RESOLUTION NO.01-51
RESOLUTION GRANTING PRELIMINARY PLAT
APPROVAL FOR DANIEL BENNIS/BENNIS INVESTMENT
PROPERTIES, LLC
WHEREAS, Daniel Bennis/Bennis Investment Properties, LLC (the "Applicant") is the fee
owner of property legally described on Exhibit A attached hereto (the "Property"); and
WHEREAS, the Applicant intends to plat the Property by combining three lots into two;
and
WHEREAS, this matter was reviewed and approved by the planning commission at its
meeting on September 11, 2001; and
WHEREAS, the plat was given preliminary review by the city council on September 18,
2001 for its compliance with the ordinances and requirements of the city.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that preliminary plat approval is hereby granted to the Applicant for the plat of the
Property, subject to the following terms and conditions:
1. The Applicant is required to connect the existing house on proposed lot 1 to sanitary
sewer within one year of the date of final plat approval;
2. When a new house is constructed on proposed lot 2 it must be built in compliance
with all required setbacks;
3. The existing shed on proposed lot 1 is acknowledged to be an existing non-
conformity because of the side yard setback;
4. The existing garage on proposed lot 2 is acknowledged to be an existing non-
conformity because of the front yard setback;
5. The final plat must dedicate drainage and utility easements along all property lines

as required by the city engineer;
6. The final plat must be executed by all parties identified by the city attorney as
having an interest in the Property;
7. The Applicant must pay to the city an administrative fee in an amount necessary to
reimburse the city for the cost of reviewing this application; and
8. The Applicant must submit the final plat for approval to the zoning administrator
within 180 days of the date of this resolution or the approval hereby granted shall be null and void.
The final plat must be in compliance with the terms and conditions of the preliminary plat approval
and of the ordinances and requirements of the city.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of
Medina that variances are hereby granted in connection with approval of the Applicant's plat to
permit both lot 1 and lot 2 to have less than five acres of contiguous soils suitable for a standard on -
site sewage disposal system. The variances are justified because, although the Property is zoned
rural residential, it is served by sanitary sewer.

The motion for the adoption of the foregoing resolution was duly seconded by member Carolyn
Smith and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Lane, Smith, Workman, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
