RESOLUTION NO.01-53
RESOLUTION AUTHORIZING EXECUTION OF PUD
DEVELOPMENT AGREEMENT
WHEREAS, on September 4, 2001 the city of Medina (the "City") adopted Ordinance No.
346, An Ordinance Approving a General Plan of Development and Rezoning Property to Planned
Unit Development, concerning certain property located generally south of Evergreen Road extended
and east of CSAH 101; and
WHEREAS, said approval was conditioned upon the City and Charles Cudd, LLC (the
"Developer") entering into a PUD development agreement (the "Development Agreement')
concerning Medina Highlands; and
WHEREAS, the City and the Developer have negotiated the terms of the Development
Agreement and the Developer has agreed to execute it and conclude all other matters necessary for
final approval of the rezoning of Medina Highlands.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, as follows:
1. The mayor and administrator -clerk -treasurer are hereby authorized and directed to
execute the Development Agreement, a copy of which is attached hereto as Exhibit A; and
2. Rezoning Medina Highlands to Planned Unit Development is subject to the
approved PUD Development Plan and to final stage site and building construction plans prior to
issuance of building permits for any lots within Medina Highlands.

The motion for the adoption of the foregoing resolution was duly seconded by member Phil Zietlow
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Lane, Smith, Workman, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
