WHEREAS, the property described herein is zoned I-2 Industrial Planned District; and WHEREAS, the applicant requests site plan approval in order to construct and operate a concrete batching facility at 14800 NW 24th Court, on a 54,000 square foot site or 1.23 Acres more or less by calculations which is comprised of two properties identified by tax folios 08-2122-025-0510 and 08-2122-025-0500; and WHEREAS, On June 7, 2016, the City of Opa-locka, Florida Planning Council Board recommended denial of the site plan by a vote of 3-1. The Site Plan and Planning Council's recommendation are attached hereto as "Exhibit A" and incorporated by reference herein; and WHEREAS, According to the City Land Development Regulation (LDR)/Zoning Code, Section 22-49 G, All Planning Council decisions, actions, resolutions, findings of fact, recommendations on appeals, rezoning, variances, consideration of capital programs, approval of land purchase or sale, and all other matters required by the Charter or Code of the City are subject to review by the City Commission. All recommendations and findings of fact by the Planning Council shall be placed on the next available regular City Commission meeting agenda in compliance with the notice requirements; and Resolution No. 16-9243 WHEREAS, the City Commission of the City of Opa-locka, Florida desires to approve or deny the site plan as proposed by Polimix Properties, Inc., NOW, THEREFORE, BE IT DULY RESOLVED THAT THE CITY COMMISSION FOR THE CITY OF OPA LOCKA, FLORIDA: Section 1.The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka, Florida hereby grants/denies Polimix Properties, Inc., request for final site plan approval to construct and operate a concrete batching facility at 14800 NW 24th Court, on a 54,000 square foot site or 1.23 acres more or less by calculations which is comprised of two properties identified by tax folios 08-2122-025-0510 and 08- 2122-025-0500. This Site Plan was reviewed by the Planning Council and the Council recommended denial. A copy of the Site Plan is attached hereto as "Exhibit A." Section 4. This resolution shall take effect immediately upon adoption. Providing for incorporation of recitals; Providing for an effective date. Staff Summary The applicant requested information concerning the permitted uses of the 1-2 zoning district. Staff provided this information and provided the deadlines for submission of all the required documents including the Planning Council applications, site plan requirements,the fee schedule and the format of a development agreement. During the month of March, 2016, staff met with the applicant's Architectural team and reviewed the proposed project Site Plan and set forth the requirements in order for this project to be in compliance pursuant to the City's Comprehensive Plan and Land Development Regulation/ Zoning Code Ordinance no. 15-31 and the following was determined: A Site Plan is required; A Development Agreement is required; No Variance is required. The applicant, POLIMIX Properties,lnc, submitted a proposal to use the subject property to construct and operate a concrete batching facility at 14800 NW 24th Court. The site would provide for the storage of 12 concrete delivery trucks, storage of aggregates and additives for the mixtures,fuel for the front loader, a 1,630 square foot building and two batch plants. Resolution—POLIMIX Properties Request for SP Approval 06-30-16 1 The applicant submitted a Planning Council application for Site Plan approval request on March 21, 2016. The applicant contacted staff and conveyed that the site plan needed to be changed and the request was tabled until all documents were submitted. The site plan was re-submitted on May 6,2016. The site plan consisted of a sealed certified survey,general notes and specifications, civil site plan, grading and drainage plan, water main plan, detail sheet, vehicular circulation plan, landscape plan, tree disposition plan, lighting photometric plan and architectural elevations and a traffic statement report. In addition to the Planning and Community Development and Zoning review this site plan was also subject to a Development Review Committee (DRC) process by which other City of Opa-locka Departments reviewed this site plan. After all reviews were done, this request was then properly noticed pursuant to state law and the City Charter Code by the City Clerk's Office for public hearing notice of advertisement. It is proposed that at all times on the site there will be four employees operating the facility, and truck delivery drivers will be coming and going.Within the office there will be two employees; one operating the control room and the other dispatching trucks. Outside of the office; one will be operating the front loader and the other will be in charge of plant maintenance and cleanliness. Parking for the facility will be met by providing the necessary spaces for the buildings' square footage as per the code, which is five parking spaces, but one additional space is proposed for temporary parking. The temporary parking space will accommodate an arriving delivery truck driver while they relocate a delivery truck from its overnight parking space and place it in cue for batching and then station their personal vehicles within one of the oversized spaces. Similarly, at the end of the day when the delivery truck is washing out it's drum at the centralized washout area the delivery driver can perform the