HomeMy Public PortalAbout2002-006 Resolution Granting Site Plan Approval for Property at 29 Hamel RoadMember Bruce Workman introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.02-06 RESOLUTION GRANTING SITE PLAN APPROVAL FOR THE PROPERTY AT 29 HAMEL ROAD WHEREAS, Rowdy Dorweiler (the "Applicant") is the fee owner of the Property located at 29 Hamel Road (the "Property"); and WHEREAS, the Property is located within the uptown Hamel area of Medina and is zoned Uptown Hamel PUD District; and WHEREAS, the Applicant has applied for approval to change the use of the Property from commercial to residential; and WHEREAS, within the Uptown Hamel PUD District, a change in use from commercial to residential requires site plan review and approval pursuant to Section 825.55 et sec . of the city's code of ordinances; and WHEREAS, the Applicant's proposed site plan was reviewed by the planning commission at its meeting on January 8, 2002; and WHEREAS, the city council reviewed the matter at its meeting on January 15, 2002. NOW THEREFORE, BE IT RESOLVED by the city council of the city of Medina that site plan approval is hereby granted to the Applicant regarding the Property, subject to the following terms and conditions: • ' 1. The approved site plan is attached hereto and incorporated hereby by reference. The Applicant must comply with all elements of the approved site plan and the additional terms and conditions of this resolution. 2. All exterior lighting installed on the Property must be downcast and enclosed on all sides except the bottom so that no light is cast directly on other properties or rights -of -way; 3. The blacktop parking area in the front of the building must be removed and replaced with sod or landscaping by September 1, 2002; 4. The Applicant must submit a landscaping plan satisfactory to the city staff and install the required landscaping; 5. The Applicant must pay an administrative fee to the city in an amount sufficient to reimburse the city for the cost of reviewing this application; and RHB-209595v 1 ME230-326 6. The approval hereby granted is valid for a period of one year from the date of adoption of this resolution. Thereafter, the approval is null and void. BE IT FURTHER RESOLVED by the city council of the city of Medina, Minnesota that the city has reviewed the Applicant's site plan for the Property for its compliance with the requirements of the Uptown Hamel PUD District. The city council notes that certain goals and objectives have not been fully satisfied but believes the attached site plan is adequate for the following reasons: (a) The approved site plan complies with the maximum front yard setback established by section 834.05, subd. 4 to the degree possible in light of the location of the existing structure. (b) The minimum lot size for residential uses established by section 834.05, subd. 8 has been met to the degree possible in light of the fact this is an existing lot. (c) The maximum hard surface coverage of 40 percent established by section 834.08, subd. 3(m) is exceeded but is reasonable in light of the fact that the site is already developed, the blacktop in front of the structure will be removed and that the Property is likely to be used for commercial purposes again in the future. (d) The minimum landscaping requirement established by section 834.08, subd. 3(m) will be met to the degree practicable in light of the existing hard surface coverage. (e) The design of the fences or walls does not meet the requirements of section 834.08, subd. 3 (o) but they do not belong to the Property. (f) The requirement that all utilities be underground found in section 834.08, subd. 3(f) is not reasonable for existing structures to be used for residential purposes.
