CALL TO ORDER Chairman Wong called the Community Redevelopment Agency Regular Meeting to order at 7:54 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: ABSENT: Member - Capra, Vizcarra, Wilson, Gillanders, Wong Member -None ALSO PRESENT: Executive Director /Agency Counsel Martin, Acting Assistant Executive Director Lambert, Agency Secretary Flandrick 3. CONSENT CALENDAR Mrs. Wilson moved to approve the Consent Calendar, seconded by Vice Chairman Gillanders and unanimously carried. A. APPROVAL OF MINUTES Approved the Minutes of the Regular Meeting of February 20, 2007, as presented. B. ADOPTION OF RESOLUTION NO. CRA 07 -907 — APPROVAL OF PAYMENT OF BILLS Adopted Resolution No. CRA 07 -907, a RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $234,318.22 DEMAND NOS. 3367 THROUGH 3377. C. ADOPTION OF RESOLUTION NO. CRA 07 -908 — APPROVAL OF PAYMENT OF BILLS Adopted Resolution No. CRA 07 -908, a RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $10,544.00 DEMAND NOS. 3378 THROUGH 3383. 4. UNFINISHED BUSINESS — None 5. NEW BUSINESS — None 6. COMMUNICATIONS A. CONSIDERATION OF A REQUEST FOR AN EXEMPTION FROM THE 15% CAP ON RESTAURANT USES WITHIN THE TEMPLE CITY MARKETPLACE Executive Director Martin stated a letter request was received from Susan Lew, Administrator of the shopping center in Block A, asking for an exemption from the 15% cap on restaurant uses within the center. The letter was distributed to all Agency members. Susan Lew provided background information on the Disposition and Development Agreement (DDA) entered into between the City and the developer in 1989 for developing the Temple City Marketplace. The DDA included the restrictions that the non - retail use could not be greater than 10% of the total gross area and the restaurant use not greater than 15% of the total gross area. Her company bought the center from the developer in 1991, and so became a partner with the City. She has been working very closely with City staff and Agency Members and appreciated their Agency Minutes March 20, 2007 Page 2 support. Lately it has been ,,a challenge to fill the center with qualified tenants because of the restrictions on use. The space vacated by the Men's Wearhouse has been vacant for 4 years. Lifestyles have changed and the way people shop is very different than it was 18 years ago. She asked the Agency Members to consider removing this restriction to allow her to find qualified tenants, whether retail or restaurant. Vice Chairman Gillanders stated over the past several years, the parking situation has become critical at the center, and suggested finding alternative parking for shop owners and employees who he believed were taking up a large portion of the parking area. He felt some workable arrangement to the parking situation would make this request more practical, but did not feel that the center could sustain another restaurant at this time because of the parking. Ms. Lew responded that she has not received any complaint from business owners or customers and that her lease agreements with all tenants requires the owners to have the employees park outside of the lot. Mr. Capra questioned if managing the center from her business location in San Diego may be a factor in not being available to hear complaints or to recruit new leases. He stated the City does hear complaints about parking. Ms. Lew stated that she is a broker and works with other brokers in recruiting leases. Her company has a Temple City phone number, so when a client calls, they do not realize she is in San Diego. She is here at the center twice a month. Executive Director Martin suggested the Agency Members consent that he undertake negotiations with Ms. Lew and return to the Agency with specific recommendations. With all Agency Members in agreement, it was so ordered. 7. PUBLIC COMMENTS — None 8. UPDATE FROM EXECUTIVE DIRECTOR — None 9. MATTERS FROM AGENCY MEMBERS — None 10. CLOSED SESSION — None 11.
