HomeMy Public PortalAbout2001-048 Resolution Granting a Conditional Use Permit and Variance to Glen Lincoln Partners 780-790 Tower DriveMember Phil Zietlow introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 01 48 RESOLUTION GRANTING A CONDITIONAL USE PERMIT AND VARIANCE TO GLEN LINCOLN PARTNERS 780-790 TOWER DRIVE WHEREAS, Glen Lincoln Partners (the "Applicant") is the fee owner of the property legally described as Lot 1, Block 1, Medina Industrial 5th Addition (the "Property"); and WHEREAS, the Property is zoned urban commercial ("UC"); and WHEREAS, the Applicant has proposed to construct an industrial building on the Property which will be used for a variety of permitted or conditional uses; and WHEREAS, the city's zoning ordinance pertaining to property in the UC district requires a conditional use permit to be issued in this instance; and WHEREAS, this matter was reviewed by the planning commission at its meeting on August 14, 2001 and by the city council at its meeting on August 21, 2001; and WHEREAS, it has been determined that the Applicant's request will not adversely impact the development of adjacent properties for purposes for which they are currently zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a conditional use permit be granted to the Applicant for the Property for the stated purpose, subject to the following terms and conditions: 1. The building must be constructed in compliance with the plans and drawings submitted to and approved by the city council at its meeting on August 21, 2001, including but not limited to, brick and dyed rock face be used for the exterior building materials and brick on the front of the building be positioned and installed to break the long flat appearance; 2. The Applicant must plant four 21/2 inch boulevard trees on the Property; RHB-202169v 1 ME230-320 1 01-48 September 4, 2001 3. The Applicant must comply with all engineering requirements contained in the letter dated July 24, 2001 from Tom Kellogg of Bonestroo Rosene Anderlik & Associates to Loren Kohnen; 4. The Applicant must plant three 8 foot arborvitae on the back of the Property instead of the ash trees shown on the proposed landscape plan; 5. Tenants with other than office/warehouse/manufacturing uses will require an administrational conditional use permit and must comply with any additional terms and conditions applicable to those specific conditional uses in the UC zoning district; and 6. The Applicant must pay to the city an administrative fee in an amount to be determined by the city staff to represent the actual cost to the city of reviewing this conditional use permit application. NOW, THEREFORE, BE IT FURTHER RESOLVED that a variance be granted to the Applicant for the Property to reduce the required front yard setback for the parking from 25 feet to 16 feet, subject to the requirement that the parking lot be constructed as shown on the site plan submitted to and approved by the city council. The variance is justified by the size, shape and depth of the lot which makes full compliance with the UC ordinance parking setback requirements a hardship. Dated: September 4, 2001.
