Request filed by Westpoint Construction, • property owner, Mark Naeger, authorized representative, to rezone approximately 1.09 acres from RA-1 High Density Residential and RS-1 Low Density Residential to RD Medium Density Attached Residential. The property is generally located on the eastern side of Nob Hill Road approximately 500 feet south of Foxboro Drive and is described as lot 15 of Westminster Estates Subdivision and Reserve Tract B of The Trails of Kauffmann Hills Subdivision, Section Three, Jefferson City, Cole County, Missouri. Mr. Mark Naeger, 5510 Saddlebrook Lane, Lohman, Missouri, spoke regarding this request. Mr. Naeger explained that he recently purchased the adjacent strip of land currently zoned RS-1. The purpose is to bring the two lots together under the same zoning. He proposes to split the lot and build two additional two-unit condominium buildings. Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding this request. Mr. Bates explained that the purpose of this request is to bring the zoning of the smaller parcel into conformance with the larger lot. No one spoke in opposition to this request and no correspondence was received. Mr. Barron gave the Planning Division staff report and explained that this section of Nob Hill Road, while zoned for high density residential development, has been developed in a medium density attached residential manner. This duplex development, while not completely compatible 'with the surrounding single family development, is more compatible with the adjacent uses than a higher density apartment development would be. The downzoning of this property would restrict the allowed uses to those uses that are compatible with the existing development in the area. Staff recommends approval of the rezoning request. Mr. Nunn moved and Mr. Jordan seconded to recommend approval of rezoning property addressed as 915 Nob Hill Road from RA-1 High Density Residential and RS-1 Low Density Residential to RD Medium Density Attached Residential, to the City Council.