same operation as to park his delivery truck in the overnight parking space. A concrete batching facility operates typically from Monday to Saturday, starting roughly at 4:30am and closing its doors at 7pm. But due to the nature of construction, and the limitations of when work can occur in some areas around the Miami-Dade and Broward County a concrete batching facility will operate a 24 hour shift or on a Sunday to fulfill a special order. This analysis conforms to the trip generation methodology of the Institute of Transportation Engineers (ITE). The subject site is located within an industrial area at the address 14800 NW 24th Court in the City of Opa-Locka, Florida. This site currently has a warehouse with 30,174 square feet that will be demolished as part of the subject project. The subject project consists of a concrete batch plant with 1.24 acres. The trip generation characteristics for the subject project were obtained from ITE's Trip Generation Manual. 9th Edition. The Trip Generation calculations were performed for the weekdays AM and PM peak hour. The following land uses, as identified by the Institute of Transportation Engineers (ITE), most closely resemble the subject project. These land uses (LU) are as follows: Existing • LU 150: Warehouse with 30,174 Square Feet Proposed • LU 140: Manufacturing (Concrete Plant) with 1.24 Acres Based on the trip generation calculations, the existing warehouse and the proposed concrete plant yielded a total of 9 gross vehicle trips during the AM peak hour and 10 gross vehicle trips during the PM peak hour. As such, the net trip generation result is zero. The subject project is located within the Traffic Analysis Zone (TAZ) 254 as assigned by the Metropolitan Planning Organization's (MPO) on the Miami-Dade Transportation Plan (to the Year 2040) Directional Trips Distribution Report, October 2014. There are a host of industrial uses including manufacturing, salvage/scrap metal facility, boat manufacturing and repair, vehicle repair, and material processing around this proposed use. • Tree Preservation: Compliance with Tree Preservation Ordinance required pursuant to City ORDINANCE NO.10-03 and the Requirementsof Ordinance 15-31 Article VII Landscaping and Tree Preservation. - Findings: The applicant has provided a total of 27 Trees and 56 Shrubs of which 19 trees were required for the site and 8 trees were required as right of way frontage. The tree variety includes the Silver Buttonwood ,White Stopper and Alexander Palm. Findings: According to the City's Land Development Regulation/Zoning Code 1-2(Industrial Planned District) permits this use if approved as a special exception. • Community Comments/Petitions: - Findings: The applicant/Owner did not return any signed petitions or present any letters to the city of any comments from the surrounding neighbors regarding this proposed project or use. • Traffic Statement-All projects of this industrial intensity requires a minimum a traffic statement. Findings: According to the Traffic Statement provided the proposed concrete plant will generate the same amount of peak hour trips as the former existing warehouse. Therefore,the proposed use will have a De Minimis traffic impact on the surrounding streets and no further traffic analysis is warranted or recommended. This statement was provided by Carlos X. The following members of the Planning Council were present: Board Member Germane Barnes, Board Member Lloyd Tyler, Board Member Rose Tydus & Chairman Calvin Russell. Absent Board Members: Board Member Elio Guerrero Also in Attendance were Planning & Community Development Director, Gregory Gay, Zoning Official, Gerald Lee, Administrative Assistant, Kinshannta Hall, and Attorney Vincent Brown. II INVOCATION AND PLEDGE: Board Member Rose Tydus led the Prayer and the Pledge of Allegiance was stated after the Prayer. III APPROVAL OF MINUTES: Discussion of Minutes from June 7,2016 Meeting Chairman Calvin Russell asked if a motion could be made to have the minutes approved from May 5, 2016 meeting. Board Member Lloyd Tyler made a motion to approve the minutes. Board Member Rose Tydus second the motion. There being no discussion, the motion passed by a 3-1. We have some items on the agenda and it would be a preference if we have items more like public items that are being presented to you. Items two and three are action items that are presented by a particular group and the first item is really a department item. I would like to take the items out of sequence. I would like to have items two and three go first and have item one be the last item on the agenda if that's okay with you. I would appreciate it. Chairman Russell: I don't have a problem with that. IV. PUBLIC HEARING: 1. POLIMIX PROPERTIES, INC 14800 NW 24 COURT & 14810 NW 24 COURT, OPA-LOCKA, FL 33054 REQUEST: A RESOLUTION OF THE PLANNING COUNCIL OF THE CITY OF OPA-LOCKA TO CONSIDER THE REQUEST OF POLIMIX PROPERTIES, INC FOR SITE PLAN APPROVAL TO CONSTRUCT AND OPERATE A CONCRETE BATCHING FACILITY AT 14800 NW 24TH COURT. Chairman Russell: We should have the presentation first. Mr. Gay: We do have presenters for Polimix Properties. They can come and make a presentation about what the project is about and where it is located. Chairman If you would like to open up Public Hearing after they present you may do so. Oscar Robayna: My name is Oscar Robayna. I am the civil engineer for the project. The project consists of redevelopment of a parcel. The project is located within a warehouse off of NW 24th court and 149th Street. It's just over an acre in size. Polimix is interested in purchasing this property to develop a concrete batching facility where concrete trucks goes to fill. This will be added business to the City of Opa-locka. The property has a storage for a few vehicles. It seems to follow all requirements of the city. There is not much I can say. I really would like to open up for questions now. Chairman Russell: Any questions members? 