the construction or operation of a cable system, nor the delivery of cable service, for which issuance of a cable franchise is required; NOW, THEREFORE, BE IT RESOLVED that said application be approved in accordance with the plans and specifications submitted, subject to the following conditions: 1. The streets and right of ways shall be restored to their original condition upon completion of installation and applicant shall be liable for settlement or other damage caused by said installation for a period of one year following completion. 2. All utilities shall be placed in the utility easement using a joint trench in a 10' easement along the City's road right of ways. 3. All utilities shall also be placed in a joint trench from the right of way to all homes. 4. As built plans shall be provided to the City upon completion of installation. 5. Street light's provided by Xcel Energy and paid for by the developer shall match the plans approved by the City or one determined by City staff to be similar and meet the City's lighting standards. 6. Wright Hennepin and Xcel Energy shall install the same street lighting throughout the sub -division. 1 01-44 August 21, 2001 Dated: August 21, 2001 ATT Paul Robinson, Clerk -Treasurer The motion for the adoption of the foregoing resolution was duly seconded by member Carolyn Smith and upon vote being taken thereon, the following voted in favor thereof: Ferris, Lane, Smith, and Zietlow and the following voted against same: None Absent: Workman (arrived after vote was taken) Whereupon said resolution was declared duly passed and adopted. 2 01-44 August 21, 2001
