HomeMy Public PortalAbout081-2011 Metro -South 4th Street MOU Final chaMEMORANDUM OF UNDERSTANDING A Memorandum of Understanding between the Richmond Common Council and the Wayne County Board of Commissioners regarding the vacation of a street between Main Street and South A Street, more commonly known as South 4t" Street. Whereas, the Wayne County Board of Commissioners (hereafter "Commissioners") have a necessity to manage vehicular parking, handicapped accessibility matters, pedestrian safety and enforcement of the County's smoking ordinance in an area commonly known as South 4t" Street (hereafter "vacated street") between Main Street and South A Street; and Whereas, for the purpose of this agreement, permanent or permanently is defined as a continuous period of time of more than five (5) days; and Whereas, the Richmond Common Council (hereafter "Council) considers the vacated street a vital link between Main Street and South A Street; and Whereas, both Commissioners and Council recognize the fiscal and manpower resources necessary to accomplish the needs of each entity; and Whereas, both the Commissioners and the Council have determined that it is in the best interest of both governmental units to recognize the vacated street as a public parking facility having an entrance and exit onto Main and South A Streets; and Whereas, it is understood by the Commissioners and the Council that at the time of the vacation proceedings, the Commissioners did not have plans to permanently close the vacated street to through vehicular traffic; and Whereas, the Council has determined that based upon traffic patterns at the time of the vacation proceedings, South 4t" Street was an important thoroughfare linkage and should remain accessible for vehicular traffic to traverse between Main Street and South A Street; and Whereas, the Commissioners and Council both recognize that future parking needs of the Commissioners may change and that the Council may determine that the traffic patterns of the vacated street may also change at some future time. It is therefore resolved that before the vacated street is permanently closed to vehicular traffic, the permanent closure of the vacated street must be approved by a majority of the Commissioners and a majority of Council before such action may be taken. In determining whether to concur with the Commissioners desire to permanently close the vacated street, the Council shall take into consideration the following: 1. Guidance from the City's most current Comprehensive Plan; and 2. How emergency response vehicles will access the permanently closed vacated street; and 3. How the permanent closing of the vacated street would negatively impact growth and the orderly development of the area; and 4. How access to public utilities would be maintained. 5. The best interests of both the City of Richmond and Wayne County Government, collectively. The undersigned, by their signature below, represent and acknowledge that they have full authority to execute this Memorandum of Understanding on behalf of the respective entity for which they are signing, and that such authority is pursuant to a motion or resolution granting them such authority, that such authority is current and has not been revoked. This Memorandum of Understanding is binding upon the parties and their successors and their agents.