21 Page Chairman Russell: You said some vehicles will be stored there, what kind? Oscar Robayna: The concrete batch trucks, the ones with the drums in the back. That's what the facility for. It is for the mixing of the aggregate. It would load the vehicles which will go out for delivery. Chairman Russell: Any questions? Member Tydus: I rode by the location the other day for about twenty minutes and I could not find the address. Then I read my package and I saw where the property is vacant. I did see a vacant lot fenced in. Is that the property? Oscar Robayna: Yes it use to be a warehouse but I believed it burned down. Member Tydus: In the Middle of the Block? Oscar Robayna: Yes, in the middle of the block. Oscar Robayna: It's just south of the intersection of 149th street in the middle of the block. Member Tydus: I noticed no signed petitions from the neighboring. Oscar Robayna: That's Odd. Member Tydus: The owner did not return any signed petitions or presented any letters to the city of any comments from the surrounding neighbors regarding the proposed project of use. Oscar Robayna: That is not correct, we did submit those. Mr. Gay: There is a list within your package a list of properties that were notified. We did do the notifications to make sure all properties that were within 375 feet were notified. This project is within an industrial area. Member Tydus: I'm just reading from the written document I have from the city. Member Tydus: I know you had the traffic study done, and it seems not to be any problems as far as traffic. What kind of impact will those heavy trucks have on our pavement? Wage Oscar Robayna: The weight of the truck is large because of distribution of the loads. The actual points are not as strong. There would be taken care through impact fees. The roadways are maintained by the city. Member Tydus: This has nothing to do with this request. Just for the record, I really apologize to the citizens of this community for that industrial part. None of the codes are being enforced. I hope that with you coming here with new construction and with this landscaping in this site plan will be a catalyst for the city and the surrounding businesses in that industrial area. I grieved when I got home that I allowed that under my watch. So don't let that be an influence to you in a negative way. I hope that this business will have a new way of doing things in that area. Oscar Rubino: As you saw in that site plan there is landscaping provided per the code. Chairman Russell: I have a big concern. I didn't go by the property, but I'm very familiar with that area. The roads over there are torn. I was over there two days ago. There is nothing in place and with big trucks the roads will get worse. I really just wish we could do something else besides having big trucks back there. Member Tyler: I share the concerns voiced by my colleagues. I was going over your application it states that you will be in operation six days a week is that correct? Are your days of operation Monday through Saturday and possibly Sunday? Oscar Robayna: That's what we were hoping for but the client is willing to adjust his hours in order to bring himself to the City of Opa-locka. Mr. Gay: If I could piggy back off of that. Chairman Russell: Piggy back off of what? Mr. Gay: The statements being made as far as the hours of operation. The application that is before you is dealing with the site plan itself. The issues you are discussing as far as hour of operation will be reflected that is a part of the development agreement which will be the next item that you will be making a decision on. Even though we can have a conversation at this time, I just wanted to encourage you and let you know that those concerns that you express as it relates will be more reflective through the Development Agreement. Chairman Russell: Mr. Gay, but if we don't deal with these issues first we will still have the same issues. Mr. Gay when was the last time you drove over there? Mr. Gay: The other day. Chairman Russell: What is your opinion? Mr. Gay: The roads are terrible. Wage Chairman Russell: The roads are terrible. We are just putting problems on top of problems. The citizens are suffering. I don't live to far from there. It affects the people in surrounding areas. We need to do things that will help our community. These types of businesses will not help our community. When it rain over there the entire area flood and you can't drive a car through there. The roads will not get better. Member Tydus: We don't have any money to repair the roads. Chairman Russell: Amen to that. Member Tyler: It's also a noise pollution factor. Attorney: As to the item before you, that is whether you are going to approve the site plan for Polimix. You can either vote it up or down. Chairman Russell: These are the issues we have with that area. Maybe we should of put the other part first. The operation part first. Attorney: