A GENERAL ORDINANCE AMENDING SECTION 154.62.01.03(c) OF
THE CITY OF RICHMOND CODE
WHEREAS, Section 154.62.01.03(c) of the City of Richmond Code sets forth the procedure
by which changes to the Zone Maps incorporated by reference into the zoning ordinance; and
WHEREAS, said section parallels the procedures set forth in State Code; and
WHEREAS, presumably through typographical or word processing error said section does not
conform to the procedures set forth in Indiana Code; and
WHEREAS, it is desirable that City Code as it relates to such zoning changes should parallel
the provisions of Indiana Code.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that Section 154.62.01.03(c) is hereby amended to read as follows:
(c) This section applies to a proposal to change the Zone Maps incorporated by reference into the Zoning Ordinance.
(1) The Common Council shall vote on the proposal within ninety (9) days after the Commission certifies the proposal.
(2) This subsection applies if the proposal receives a favorable recommendation from the Commission:
(A) At the first regular meeting of the Common Council after the proposal is certified, (or at any subsequent meeting within the ninety (90) day period), the Common Council may adopt
or reject the proposal.
(B) If the Common Council adopts (as certified) the proposal, it takes effect as other ordinances of the Common Council.
(C) If the Common Council rejects the proposal, it is defeated.
(D) If the Common Council fails to act on the proposal within ninety (90) days after certification, the ordinance takes effect as if it had been adopted (as certified) ninety (90) days
after certification.
(3) This subsection applies if the proposal receives either an unfavorable recommendation or no recommendation from the plan commission:
(A) At the first regular meeting of the Common Council after the proposal is certified (or at any subsequent meeting within the ninety (90) day period), the Common Council may adopt
or reject the proposal.
(B) If the Common Council adopts (as certified) the proposal, it takes effect as other ordinances of the Common Council.
(C) If the Common Council rejects the proposal, it is defeated.
(D) If the Common Council fails to act on the proposal within ninety (90) days after certification, it is defeated.
