HomeMy Public PortalAbout2002-003 Resolution Authorizing Publication of Ord 347Member Jim Lane introduced the following resolution and moved its adoption: CITY OF MEDINA aZ-03 RESOLUTION NO. 4+ 3 RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE,NO.347 BY TITLE AND SUMMARY `}4' WHEREAS, the city' council of the city of Medina has adopted Ordinance No. 347, an ordinance adding a new section 829 to the city's code of ordinances regulating lighting which affects the nighttime environment; and WHEREAS, the lighting ordinance is 11 pages in length and contains charts; and WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, the city council believes that the following summary would clearly inform the public of the intent and effect of the new lighting ordinance. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that the city administrator -clerk -treasurer shall cause the following summary of Ordinance No. 347 to be published in the official newspaper in lieu of the entire ordinance: Public Notice The city council of the city of Medina has adopted Ordinance No. 347. The ordinance establishes comprehensive regulations regarding lighting which affects the nighttime environment. The purpose of the ordinance is to reduce unnecessary lighting and prevent light trespass. The ordinance establishes four lighting zones and sets regulations on the amount of lighting allowed in each. Commercial and industrial areas are generally allowed more light while residential areas, especially in the rural portions of the city, are intended to remain essentially dark. No regulations are imposed directly on residential property. Non-residential uses have two or five years to come into compliance with the ordinance but new or expanded uses must comply immediately.