What is before you is the site plan. The site plan whether you approve the site as it is configured and designed by Polimix Architects and engineers. It's just the site plan. The second question will be whether you all will approve the development agreement. When you go into discussing of hours of operations that will go to the development agreement as what they will agree to do if you all decide to recommend this item to City Commission. Remember this item will go before the City Commission. They will make the final determination as to grant their site plan approval application or development agreement application. You can vote it down but it will go before the City Commission. The item before you is properly zoned. It's an industrial use. It's an industrial zone. The challenges that the City of Opa-locka faces is there is a lot of spot zoning. You have a lot of industrial areas mixed in the residential areas and that is how the city was engineered 90 years ago. Member Tydus: Somebody please refresh my memory. I guess I've been away to long. We are a point now approving a site plan which says approval for use for them to operate this business is okay. It's already in place. It's just a matter of us approving a site plan. At what point does the City, planning council, Commission, administration, and citizens make the decision to whether or not the type of business in our city. I own my home and if I want to put some kitchen cabinets in my home I make the decision to what kind of cabinets I want if at all. At what point who makes the decision because something is zoned in a particular way should not mean that we have to honor that business. Will someone please explain this to me? Attorney: As I said earlier. You all can recommend to the City Commission. Member Tydus: We are not talking about the site plan. Who makes the decision whether or not if we want this particular business in this approved zoning? 51Page Attorney: There is no business being operated out of that facility. It's in an industrial area It's zoned industrial. They are coming in to attempt to take advantage of the zoning designation. They've gone through the process with Community Development and Planning to follow the process is laid out by the city land development regulation and the city zoning ordinance. Now they've brought to you for your initial review in recommendation. Once you make your initial review and recommendation then the City Commission will make the final determination to permit this type of business in that industrial zone. Chairman Russell: We understand that clearly Mr. Attorney. Does anyone else have any questions for the applicant? Oscar Robayna: May I make a statement please. Chairman Russell: Yes. Oscar Robayna: On the note of dust the facility that is located behind us. It is a food preparation facility. They are in the middle of inquiring there certification for food preparation. They've gone with their engineer and they've established that there will be no problem to their facility to pass standards that are in place for that certification. I would like for you to take that in to account when you consider the issue of dust. Does it meet the requirements of City of Opa-locka zoning code? Chairman Russell: Yes it meets the requirement but that doesn't mean we agree it should go there for different reasons. The condition of our city means a lot to us. We live in this city. I don't go home to North Miami or Palm Beach. I'm looking for a better situation in our community. This is my message to this board and the commissioners. Does anyone else have questions for the applicant? We will now move to Public Hearing. Mr. Gay: May I suggest we have the presentation by staff therefore everyone is fulfilled with all information. Chairman Russell: They may present. Gerald Lee: Our presentation is Polimix Properties, LLC. The applicant proposes to construct a concrete batching facility at 14800 NW 24`h Court. The location will provide for storage/parking of 12 concrete delivery trucks, storage of aggregates and additives for the mixtures, fuel for the front-end loader, and a 1,630 square foot building and two batch plants. The proposed facility will be located upon a 54,000 square foot site which is comprised currently of two tax folio id's, 08-2122-025-0510 and 08-2122-025-0500, and is currently owned by 14800 Investments, LLC. 6IPage Chairman Russell: Mr. Lee before you go far. Are they going to put a fuel tank in the ground? Mr. Lee: Yes. Chairman Russell: Is it zone two or three? Mr. Lee: It is zone two. Chairman Russell: You do know that fuel tanks are not allowed in zone two only in zone three. Mr. Gay: There is some detail to the type of fuel they will be using and with this type of equipment diesel fuel will be used. The actual tank will not be in the ground. It will be on top of the ground as we've understood the plans that were presented to us. Chairman Russell: He answered for you right? Mr. Lee: Yes. Chairman Russell: I asked you but he answered for you. Mr. Gay: We are a team we provide information. Chairman Russell: You have to let me so I'll know who to listen too. Mr. Gay: My apology sir. Mr. Lee: When you look around the property all of the zoning is industrial until you get close to 27th avenue. Everything else around it is I-2. I want you to know that the building that use to stand on this property was involved in a fire maybe a year ago. All of that on the property has been removed. There is nothing on the site now but space. It is a vacant property. This use is not in conflict with any other industrial uses. Chairman Russell: We have a compact city. We have allowed a lot of this stuff. It's time for a change. Mr. Lee: One of the concerns is the point of Ingress and Egress. The council may only suggest other alternatives to travel. Chairman Russell: I understand about the zoning. The condition of that area is poor. We have to get a grip on what we are going to do in this city. It is so much negative in that area but you can finish your recommendation. 