HomeMy Public PortalAbout2001-052 Resolution Granting a Conditional Use Permit to Stephen Spraungel for 822 Tower DriveMember Bruce Workman introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.01-52 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO STEPHEN SPRAUNGEL FOR 822 TOWER DRIVE WHEREAS, Steven Spraungel (the "Applicant") is the fee owner of the property located at 822 Tower Drive in Medina, which land is legally described as Lot 6, Block 1, Grier Industrial Park (the "Property"); and WHEREAS, the Property is zoned urban commercial ("UC"); and WHEREAS, the Applicant has proposed to construct a 12,135 square foot office/warehouse building on the Property which will be used for a variety of permitted or conditional uses; and WHEREAS, the city's zoning ordinance pertaining to property in the UC district requires a conditional use permit to be issued in this instance; and WHEREAS, this matter was reviewed by the planning commission at its meeting on July 10, 2001 and by the city council at its meeting on September 18, 2001; and WHEREAS, it has been determined that the Applicant's request will not adversely impact the development of adjacent properties for purposes for which they are currently zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a conditional use permit be granted to the Applicant for the Property for the stated purpose, subject to the following terms and conditions: 1. The building must be constructed in compliance with the plans and drawings submitted to and approved by the city council at its meeting on September 18, 2001; 2. City staff must verify that exterior lighting on the Property is in compliance with City requirements prior to occupancy of the building; RHB-203515v 1 01-52 ME230-327 October 2, 2001 3. The Applicant must comply with all engineering requirements contained in the letter dated September 10, 2001 from Tom Kellogg of Bonestroo Rosene Anderlik & Associates to Loren Kohnen; 4. Tenants with other than office/warehouse uses will require an administrational conditional use permit and must comply with any additional terms and conditions applicable to those specific conditional uses in the UC zoning district; and 5. The Applicant must pay to the city an administrative fee in an amount to be determined by the city staff to represent the actual cost to the city of reviewing this conditional use permit application.
