HomeMy Public PortalAbout16-9246 Attorney to Acquire Certain Parcels of Land on Cairo Lane Sponsored by: City Manager RESOLUTION NO. 16-9246 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, DIRECTING THE CITY MANAGER AND THE CITY ATTORNEY TO ACQUIRE CERTAIN PARCELS OF LAND ON CAIRO LANE (EXHIBIT-SURVEYS "A") AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENTS (EXHIBIT-PURCHASE AGREEMENTS "B") NECESSARY TO EFFECUATE FOR THE PURCHASE OF THE SAID PARCELS OF LAND (EXHIBIT-APPRAISALS "C") FOR AN AMOUNT NOT TO EXCEED $45,000.00 ; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City is in the process of installing public utilities and resurfacing the road on Cairo Lane; and WHEREAS, The City needs to acquire the parcels of land (Exhibit "A") along Cairo Lane in order to complete the required public utility installation and resurfacing; and WHEREAS, The appraised combined value of the 4 parcels of land is $45,000.00 (Exhibit "C") WHEREAS, It is in the best interest of the City to acquire the 4 parcels of land (Exhibit "A"); and NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference; Section 2. The City Manager and the City Attorney are hereby directed to acquire the 4 parcels of land along Cairo Lane (Exhibit "A") for the combined appraised value of$45,000.00 (Exhibit "C"), and the City Manager is Resolution No. 16-9246 authorized to execute agreements in similar form (Exhibit "B") in order to effectuate the purchase of the 4 parcels of land (Exhibit "A"). Section 3. This Resolution shall take effect immediately upon adoption, and is subject to the approval of the State of Florida Financial Oversight Board. EXHIBIT "B" This instrument prepared by: City Of Opa-Locka Parcel Identification No.: Folio # 08-2128-003-0420 EXCLUSIVE PERMANENT EASEMENT AGREEMENT THIS EASEMENT AGREEMENT (this "Easement Agreement") is made this day of , 2015, by ("Grantor') whose address is and the City of Opa-locka ("Grantee"), whose address is 3400 NW 135th Street, Opa-locka, FL 33054. WITNESSETH: WHEREAS, Grantor is the fee simple owner of that certain property described in Exhibits "A" and "B" (attached) and also described by folio # 08- 2128-003-0420; and WHEREAS, Grantee is the owner of the Right-of-Way described as Cairo Lane which is also described in Exhibits "A" and "B" hereto (the "Grantee's Property"); and WHEREAS, Grantee has requested a 10' x 160' easement for utilities purposes. NOW, THEREFORE, for good and valuable consideration paid by Grantee to Grantor, receipt of which is hereby acknowledged, Grantor and Grantee hereby agree as follows: 1 1. Grant of Easement. Grantor hereby grants and conveys to Grantee, its heirs, successors and assigns forever, 10' x 160' easement upon and under the Easement Property for utilities purposes. This easement is not a sale and creates a non-possessory interest that only entitles the holder the right to use the easement in the specified manner. 2. Construction of Improvements. Grantee, prior to the installation, repair, and maintenance of the easement property (the "Improvements") shall submit to the Grantor, for its approval, the proposed construction contract to be entered into by Grantee with a licensed contractor for the construction of the Improvements, the form and content of which shall be reasonably acceptable to the Grantor. Prior to the commencement of the Improvement work, Grantee shall secure any necessary permits and such work shall be done in accordance with all applicable laws, codes, rules and regulations. All Improvement work shall be conducted in a manner which shall cause the least nuisance or disturbance to the Grantor or any of the tenants, residents, invitees, employees or agents of Grantor. 3. Maintenance, Repair and Replacement. It shall be the Grantee's sole obligation to install, construct, maintain, repair and replace all Improvements on the Easement Property at no expense whatsoever to the Grantor. In the event that Grantee installs, constructs, maintains, repairs or replaces any of the Improvements. Grantor shall not place any improvements within ten feet of the easement or in the area noted on the site plan which must 2 be kept free from obstructions. If the Grantor constructs any improvements in violation of this agreement, Grantee will provide ten (10) days notice to Grantor to remove any obstruction.