7IPage Mr. Lee: We can talk about planning routes and you can describe routes you would like them to take. Chairman Russell: Go back to the last one on the physical impact roads. Mr. Lee: I recommend them reaching out to be a part of a maintenance program because they may have the most possible effect to the area because of the weight of their trucks. I understand that may a presentation about the weight of the trucks not being an issue but that can go further depending on what they bring to the table. All recommendations are all listed in the staff report allows this development to go forward. Our recommendation is for approval. Chairman Russell: Public Hearing is open. Alvin Burke: My name is Alvin Burke. My address is 1240 Jann avenue. First of all, we have one big concrete operation already in the city of Opa-locka. If you ride down 19th avenue from 135th street to 144th and 145th you'll find all of the streets are torn up because of the big trucks. They are saying the trucks won't make a difference. The trucks will make a difference. I'm coming before you tonight and I'll be coming before the Commission. I live on "Jann" and I'm right across the street from this. Nobody in Community Development lives in this city. They talk about a Developer's agreement but who is going to enforce it. Who's enforcing the developer's agreement that is in place now? We have a property on 135th street with a developer's agreement and it looks like a junk yard. We don't need any big trucks messing up our roads. I know it's going to affect me. Who is going to sit around and watch the trucks take their routes? The police department can't do it. I appreciate the businesses coming to our city. I live here and I plan on living here. Mr. Russell you've been here long enough, so you know about developer's agreement. You know nobody enforces it. Chairman Russell: Public Hearing is still open. Mark Cooper: My name is Mark Cooper. I live in South Miami. My address is 6801 SW 75 Terrace. I have pictures of the streets how it floods. As a landlord, the properties that I brought at the time were in foreclosure. A cement factory is different than a warehouse. You can't say it's not going to affect the city. The City Commission just reduced the zoning on all buildings up along 151st street so that we could be better neighbors to Miami Gardens. When ecological waste was here they used Ali-baba. It's only one way to get in. What ends up happening is whatever you think is going to happen the opposite will happen because there are natural forces that affect this area. I noticed here in this agreement the owner should submit annual reports and additional documentation as required. How many annual reports do we get each year from businesses? Chairman Russell: Who are you addressing this too? Member Tydus: Administration. Mr. Gay: As it stands right now based on the time period I've been here we have not received or requested annual reports as it relates to particular projects. Now, as it relates to the monitoring of development agreements we have realized a number of agreements have been done in the past and some of them have not been filed correctly with the county departments. We have taken the steps that are done under my watch to make sure they get to the areas they need too. Therefore the city will have some type of recourse as it relates to whether a developer adheres to their requirement as it relates to the development agreement and that's actually apart of the second issue. Chairman Russell: Thank you Mr. Gay. Any more questions Ms. Tydus? Member Tydus: No. Chairman Russell: I can't support this project. There have been pictures taken and we see the problems we have. I can't support this. Mr. Gay: May I speak on relationships to those pictures. Chairman Russell: I'm going to say something before you say something. I said this before. We passed a project for a plaza, and it isn't nothing but a truck pit stop. I want to say we have to be very careful on pushing projects. We need to work on this type of stuff. The dust and stuff affects us. Gas tanks are not allowed in zone two. We went through that and we know it's not zoned for that. That's our problem everything is on top of things. I can testify when it rains it is an excessive water build-up from 24th court and 149th street going west to 26 avenue. The entire block is flooded as the picture shows. I was very shocked to hear that was not enforced. We can try to control this process as much as possible so the impact of my client is less but What business is going to go into that area with a failing infrastructure like that? Thank you very much. Mr. Lee: We've already reviewed the site plan and the developer's agreement is a tool that can be used to reduce impacts or give guidance on the site plan and how it operates. When we get to a place when we approve the site plan it will be great to have the developer's agreement to go along with it. Chairman Russell: I've been serving on this board for over 12 years. I hate I made approvals on some things. We have projects that have residents suffering. CITY OF OPA-LOCKA THE CITY OF OPA-LOCKA, FL 33054 REQUEST: AN ORDINANCE OF THE PLANNING COUNCIL OF THE CITY OF OPA-LOCKA, FLORIDA TO CORRECT SCRIVENER'S ERRORS IN ORDINANCE 15-31, THE LAND DEVELOPMENT REGULATION (LDR)/THE CITY ZONING ORDINANCE; PROVIDING FOR THE REPEAL OF ALL OTHER CODE PROVISIONS AND ORDINANCES INCONSISTENT WITH THIS ORDINANCE; PROVIDING FOR SEVEREABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE; Mr. Gay: As Mr. Lee comes forward to make his presentation. I just want to let you know you are aware we passed the zoning code in October of last year. As we begun to use the code over the last six months we have noticed errors in information as it was translated from the draft version to the final version and this is our first attempt to correct those errors that has occurred in the zoning code. We've noticed in two aspects one in the language of the code itself. We will be coming back before you in two months. There are some errors within the map itself. Mr. Lee: If you look in your code book under section 22-83 it talks about single family zoning and it should of been reduced to 4800 square feet which is on page 92. The other section 22-84 it deals with the duplex/R-2 family density zoning district. The density for that district is "18-22" units per acre and you can find that on page 97 and under section 22- 86 under townhouse district the density numbers are "24-28" units per acre on page 100. Under section 22-85 it's in the multi family district/R-3 it's moderate density changed from 11IPage "30-36" units per acre on page 98. The next one which is apartment buildings are also in R-3 which allows "40-70" units per acre out to the right driven by the lot size. Two sets of properties could be in the R-3 district and if they are small properties they will use "30-36" units per acre. The larger density will use "40-70" units per acre. This is based on property accumulation. The next section is 22-87 in the R-4 zoning district a density of"75-120" units per acre. The next section is 22-99 under corridor mixed use overlay live/work permitted. No commercial retail sales are allowed. If you have a live work situation you are not allowed to have a restaurant. The next section 22- 128 this talks about issuing a permit for yard sales. In the previous version it states the Planning & Community Development department would issue that permit and it's not. The building department would issue the permit and that's what that change is for. The next section 22-134 chain link fences and I wanted to ask the council, and get your input. Do you want to allow chain link fences in commercial districts? Our code currently states they are not allowed. This is for your consideration. The next section 22-137 talks about distances of places that sells alcohol and its away from parks but it's only suppose to be residential single family and duplexes because a multi-family may be near. Chairman Russell: So you say park and residential? Mr. Lee: Yes. Chairman Russell: You that's impossible in this city. You have a lot of places that sell alcohol that are on top of parks. Mr. Lee: The code of ordinance talks about being 1,000 feet away that sell alcohol period like a liquor store. The next section 22-140 the property site must be 1,000 from residential zoned property and if requested at a site plan review. This talks about having a fuel tank in an industrial zone district. A greater distance than what we discussed. This is not a gas station. This is for a 1,000 linear feet away from residential zoned property and 500 if it's on the site plan and they include containment walls for safeguards. The next section 22-141 talks about certain businesses in certain multi-family zoning districts. If the zoning district is within an overlay that allows then this applies. The next section 22-267 is about public notice. The citation is incorrect and this is the final change we recommend for approval. Chairman Russell: We've been talking a lot about gas. We are so congested. I really have a problem with this unless you're going to let me put a gas tank in my backyard. After a while everyone will be filling their cars up with gas at their business. Gas tanks in the ground are only allowed in I-3 right? Mr. Lee: I-2 and I-3. 12IPage Chairman Russell: It's not zoned for I-2. Mr. Gay: May I add some clarification Chairman if you don't mind. There are different types of fuels. There are fuels for street vehicles. There are then you have another type of gas for tractors and then gas for small equipment. If it is for public consumption those are allowed in our B -2 areas. We don't regulate that it is placed upon us. Chairman Russell: You're talking about diesel gas. Diesel gas is diesel. I understand Mr. Gay. Mr. Gay: I just wanted to bring some clarification. Chairman Russell: Anymore questions? Member Tyler: On the chain link fences, is the reason it was taken out because of the lack of security? If so I would keep it out. Chairman Russell: Chain link fences are so easy to climb. We should not allow them. It's dangerous for kids. Member Tydus: As you utilize the ordinance will you find more errors? Mr. Gay: Remember the zoning code is a fluent document.
